Jeanna Marie Hattaway, 29, of West Main Street Road, Batavia, is charged with two counts of petit larceny. On May 31, at 8:30 p.m. Hattaway was arrested after allegedly stealing various items from two separate neighbors' yards in the area. She was issued an appearance ticket for Town of Batavia Court at 1 p.m. on July 7. The case was handled by Sheriff's Deputy Michael Lute.

Joseph Alexander Mazuera-Cortes, 27, of Blackburn Lane, Mount Hope, Ontario, Canada, is charged with driving while intoxicated, and operation of a motor vehicle with a BAC of .08 percent or 1 percent or more. At 12:55 a.m. today, the subject was allegedly driving a motor vehicle in an area that was restricted to pedestrians at the Darien Lake Campgrounds, 9993 Alleghany Road, Darien. When questioned by Darien Lake security, he allegedly attempted to flee the area, driving erratically through the campground. He allegedly drove down a restricted lane into a heavilty wooded area before stopping. He was taken into custody by security officers. He was allegedly found to be intoxicated and arrested for DWI. The case was handled by Sheriff's Sgt. John Baiocco.

Dakota David Swimline, 19, of Trumbull Parkway, Batavia, is charged with unlawful possession of marijuana. Following an investigation of a liquor law violation complaint on Farnsworth Avenue in the Village of Oakfield, Swimline was arrested at 1:13 a.m. today after allegedly being found in possession of a small amount of marijuana hash oil in the front pocket of his pants. He was issued an appearance ticket of Town of Oakfield Court and is to appear there June 27. The case was handled by Sheriff's Deputy Eric Meyer, assisted by Deputy Andrew Hale.

Sterna Gettel Grunwald, 31, of McNamara Road, Spring Valley, is charged with unlawful possession of marijuana. The defendant was stopped following the observation of vehicle and traffic violations on Route 63 in the Town of Batavia at 11:15 p.m. on May 30. An odor of marijuana was allegedly detected emanating from the vehicle and Grunwald was allegedly found in possession of marijuana. Grunwald was issued an appearance ticket for Town of Batavia Court at a later date. The case was handled by Sheriff's Deputy Ryan DeLong, assisted by Deputy Eric Meyer.

A male was bitten in the eye by a snapping turtle and is now in the clubhouse at the Chestnut Hill Country Club awaiting evaluation by medics. It is located at 1330 Broadway Road in Darien Center. Darien ambulance is responding.

William S. Webster, 24, of Parsells Avenue, Rochester, is charged with unlawful possession of marijuana, unlawfully dealing with a child, and consumption of alcohol in a motor vehicle. At 12:04 a.m. this morning, Webster was stopped at a DWI checkpoint on Route 33 in the Town of Batavia. He was allegedly found to be in possession of marijuana and consuming alcohol in the vehicle and providing alcohol to a minor. He was issued an appearance ticket for Town of Batavia Court on June 13. The case was handled by Sheriff's Deputy Kevin Forsyth.

Seth Ryan Doster, 24, of Alleghany Road, Darien, is charged with criminal possession of a controlled substance in the seventh degree. At 8:40 p.m. on May 27, the defendent was arrested after he was searched following a traffic stop on Florence Avenue in the City of Batavia. He was allegedly found in possession of a controlled substance. The defendant was released on an appearance ticket for City Court at a later date. City police assisted in the investigation. The case was handled by Sheriff's Deputy Ryan DeLong.

Angelo A. Cassidy, 39, of East Main Street, Le Roy, is charged with second-degree criminal mischief and third-degree grand larceny. He was arraigned on the charges at 11:10 a.m. on May 18 and released under supervision of Genesee Justice. It is alleged that at noon on Oct. 20, Cassidy removed a home-heating system, appliances and building supplies from a residence on Washington Avenue in the City of Batavia without permission. He is to appear in City Court at 9:30 a.m. on June 16. The case was handled by Batavia Police Officer Jason Davis.

Kiha Samuel McNear, 18, of Walnut Street, Batavia, is charged with harassment and endangering the welfare of a child. McNear was arrested at 1:50 a.m. on May 22 on Walnut Street in Batavia after allegedly striking an individual multiple times in the face with a closed fist. The alleged victim was under the age of 17. McNear was jailed on $1,000 bail and was to return to City Court on Monday (May 23). The case was handled by Batavia Police Officer Matthew Wojtaszczyk, assisted by Officer Peter Flanagan.

Twan Conway, 45, of Walden Creek Road, Batavia, is charged with second-degree harassment. Conway was arrested following a 9-1-1 call hang-up investigation. The call was made at 12:30 p.m. on May 17. Conway was arraigned at 10:30 a.m. on May 22 and jailed on $500 bail. Conway was scheduled for City Court on May 23. The case was handled by Batavia Police Officer Matthew Wojtaszczyk, assisted by Officer Kevin DeFelice. Then on May 23, at 7:40 p.m., Conway was arrested again following an incident wherein he allegedly pushed another person while an active order of protection was in place. He was jailed without bail and is be in City Court tomorrow, May 27. This case was handled by Batavia Police Officer Stephen Cronmiller.

Michael Patrick Sullivan, 53, of Main Road, Stafford, is charged with second-degree criminal contempt and second-degree harassment. At 7:54 p.m. on May 24, Sullivan was arrested after allegedly violating a court order by subjecting two people to physical contact by throwing a glass item at them. He was jailed on $1,000 bail and is to be in Town of Stafford Court on June 9. The case was handled by Sheriff's Deputy James Diehl, assisted by Sgt. Eric Seppala.

Sara Jo Likus, 30, of Townline Road, Darien, is charged with: driving while ability impaired by drugs or both alcohol and drugs; driving on the sidewalk; and moving from lane unsafely. At 9:28 p.m. on May 18, it is alleged that Likus drove a vehicle while her ability to do so was impaired, and that while driving she changed lanes unsafely and drove over the curb onto the sidewalk, striking a utility pole. She was issued several tickets and released to a third party. She is to be in City Court on June 8. The case was handled by Batavia Police Officer Jamie Givens.

Charles-Gus Williams, 37, of Robinson Road, Lockport, is charged with second-degree criminal contempt. At 1:49 p.m. on May 20, it is alleged that Williams violated a complete stay away order of protection at a residence on Maple Street in the City of Batavia. He was jailed on $2,500 bail and was due in City Court on May 23. The case was handled by Batavia Police Officer Christopher Lindsay.

Jeffrey D. Matla, 56, of Alexander Road, Batavia, is charged with: DWI -- common law; speeding; failure to signal a lane change; and DWI with a BAC greater than .08 percent. Matla was arrested at 5:18 p.m. on May 22 on West Main Street in Batavia following a traffic stop. He was stopped for traffic violations and allegedly found to be operating his motorcycle in an intoxicated condition. He was released and is to be in City Court on June 8. The case was handled by Patavia Police Officer Cowen Mitchell.

Joshua Yeomas, 31, of Lewis Place, Batavia, is charged with third-degree unlicensed operation and failure to use headlights while operating with windshield wipers. Yeomas was located during an unrelated NYS Parole investigation, assisted by Batavia PD, and taken into custody on an arrest warrant stemming from an incident on April 13 on West Main Street, Batavia. He was released and is to appear in City Court at a later date. The case was handled by Batavia Police Officer Marc Lawrence, assisted by Officer Jason Davis.

Bert Clifford Earl, 55, of Grandview Terrace, Batavia, is charged with harassment. He was arrested at 11:50 p.m. on May 20 following a disturbance at Batavia Downs wherein he allegedly subjected another person to unwanted physical contact. He was issued an appearance ticket and is to be in City Court on June 7. The case was handled by Batavia Police Officer Peter Flanagan, assisted by Officer Arick Perkins.

Lori A. Brightenfield, 56, of Maple Street, Batavia, is charged with petit larceny. She was arrested for writing a check to a business on May 18 to buy alcohol when she allegedly knew she did not have the funds to pay for it. She was issued an appearance ticket for City Court and is to be there on June 7. The case was handled by Batavia Police Officer Jamie Givens.

Carol M. Pahuta, 47, of Byron Holley Road, Byron, is charged with petit larceny. Pahuta was arrested following a larceny investigation on West Main Street in Batavia. She was issued an appearance ticket and released. She is to be in City Court to answer the charge on May 31. The case was handled by Bataiva Police Officer Kevin DeFelice.

Daniel Colin Healy, 25, of North Street, Batavia, is charged with aggravated unlicensed operation in the third degree. He was taken into custody at 1:48 p.m. on May 23 by Gates PD on an active bench warrant out of City Court for failing to appear on the charge, stemming from an incident June 27 on Vine Street in the City of Batavia. He was jailed on $250 bail and was to be in City Court Wednesday (May 25). Batavia Police Officer James DeFreze handled the case.

Mark J. Zinni, 21, of Evergreen Drive, Batavia, is charged with driving without lights and unlawful possession of marijuana. Zinni was arrested following a traffic stop on Pearl Street at 11:39 p.m. on May 21 in the City of Batavia. It is alleged that Zinni was driving without lights and that he was in possession of several small bags containing marijuana. He was released on appearance tickets and is to be in City Court on June 7. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Matthew Lutey.

Katelyn C. Kubala, 27, of Genesee Street, Batavia, is charged with unlawful possession of marijuana. She was arrested on a warrant for NYS Parole. At the time she was taken into custody, at 10:59 a.m. on May 20, she allegedly had a quantity of marijuana in her purse. She was turned over the NYS PArole Officer April Fuller at BPD and is to appear in City Court on May 31. The case was handled by Batavia Police Officer Jason Davis.

Michael W. Funke, 21, of Vine Street, Batavia, is charged with unlawful possession of marijuana. Funke was arrested following a traffic stop on Pearl Street at 11:52 p.m. on May 21 in the City of Batavia. He was a passenger in the vehicle and allegedly in possession of marijuana. He was released on an appearance ticket and is to be in City Court on June 7. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Matthew Lutey.

Julie L. Dutton, 21, of Central Avenue, Batavia, was arrested on May 23 on a bench warrant out of City Court. It is alleged that she violated the terms of her release under supervision. She was jailed on $5,000 bail and is due in City Court today. The case was handled by Batavia PoliceOfficer Christopher Lindsay.

Andrew C. Webster, 23, of Martin Road, Akron, is charged with failure to appear. At 4:05 p.m. on May 20, Batavia police took custody of Webster from NYS police on a City Court arrest warrant for failure to appear. Webster paid an undisclosed amount of bail and was released. He was to be in City Court on May 24. The case was handled by Batavia Police Officer Arick Perkins.

Brian J. Dorman, 32, of Bank Street, Batavia, is charged with owning an unlicensed dog in the City of Batavia. He was issued an appearance ticket and is to be in City Court on June 7. The case was handled by Batavia Police Officer Christopher Lindsay.

A man in his 50s was reportedly pinned by a vehicle at 1414 Broadway Road in Darien. Mercy medics are called to respond along with Darien Fire Department. The patient is described as "conscious and alert with a slight contusion to the upper head, multiple contusions on both legs."

She was arrested at 3:54 p.m. on May 19 after she was allegedly found by police to be engaged in sexual activity with another individual in DeWitt Recreation Area on Cedar Street in the City of Batavia. Robert V. Wasinger, 18, of Delevan Elton Road, Delevan, is charged with public lewdness. He was arrested at 3:54 p.m. on May 19 after he was allegedly found by police to be engaged in sexual activity with another individual in DeWitt Recreation Area on Cedar Street in the City of Batavia. He was issued an appearance ticket for 1 p.m. on May 31 in City Court. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Mitchell Cowen.

Britanny B. Cina, 27, of Ross Street, Batavia, is charged with DWI -- common law, and DWI per se. At 1:56 a.m. on May 21, Batavia police responded to the 7-Eleven store on East Main Street for the report of multiple subjects fighting in the parking lot. Upon further investigation, Cina was arrested after it was learned that she allegedly drove a motor vehicle to the convenience store in an intoxicated condition. She was arrested and processed at BPD headquarters where a chemical test was administered, and allegedly it found her BAC to be over the legal limit. She was issued traffic tickets and her City Court date is set for June 1. The case was handled by Batavia Police Officer Arick Perkins, assisted by Police Chief Shawn Heubusch.

Alexander J. Jasinski, 22, of Godfreys Pond, Bergen, is charged with: driving with a BAC of more than .18 percent; DWI; third-degree aggravated unlicensed operation; failure to stop at a stop sign; and moving from lane unsafely. At 9:52 p.m. on May 21, Jasinski was allegedly involved in an accident at the intersection of West Avenue and Weatherwax Road in the Town of Elba. He was westbound on West Avenue when he allegedly failed to stop at the stop sign and his pickup truck went through the intersection and struck a 15-by-15 foot building, a fence and a parked car before coming to rest. The case was handled by Sheriff's Sgt. Ronald Meides, assisted by Deputy Eric Meyer.

Byron Gilbert Keller, 21, of Sumner Road, Darien, is charged with: driving with a BAC of more than .08 percent; driving while intoxicated; unlawful possession of marijuana; and failure to keep right. At 4:59 p.m. on May 21, following a report of a motor-vehicle accident at 9864 Alexander Road in the Town of Alexander, Keller was arrested and charged as noted above. Keller is to appear in Town of Alexander on June 14.

Nikki L. Stonebraker, 27, of Liberty Street, Batavia, is charged with unlawful possession of marijuana. Stonebraker was arrested following an investigation into an alleged distrubance on Liberty Street at 9:21 a.m. on May 19. The defendant was issued an appearance ticket for this afternoon in City Court. The case was handled by Batavia Police Officer Jason Davis, assisted byn Officer Kevin DeFelice. At the same incident, she was also charged with endangering the welfare of a child following a physical domestic incident with her former boyfriend which was allegedly witnessed by her children. For that case, she was released under supervision of Genesee Justice and is to be in City Court to answer the charge at a later date. The case was handled by Batavia Police Officer Marc Lawrence, assisted by Officer DeFelice.

Christopher T. Sprague, 22, of 36 Dellinger Ave., Batavia, is charged with second-degree criminal use of drug paraphernalia. He was arrested at 5:55 p.m. on May 12 after NYS Parole checked his residence and allegedly found drug packaging material inside. He was issued an appearance ticket for City Court on June 14. The case was handled by Batavia Police Officer Christopher Lindsay.

Selina Sarai Tapia, 20, of State Street, Holley, is charged with unlawful possession of marijuana. She was arrested following a traffic stop at 4:20 p.m. on May 16 on Alleghany Road in Alabama during which time was allegedly found to be in possession of marijuana. She was issued an appearance ticket for Town of Alabama Court on June 21. The case was handled by Sheriff's Deputy Michael Lute.

Turning onto Simonds Road in Darien yesterday, I saw big flag waving from a building that said, "OPEN," and a smaller sign that said "old tractor parts for sale."  

That looked interesting. It had never caught my eye before, so thinking it was a new business, stopped.

Turns out, Ron and Margie Rupp are now in their third year of business. Only the flag is new.

And it's not just old tractor parts they sell. They can get new and old parts for every make and model of tractor as well as all other farm equipment.

"It doesn't matter if it's green, blue or yellow," Ron said.

Ron Rupp said he represents five different parts dealers.

"If it's available, we can get it," he said.

He started the business in part to keep him busy in retirement, but over the last year or so, it has really started to pick up, he said.

Besides selling parts out of a trailer on their property, or ordering whatever a customer needs, they also travel around to tractor and steam shows. That keeps them busy during the summer months.

Darien Lake Theme Park unveiled its newest water ride today, RipCurl Racer, a 24-second roaring slide through curling tubs before splashing down in the pool at the bottom of the ride.

The Neid Marcucci family of Batavia was officially the first riders of RipCurl.

The ride is part of a $1.5-million capital investment in the park and was previewed today for the season.

“Bringing in RipCurl Racer, the third new thrill ride to join the park’s lineup over the past year, is really exciting for us,” said Chris Thorpe, general manager at Darien Lake. “The continued growth and expansion at Darien Lake is a testament to our dedication to providing guests with the best entertainment value in the region.”

The growth of the state's largest seasonal employer is a continued benefit to the local economy, said GC Chamber of Commerce President Tom Turnbull.

“With the addition of RipCurl Racer, Darien Lake continues to invest in Genesee County and solidify its position as one of the top family entertainment destinations in Western New York and the entire Northeast,” Turnbull said. “Not only does Darien Lake provide a premier entertainment venue, but they also are the leading provider of seasonal jobs that are vital to our local economy.”

Darien Lake hosted its fourth annual Color Me Rad 5K fun run today, with proceeds this year benefiting substance abuse and rehabilitation programs.

The fourth annual "Color Me Rad" 5K -- a nationally recognized human tie-dye spectacle and run/walk -- returns to Darien Lake Saturday, May 14, rain or shine.

A total of 2,500 color-plastered participants are expected. This year, proceeds will benefit the Erie County Council for the Prevention of Alcohol and Substance Abuse.

All participating runners/walkers receive free access to Darien Lake Theme Park the day of the race. To top it off participants will also get a free T-shirt, temporary tattoo, and a Goo Guard phone case.

The course is the same 3.1-mile fun run with twice as many color stations. That means every half a mile our volunteer Color Bomb Squads will cover people from head to toe in pink, yellow, green, blue and violet.

New this year are Gel Color Stations. Participants will be colored rad all over with a cooling sensation and full coverage of spectacular colors.

The fun begins at 9 a.m. and ends at 11:30 a.m. at the theme park, located at 9993 Alleghany Road in Darien Center.

Cost is $50 per person today, $55 on Saturday. Kids' pack -- for ages under 7 -- is $15 each.

Yesterday was the first day of another new season of fun at Darien Lake Theme Park.

While we didn't get out to Darien for photos until the afternoon, after the clouds arrived, the morning blue skies helped encourage a great first-day attendance, park officials said.

RipCurl Racer

Towering above the ground at 42 feet, six mat-riding competitors launch themselves headfirst into side-by-side tunnels and rocket through the twisting tunnels before accelerating into separate racing lanes. Riders then drop down the home stretch, enjoying speed, compression and zero gravity moments as they blast into a high-velocity finish. RipCurl Racer will begin taking riders on the water park’s opening day – May 21.

Ignite the Night Laser Show

Darien Lake’s Ignite the Night laser show has been upgraded to include full-color laser beams; extra pyrotechnics, and an all-new soundtrack. Ignite the Night, presented by Tops Friendly Markets, takes place every evening at 10:10 on the lawn at the Lakeside Amphitheater from May 20 to Sept. 4.

In-Park Concerts

The in-park concert series presented by Tops Friendly Markets are free with a Season Pass, a hotel/camping package or daily admission. The series will take place on the Performing Arts Center stage, with access to and from shows provided exclusively through the park. The concert series includes performances by Jacob Whitesides and Laura Marano on May 28, Rachel Platten on June 4, Sabrina Carpenter on June 25, and the latest addition Daya and Shawn Hook on July 2.

County planners expected a detailed discussion last night about a proposed Arby's restaurant at 8364 Lewiston Road, Town of Batavia, but the applicant withdrew the application earlier in the day.

County Planning Director Felipe Oltramari said he expects the proposal to come back to the planning board at a later date, perhaps as soon as the meeting next month.

There are a few variances needed for a 2,000-square-foot fast-food restaurant at the location, which is across from Kmart where a used car lot is now and next to Jerry Arena's Pizza.

The zoning code for the town requires a 40,000-square-foot lot for such an establishment, but the lot size at this location is only 29,664 square feet.

The builders are proposing parking spaces of 9x18 feet, instead of the required 10x20 feet.

The restaurant will also require three signs instead of the permitted two, with one being a bit larger than the sign ordinance allows.

The owner listed on planning documents is Bill Meland, with a business address of the current Arby's location on West Main Street in the City of Batavia.

In other matters brought to the board Thursday night:

• The Chamber of Commerce received approval plans to remodel 8276 Park Road, Batavia, which will become the new headquarters for the chamber and the visitors' bureau once it's completed. The project includes a building addition, facade renovations, a new roof and a new accessible ramp.
• Richard Mistretta is planning to open a record store at 220 E. Main St., Batavia, and received approval for his sign.
• The Town of Batavia is planning to revise its zoning code to remove the requirement that certain properties in industrial parks be directly accessed from a state highway. The town has granted three variances in recent years and since there might be addition variance requests that would likely be granted, the town is seeking to remove the requirement altogether.
• The Town of Alabama is extending its moratorium on commercial development for 12 months. This is the third extension sought by the town.
• Daniel Miller and Padrna Kasthurirangan were approved for a windmill at 10021 Simonds Road, Corfu. The windmill will stand 121 feet tall.
• The new Waggin (sic) Wheel Restaurant at 8282 Park Road, Batavia, was approved for outdoor cooking and a change to the commercial sign.
• Suzanne Schultz received permission to hold craft classes at 57 Main St., Oakfield.

The county planning board is not the final word on application approvals. Their approvals are recommendations. Final decisions rest with the planning or zoning boards in each jurisdiction.

A two-car accident is reported at 2025 Attica Road, Darien.

An injury is reported.

The call was first dispatched as a non-injury accident, but the dispatcher later updated the call to say an injury was now reported.

Darien fire and Darien ambulance are dispatched.

UPDATE 7:33 a.m.: Darien is back in service.

On April 7 the New York State Magistrates Association had the honor to place a wreath at the "Tomb of the Unknown Soldier" at one of the nation’s most sacred shrines honoring veterans and their families who have sacrificed their lives for our freedom. The Tomb of the Unknowns is in the Arlington National Cemetery in Virginia.

Hon. Gary Graber, who serves as Town Justice in Darien, Hon. Tanja Sirago, Hon. Harold Bauman and Hon. Dennis Quinn placed the wreath on behalf of the New York State Magistrates Association. They acknowleged that it was an honor and a humbling experience to be able participate in this ceremony honoring our NYSMA members who have served as well as all of those who serve in the Armed Forces both past and present.

The "Tomb of the Unknown Soldier" includes the remains of unknown service members from World War I, World II and the Korean War. Soldiers from the 3rd U.S. Infantry Regiment (AKA "The Old Guard") keep a 24-hours-a-day, 365 days-a-year vigil at the Tomb. The wreath ceremony is memorial in purpose and patriotic in nature, dedicated to the memory of all those interred in the cemetery and to all those dying in the military service of the United States.

Kendra Marie McGuire, 25, of Bryant Street, North Tonawanda, is charged with fourth-degree grand larceny. She was arrested and issued an appearance ticket for April 26 in Darien Town Court. It is alleged that she stole cash and coins valued at more than $1,000 from a residence on Richley Road in Darien in November of 2012. The case was investigated by Sheriff's Deputy Chad Minuto.

Daniel Joseph Kish, 44, of Payne Avenue, of North Tonawanda, was charged with aggravated unlicensed operation, 3rd, and unsafe turn/failure to signal at noon on March 17. He was arrested on the charges March 31 after turning himself in on an arrest warrant out of the City of Batavia. Kish allegedly missed city court for prior alleged traffic violations. Bail was set at $250 and he did bail himself out at city court. He was released and is to reappear in city court on May 18. The case was handled by Sheriff's Deputy Michael Lute.
