Readers report: Dog may have saved three lives at Le Roy house fire

Just after midnight, the Le Roy fire department was called to a structure fire at 8484 E. Main St. Road where upon arrival they found the house fully engulfed, according to reader Gary Spencer.

Lorie Longhany also e-mailed reports of the fire.

Neighbors from across the streets dog barked, woke owner up, he crossed the street and alerted the homeowners.  The husband went back in after car keys and he was burned and taken to the hospital -- wife and daughter also taken in for smoke inhalation.  House is a total loss.

Longhany, who lives on Lime Rock, said units from Le Roy, Stafford, Caledonia, Bergen and Pavilion responded. Route 5 was closed and traffic was sent around York Road and Church Road.

The hero in this fire was a dog named Rocket that is no stranger to alerting danger.  A couple years back this dog was out of his yard and barking around our friends pool.  His owner was calling him to come home.  He wouldn't -- kept barking around the pool.  When his owner went to retrieve him, he found that in the pool was my neighbors and good friends dog, Buddy who would have drown.  Last night, from what my neighbors first hand account, Rocket's barking alerted his owners to the burning house across the street.  The neighbor saw the flames and ran across the street and woke up the homeowners.  That dog may have saved three lives last night.

UPDATE: Lorie sends along this note this morning:

We took a ride by this morning, and as I said, we kept away from the scene and stood in our friends driveway after being awoken to all the commotion, but it appears that the structure is heavily damaged, but not burned to the ground by any means.  The fire fighters did a tremendous job.  It is really amazing the organizational skills that these volunteers put into play as they are battling a fire.  We watched in amazement.  Probably a good many of them were there till the early hours and then had to get up and go to their paying jobs this morning.

Also, she "cautions" that her account of Rocket is third person, having been told by a neighbor who spoke with Rocket's owner.

UPDATE II: WBTA reports:

The home was occupied by 54-year-old Rita Teeter, her 54-year-old boyfriend Daniel Bovee and her 25-year-old daughter, Jennifer Coombs.

Rita and Jennifer were treated at Strong Hospital for smoke inhalation and released.

Bovee was admitted to the hospital in satisfactory condition with burns to his face, head and feet.

Assemblyman Hawley Announces Local Food Drive

Assemblyman Steve Hawley (R, I, C – Batavia) today announced that he is hosting a local food drive throughout the 139th Assembly District in order to help those hit hardest in these tough economic times.

“The generosity and kindness of Western New York residents never ceases to amaze me and while many of our friends and neighbors are struggling right now, there are many of us that know how fortunate we are and grateful that we can help those less fortunate. I am sure that the residents of the 139th Assembly District will show their generous spirit yet again with this food drive that will be benefiting our local food pantries in order to help families, seniors and individuals in need,” said Hawley.

The Assemblyman has posted drop boxes in a variety of locations throughout Genesee, Monroe, Niagara and Orleans counties within the 139th Assembly District where residents can leave non-perishable food donations. The donations will be given to local charities, shelters, and food pantries, including the Salvation Army, Life Solutions, Hilton Food Shelf, Brockport Food Shelf, and Orleans Community Action, among others.

Police Beat: Le Roy 9-1-1 service disrupted following chase and accident

When Jeffrey D. Bald, 27, of Wolcott Street in LeRoy, allegedly fled from police following a reported domestic disturbance, he did more than just send law enforcement officers on a chase, he also reportedly disrupted 9-1-1 service for the village.

Bald reportedly lost control of his vehicle on Myrtle Street and struck a utility pole. That accident caused disruption to the emergency call service, which has now been restored.

UPDATE: We just received this correction from Chris Hayward, chief of police: 

911 service still an issue.  Frontier working on it and they hope to have it resolved by this afternoon.  911 calls being forwarded to 768-2527, if that is busy calls then route to the County.  If they call 911 and still experience a problem call 768-2527 directly. 

Events began around 9:15 p.m. at Bald's residence, where police were called because of a possible domestic dispute.  En route to the residence, police say they spotted Bald driving from the scene on Wolcott.

Bald reportedly drove into the intersection of Route 5, turning westbound on Route 5, nearly striking another vehicle head-on.

Officers attempted to stop the vehicle, but Bald reportedly headed the wrong way down Bacon Street. Upon reaching Route 19, Bald reportedly drove his car southbound to Myrtle Street, which is where he apparently lost control.

Bald then reportedly attempted to flee the scene on foot and he was taken into custody about a half mile from the site of the accident.

Police report speeds in the vehicle chase never exceeded 50 m.p.h.

Bald is charged with DWI, aggravated unlicensed operation, resisting arrest and leaving the scene of a property damage accident, along with other violations. He is being held in Genesee County Jail on $5,000 bail.

Amanda Wittmann, 21, of Bennington, is charged with rape. Wittmann is accused of sexual relations with a 16-year-old in Washington, where authorities issued a warrant for her arrest. She was arrested in Pembroke.

Micahel Innes, 55, of Rochester, is likely going to pay more for his untaxed cigarettes than he anticipated. Yesterday, Innes was stopped in Oakfield for an alleged traffic violation. A Sheriff's deputy noticed more than 400 cigarettes in his car, which is a violation of New York State tax code. Innes will appear in Oakfield Town Court to answer the charges June 8.

Lamarr Randell, 23, of Buffalo, was stopped for allegedly speeding in Pembroke. Deputies report they found marijuana in his possession.  He was cited for both alleged violations.

Timothy Mcjury, 21, of Alexander, is charged with petty larceny for allegedly shoplifting at Home Depot in Batavia.

Joseph Henrick, 59, of Stafford, is accused of violating an order of protection. He is charged with criminal contempt.

No holiday on V.E. Day for LeRoy students

Attention parents and kids in the LeRoy Central School District: there's no holiday on Friday, May 8. That's VE Day -- as in Victory in Europe -- in honor of the unconditional surrender of the Nazis in World War II.

As of 4:30 p.m. May 5, VE Day was still cited on the district's website calender as an official school hoilday.

Oops! It was some sort of administrative error and it's certainly no school holiday.

But it was practically a world holiday in 1945. Millions of people poured into the streets of London, Chicago, Paris, Los Angeles, New York City and elsewhere. Light had overtaken darkness and its synonym, the Third Reich.

On the balcony of Buckingham Palace, King George VI, Princess Elizabeth and Prime Minister Winston Churchill waved to jubilant Londoners. It was also President Harry S Truman's 61st birthday and he dedicated the victory to Franklin Delano Roosevelt, our president who died less than a month earlier, on April 12.

VJ Day -- Victory over Japan -- was still to come, on Aug. 14, 1945 (North American Time). When it was announced, another wave of gleeful hysteria broke out in American streets and the sailor bent over the nurse in Times Square and gave her a big smooch.

(The kissers in the famous Alfred "Eisie" Eisenstadt photo were later determined to be, although there's still debate about this, Carl Muscarello and Edith Cullen Shain. The photo was probably shot with a Leica 250 "Reporter," which used 10 mm film and offered 250 shots before having to reload. The photojournalist's work was featured in the first one-man exhibit offered by the International Museum of Photography at the George Eastman House Museum in Rochester.)

These days, VE Day is a holiday commemorated in the former East Germany, France, the United Kingdom, Slovakia and the Czech Republic. But, again, not in the LeRoy Central School District where Friday will simply be another opportunity to teach and to learn.

Late night fire in LeRoy destroys home, displaces family, sends firefighter to hospital

A firefighter suffered possible heat exhaustion and the family of a home at 70 Church St. in Le Roy has been displaced after a blaze that may have been caused by a discarded cigarette caused extensive damage to the residence.

We received an e-mail this morning from Chief Tom "Woody" Wood confirming the fire we first reported last night (thanks to notification of two alert readers).

The fire was reported at 11:15 p.m.

The firefighter, who is not identified, remains hospitalized this morning for observation.

Here's the full text of Wood's e-mail:

Last night's fire came in about 11:15pm.  First chief on location with a confirmed working bedroom fire.  An additional alarm was transmitted requesting one engine from Bergen and Pavilion to the scene along with Town of Batavia Fast team while Stafford did our fill-in.  At this time we are not releasing the names of the three occupants that were displaced and had to be relocated by the red cross.  Preliminary result indicate a POSSIBLE discarded cigarette.  One firefighter was transported to the hospital for possible heat exhaustion and currently remains there for observation.  The residence suffered extensive damage and the figured amount has yet to be determined. 

House fire in Village of Le Roy has been mostly knocked down

A house fire at 70 Church St. in the Village of Le Roy has been mostly knocked down, according to a county dispatcher.

Firefighers from Le Roy, Stafford, Bergen and Byron responded to the blaze.

No other information available at this time.

Gas leak in Village of LeRoy last night had Main Street shut down

A reader e-mailed us this morning and asked why Main Street in LeRoy was shut down last night.

In response to our inquiry, we just received this e-mail from Deputy Chief Tom Wood:

There was a natural gas leak in the Vintage and Vougue store. The gas leak was in the basement on one of the meters.  Gas odor had spread to to other buildings additional alarm was tramitted for Caledonia and Pavilion Fire Dept.  and residents were evacuated and Main St was shut down for the call.  RG&E arrived and fix the problem

Police Beat: DWI and shoplifting charges

Nicholas A. Cinquino III, 25, of Batavia, was allegedly observed driving down the center lane of West Main about 2:30 this morning. After a traffic stop, Cinquino was taken into custody. He is charged with DWI, with a BAC of more than .18 and ticketed for improper lane usage.

Misty D. Palmer, 21, of LeRoy, is accused of trying to walk out of Wal-Mart with three DVDs. She is charged with petty larceny. Palmer was reportedly caught after the inventory control sensor was activated as she tried to walk out the front door. She was issued an appearance ticket.

Firefighter asks people 'stop burning stuff'

This is my interview yesterday with LeRoy 2nd Asst. Fire Chief Tom "Woody" Woods.

Woods was the chief overheard asking for more help yesterday, saying if he didn't help quickly, "we're going to lose this truck and us."

When I first spoke to Wood yesterday, he said it was quit a battle with the fire jumping out of the woods quickly before he and his crew beat it back.

Wood said the recent spate of brush fires have kept firefighters pretty busy and he said the only way the fire season is going to slow down is if people stop burning stuff.

Injuries reported in single-car rollover accident on Thruway

Two ambulances are responding to a single-car rollover accident on the westbound Thruway at mile maker 382.6 in the Town of LeRoy.

The extent of any injuries are unknown, but an original dispatch of Mercy Flight -- which was 90 miles away -- has been canceled.

All occupants are out of the vehicle.

LeRoy police seek help in rash of larcenies

The LeRoy Police Department is asking for assistance in determining who is responsible for a rash of overnight larcenies from unlocked vehicles in the Myrtle Street/Gilbert Street area. 
 
The larcenies have occurred nightly since April 7. The most recent was last night (4/14).   The thefts consist mostly of money and/or other valuables.
 
Witnesses state that teens wearing a dark hoodie and possibly a pink coat may be involved.
 
The LeRoy Police Department asks that you lock all vehicles at night. Any citizen with information about these thefts, or who sees suspicious persons in the area, should contact the LeRoy Police Department immediately at 768-2527 or call 9-1-1.

Police Beat: The case of the missing tires

Gorgon L. Montgomery, 50, of Batavia, allegedly thought he could get something for nothing. He is accused of taking four tires that had been chained to a residential tree and marked "for sale." The tires disappeared the night of April 1 and were allegedly found in the back of Montgomery's pick up truck yesterday. He is charged with criminal possession of stolen property in the 5th degree. He was issued an appearance ticket on the charge.

Gerald P Perkins, 77, of LeRoy, was reportedly stopped for driving a vehicle without break lights. Upon further investigation, the arresting deputy reports, it was determined that Perkins was allegedly driving while impaired by alcohol. He was charged with DWI and released to a friend.

Michael C. Mirabal, 36, of Batavia, is accused of taking and using another person's car with out permission. He is charged with one count of unauthorized use of a motor vehicle, a misdemeanor. He was issued an appearance ticket.

Community packs gym in LeRoy to discuss issues with teenage drinking

Last night citizens of LeRoy and surrounding towns flooded the Gymnasium at LeRoy Village Fitness to listen and voice their concerns on teenage alcohol abuse.

The community forum was scheduled to start at 7:30 p.m., but started ten minutes late because people continued to pile into the gym.

Pastor Jack Hempfling was the moderator and gave a big thank you to everyone for coming out.

In her introductory remarks, LeRoy Central Schools Superintendent Cindy Herzog, said it is all about perspective. We all come with many perspectives, we all wear different hats. She connected with the audience by sharing her own experiences.

She is a mother of five, ages 22, 20,16,14, and 13. She talked about a time when her teenage daughter was out one night and she received a phone call in the early morning hours from the police.

“When you get that phone call you can hardly breathe,” she said.

She talked about her husband always putting on the news in the morning, and the fear she feels every time they mention the teenage arrests.

“I fear every time on R News, it’s going to be one of our kids.”

David Markham, Executive Director of GCASA, tugged at the hearts of the listeners when he answered the question of “Why do I care?” He cares because he lost his 5- and 8-year-old, because of someone making a wrong choice. A drunken driver killed his children.

As he spoke he took the time to pause and let the audience reflect when he said today they would be 22 and 25.

He said we must focus on changing the community norms and attitudes, and decrease access.

Markham brought up a great point about the media reacting to the incident with Janet Jackson, at the Super Bowl. Everyone made a big deal about part of her breast being exposed, but there wasn’t anything wrong with the 22 beer commercials that were shown during the Super bowl.

Today teenagers have access at their fingertips; it is up to parents to decrease access.

Chris Hayward, LeRoy chief of police presented a slide show full of statistics showing the kids who are drinking the most are the age group 13-15.

The Village Police have seen a 131 percent increase in drug and alcohol related arrests since 2003. This is not including DWI arrests.

In 2008 the 13-21 year-old populations represented 53.5 percent of those arrests. Of those arrests the 13-18 year old population represented 73 percent.

On a national level 22.4 percent of eighth graders and fifty percent of seniors consumed alcohol in the last month from data from 2007.

There were 23 underage drinking incidents in LeRoy since May of 2008. One of the incidents in November was a 15-year-old was so drunk she couldn’t walk or stand up, so her friends just left her. Hayward gave praise for the parent who was out looking for their daughter, if they didn’t, who knows what might have happened.

Part of the message was parents must be responsible and get involved. They asked for places for teenagers to go. Seventy one percent of American youth say their parents are their leading influence.

Sixty percent of LeRoy students have used alcohol in their lifetime.

‘We have great kids,” said Hayward, “Some of our kids are making bad choices, choices that could result in death."

It is not about their character, he said, it’s about their choices.

Jackie Whiting, of LeRoy said she is all about the good choices but really pressed the panel with this question, “What are we going to do to offer better choices?” Now that the community is all here showing their concern what are the next steps to take was her main point.

Herzog responded by saying we are a big community that wants to do a lot of things, but the resources are not there. People in the audience were shaking their heads as soon as Herzog said we accept all ideas.

Ed Bishop, a parent who has spent 40 years in public education agreed there needs to be activities for the kids. He asked a powerful question about parenting.

“Most parents do not know,” he said referring to their child’s activities and whereabouts.
“Do you know?” he said.

One parent asked about the emphasis of arresting teenagers for marijuana. She works at Bryon-Bergen and said she knows kids are getting high before class in their cars.

“Pot is extremely accessible,” she said.

Hayward responded saying three weeks ago there was an arrest for possession of marijuana. He said it is a little bit tricky when it comes to making arrests with marijuana but there are arrests being made for it.

It takes a community to raise a child, one woman said and it took a community forum to realize the seriousness of preventing underage drinking in LeRoy.

The organizers gave everyone two folders full of statistics and pamphlets with advice and articles on underage drinking.

Also on the panel: Dana Berg, student, Ed Bishop, parent, Joe Englebert, Jr/Sr High Principal, Lisa Heywood, Parent, Father Michael Rock, St. Peter’s Church.

A note of interest, as I was walking to my car a couple were talking about the pool located in the Village Fitness, talking about how small it is. Then they went on to talk about how the community pool is getting taken away, and said, "Well now the kids won’t even have that."

Meeting to discuss problem of teen drinking called in LeRoy tonight

Residents of LeRoy are asked to attend a community forum tonight to discuss the issue of teenage alcohol abuse.

The meeting will be held at LeRoy Village Fitness, according to WBTA.

Over the past six years, there has been a 250 percent increase in incidents involving under-age drinking. Most recently, a 21-year-old man was found in the Village so intoxicated, allegedly, that he had to taken to the hospital. He allegedly bought and served alcohol to an 18-year-old in the Village.

The meeting begins at 7:30 p.m..

Three people busted in Batavia after investigation into crack cocaine sales

Two Rochester residents and a Batavia man are in custody after an investigation last night by Drug Enforcement Task Force members into the sale of crack cocaine in Batavia.

Arrested where Mark H. Gissendanner, 24, or Rochester, Aileen Nieves, 21, of Rochester and Shawn M.Walburn, 35, of Batavia.

Gissendanner was arrested in the parking lot of 21 Liberty Street, while Nieves and Walburn were picked up in the parking lot of Van Detta Stadium on Union Street.

All three suspects were arraigned in Batavia City Court and are being held without bail.

Gissendanner reportedly sold a quantity of crack cocaine to task force members on two occasions and then was allegedly in possession of more of the drug when he was arrested. He is charged with criminal sale of a controlled substance in the third degree and criminal possession of a controlled substance  in the third degree.

Nieves reportedly sold crack cocaine to an undercover office while in Batavia and was allegedly in possession of more crack when she was picked up. She is charged with criminal sale of a controlled substance in the third degree and criminal possession of a controlled substance  in the third degree.

Walburn was allegedly in possession of crack when his vehicle was stopped by task force members in Batavia. He is charged with criminal possession of a controled substance in the forth degree.

Participating in the investigation were members of the Genesee County Sheriff's Department, the Batavia Police Department and the LeRoy Police Department.

Police Beat: Teen from North Chili charged with sexual misconduct with LeRoy girl

Michael J. McCauley, 19, of North Chili, is charged with one count of unlawfully dealing with a child and one count of sexual misconduct. The investigation began in November 2008 when the mother of a Village youth came home to find McCauley allegedly in the house with her underage daughter. The daughter was allegedly served alcohol.  It was later alleged that McCauley and the daughter had been involved in a sexual relationship over the previous year. McCauley was arraigned and released on an order of protection.

Kyle W. Nash, 21, of LeRoy, was arrested early Monday morning for allegedly supplying a minor with alcohol. Nash was reportedly observed with an 18-year-old on Lincoln Avenue. Nash was found to be so intoxicated that police had him transported via ambulance to a hospital. Police believe Nash purchased and supplied his 18-year-old companion with alcohol. He is charged with unlawfully dealing with a child.

Sheldon Wetmore, 19, of Wyoming, was arrested in Alexander on Sunday afternoon for alleged unlawful possession of marijuana. The reported marijuana was found after Wetmore was stopped for an alleged unsafe lane change.

Jerrod J. Cramer, 31, of Alabama, was charged with a DWI Saturday afternoon after being stopped for an alleged traffic violation. Sheriff's Deputies report an open contain was found in Cramer's vehicle. He is charged with a DWI with a BAC of more than .08 percent. He was also cited for hauling an unlicensed, uninspected trailer.

Rodney McKenzie, 44, of Alden, was charged with criminal contempt for allegedly violating an order of protection out of the Town of Alabama court. McKenzie allegedly placed several harassing phone calls to an individual he was ordered not to contact.

Amanda L. King, 27, of LeRoy, was arrested Friday by LeRoy police officers on a charge of harassment in the second degree, and one count of endangering the welfare of a child. King allegedly bit a 12-year-old child during a domestic incident, leaving a bruise. King was arraigned and released on an order of protection.

Jeffery L. Bowker, 44, of Bergen, is charged with DWI out of the Village of LeRoy, after Det. John Condidorio reportedly observed Bowker make a wide right turn at routes 5 and 19, almost striking another vehicle. The subsequent investigation found that Bowker reportedly had a BAC of .18 or higher.

Dale R. Williams, 25, of LeRoy, was arrested in Bergen Saturday morning for an alleged DWI. Wiliams is reported to have had a BAC of .08 or greater. He is also charged with unlicensed operation of a vehicle.
