Charges were dismissed in Federal Court in August against the one person arrested on the Tonawanda Indian Reservation as the result of a raid related to alleged synthetic drug sales at smoke shops.

Tiffany E. Greiner, 22, of Akron, was arrested in July on a single count of conspiracy and possession with intent to distribute a controlled substance analog intended for human consumption.

Joseph LaTona, her attorney, said this morning that the charges were dismissed because a witness was out of town and not available for a scheduled court appearance. The prosecution didn't want to adjourn the case, so LaTona moved to dismiss the charges and the judge granted the request.

Federal prosecutors still have the option to take the case to a grand jury and seek an indictment.

Barbara Burns, spokeswoman for the U.S. Attorney's Office in Western New York, declined comment on the dismissal, but said authorities continue to investigate the case related to the Tonawanda raids. She said authorities continue to seek witnesses or other people with information and encouraged members of the public to come forward with any information they might have related to the alleged sale of synthetic drugs at the reservation.

Brandon M. Maldonado, 24, of 146 Summit St., Batavia, was arrested on warrants for alleged petit larceny and criminal mischief. Maldonado was located at the scene of the fire Sunday night at 140 Summit St.

Bethani M. Dibble, 20, of 146 Summit St., Batavia, is charged with DWI, driving with a BAC of .08 or greater and leaving the scene of a property damage accident. Dibble allegedly drove her vehicle into the porch and fence of her residence and then left the scene of the accident at 2:38 a.m., Saturday.

Daniel E. King, 36, of 2058 Phelps Road, Basom, is charged with petit larceny and harassment, 2nd. King is accused of stealing a can of Mike's Hard Lemonade from a convenience store on West Main Street and then hitting the store manager when confronted.

Daryl R. Hamler, 18, of 6786 Westcott Road, Le Roy, is charged with unlawful possession of marijuana. Hamler was charged after allegedly being found in possession of marijuana while driving through a DWI checkpoint on Clinton Street.

Alicia M. Stanwick, 21, of 318 E. Main St., Apt. 2, Batavia, is charged with DWI, driving with a BAC of .08 or greater and inadequate stop lamps. Stanwick was stopped at 1:36 a.m., Sunday, on Main Street, Batavia, by Officer Marc Lawrence.

Katelyn Louise Hodgins, 24, of Pringle Avenue, Batavia, is charged with DWI, driving with a BAC of .08 or greater, driving left of pavement markings and open container. Hodgins was stopped at 1:17 a.m., Saturday, on Seven Springs Road, Batavia, by Sgt. Greg Walker.

Thomas Allen Pfalzer, 45, of Harper Road, Darien, is charged with DWI, driving with a BAC of .08 or greater, driving while on a mobile phone, consumption of alcohol in a motor vehicle and unlawful stopping or parking in the roadway. Pfalzer was allegedly located at 2:04 a.m., Saturday, in his vehicle stopped on Sumner Road, Darien, talking on his mobile phone. Upon investigation by Deputy Jason Saile, Pfalzer was allegedly found to be intoxicated.

Darrell Jerrod Holloway, 44, of Crowydon Road, Rochester, was arrested on a bench warrant for alleged failure to pay a fine. Holloway was taken into custody following his release from the Elmira Correctional Facility, where he was held on an unrelated matter. Holloway was jailed pending a court appearance.

Tyanna Desiree Green, 17, of Lewis Place, Batavia, is charged with petit larceny. Green allegedly stole two CDs from Kmart.

A car reportedly hit a dump truck and is on fire in the area of 1151 Bloomingdale Road, Basom.

Initially, there was reported entrapment, but now dispatchers have been told the person is out of the vehicle, but is seriously injured.

Mercy Flight is in route with an eight minute ETA.

UPDATE 11:29 a.m. (Photos and information provided by Alicia Kaus): The pickup truck was driven by Charles Scorse, 22, of Hamlin. Scorse was reportedly heading to the reservation to buy cigarettes after working all night in Greece and he fell asleep. His truck hit a Waste Management garbage truck that was stopped to pick up residential trash. The WM worker told Scorse to get out of his vehicle, that it was on fire. Scorse managed to get out, stumble across the road and collapse. The truck then burst into flames. He was taken by Mercy Flight to ECMC. The WM worker was uninjured.

Brett R. Doward, 26, 411 W. Hickory St., East Rochester, is charged with obstructing governmental administration, 2nd, criminal possession of a controlled substance, 7th, and possession of a controlled substance not in it original container. Following a report at 12:06 a.m., Sunday, of a disturbance on Hall Street, Batavia, Batavia PD received the description of a person allegedly involved and the vehicle he allegedly used to leave the scene. Officer Jason Ivison spotted a vehicle matching the description on Ellicott Street. The vehicle fled and pulled into a driveway on Liberty Street. Doward allegedly jumped from the vehicle and ran. After a short foot pursuit, Doward was taken into custody. Doward was released on an appearance ticket. BPD was assisted by the Sheriff's Office and State Police.

A 17-year-old resident of North Main Street, Perry, is charged with petit larceny. The youth is accused of shoplifting from Kmart.

Jeremy Dean Lyons, 27, of Judge Road, Oakfield, is charged with criminal mischief, 3rd, unauthorized use of a motor vehicle, 3rd, aggravated unlicensed operation, 3rd and unlicensed operation. During a domestic dispute with his girlfriend, Lyons alleged damaged property and then allegedly took a vehicle without permission and drove the vehicle on a suspended license.

Jeremy Dean Lyons, 27, of Judge Road, Oakfield, is charged with criminal contempt, 2nd. While housed in the Genesee County Jail, Lyons allegedly violated an order of protection by contacting the protected party.

Terri Marisa Doctor, 33, of Council House Road, Basom, is charged with DWI. Doctor was taken into custody on a Town of Pembroke warrant issued in November 2012 for allegedly failing to pay a fine on a DWI convictions. Doctor was jailed on $1,500 bail.

Spencer Todd Grimes, 18, of Goodrich Street, Albion, is charged with trespass. Grimes is reportedly a former employee of Darien Lake who was accused of stealing and barred from the property. Grimes was allegedly on the property Saturday morning.

Nicholas Lamont Santos, 19, of Gillette Road, Albion, is charged with trespass. Santos is reportedly a former employee of Darien Lake who was accused of stealing and barred from the property. Santos was allegedly on the property Saturday morning.

Randy Lee Ridd, 55, of Swamp Road, Byron, is charged with grand larceny, 4th, and trespass. Ridd is accused of trespassing on the property of a business in Bergen and stealing metal plates. Also charged was Corretta Melissa Pitts, 44, of Swamp Road, Byron.

Brandon Monteleon, 20, of 57 Church St., Le Roy, is charged with criminal obstruction of breathing or blood circulation and harassment. Monteleone was arrested following an alleged disturbance on Church Street between the defendant and another individual.

Daniel S. Platt, 31, of 53 Lake St., Le Roy, is charged with criminal obstruction of breaking or blood circulation and one count of unlawful dealing with a child and harassment, 2nd. Platt is accused of placing his hands around the neck of a victim, causing difficulty breathing. He's also accused of serving alcohol to a person under age 21.

Andrea M. Gray, 34, of 14 Lake St., Apt. #2, Le Roy, is charged with harassment, 2nd, and reckless endangerment, 2nd. Gray reportedly had an argument with an acquaintance on Lake Street. Gray allegedly pushed the victim, causing the victim to fall backward. The victim's head struck a driveway. Gray is also accused of sitting on the victim and pulling the victim's hair. Gray was jailed on $1,000 bail.

Todd Allan Betts, 35, of Transit Road, Elba, is charged with reckless endangerment, 1st, endangering the welfare of a child, menacing, 2nd, criminal obstruction of breathing and harassment, 2nd. Betts was charged following the report of a domestic incident. Betts allegedly grabbed a woman by the throat and threw her to the ground. He allegedly pointed a shotgun in the direction of the woman and a child. Betts was jailed on $2,500 bail.

Tametha A. Wentland, 40, of Harlow Road, Darien, is charged with harassment, 2nd. Wentland is accused of physically contacting a victim. The incident was reported at 11:59 p.m., Saturday. Wentland was arrested by State Police.

Levi Winnie, 26, of 590 Council House Road, Basom, is charged with criminal mischief, 4th. The alleged incident was reported at 4:15 a.m., Saturday. Winnie was arrested by State Police on the Tonawanda Indian Reservation. No further details were released.

An employee of a smoke shop on the Tonawanda Indian Reservation was charged in federal court today for allegedly selling synthetic marijuana and bath salts.

Tiffany E. Greiner, 22, of Akron, was arraigned in federal court in Buffalo on a single count of conspiracy and possession with intent to distribute a controlled substance analog intended for human consumption.

The charge carries a maximum penalty of 20 years in prison or a $1 million fine or both.

According to the U.S. Attorney's Office, Greiner was employed as a sales clert at the Sacajawea Smoke Shop in Basom.

The charge stems from a lengthy investigation by the DEA involving sales of synthetic marijuana and bath salts that resulted in numerous search warrants being served at various shops on the reservation in February.

The criminal complaint alleges that Greiner sold quantities of "Sexy Monkey" and "Alien Incense."

The substances are allegedly analogs to controlled substances and the government is accusing Greiner of knowingly selling the products for human consumption to undercover agents.

The Genesee County Sheriff's Office assisted in the investigation.

A report Tuesday night of a drive-by trucker firing shots out his window in Basom is still under investigation, but a possible suspect has been identified, Sheriff Gary Maha said today.

The subject deputies believe may have been involved may also have been arrested for DWI in Erie County.

Maha said it will take a little time to put the whole case together because law enforcement agencies in Genesee, Erie and Niagara counties are all involved.

A person in the area of Crosby and Judge roads in Alabama reports being shot at with a .22-caliber rifle by someone driving a pickup truck registered to a driver on Ham Road in Basom. Law enforcement is investigating.

UPDATE: 11:45 p.m.: A deputy reports recovering a bullet. No further details available at this time.

Clifford Leo Regimbal, 33, of Oakfield, is charged with criminal possession of marijuana and unlawful growing of marijuana. Regimbal was a passenger in a vehicle that was stopped at 6:57 p.m. Monday on Route 77, Basom, and allegedly found in possession of a bag containing more than 25 grams of marijuana and a 2-foot tall marijuana plant. Also charged with unlawful possession of marijuana was Ashley Nicole Janikowski, 28, of Oakfield. The traffic stop was initiated by Depty Patrick Reeves.

Jamie R. Bachorski, 18, of Webber Avenue, Oakfield, is charged with endangering the welfare of a child. Bachorski is accused of smoking marijuana with a child May 29.

Amber Michelle Hufsizer, 21, of Newark, is charged with petit larceny. Hufsizer is accused of stealing merchandise valued at $90.89 at Darien Lake Theme Park.

Brad C. Doward, 22, of 10 Hall St., Batavia, is charged with criminal trespass, 2nd, criminal mischief, 4th, harassment, 2nd, and endangering the welfare of a child. Doward allegedly unlawfully entered the residence of a friend, damaged property, had physical contact with the resident, all while in close proximity to a child. The incident was reported at 4:30 p.m. Sunday, and Doward appeared at police HQ at 12:30 p.m. Monday.

Mark W. Nassivera, 21, of Rochester, is charged with criminal mischief, 3rd. Nassivera was taken into custody by State Police in connection with an incident reported at 10:03 p.m. Sunday in Alabama. Nassivera was jailed on an unspecified amount of bail. No further details available.

David L. O'Neil, 22, of 101 Elmwood Parkway, Tonawanda, is charged with DWI and driving with a BAC of .08 or greater. O'Neil was stopped by State Police at 12:29 a.m. Saturday in the Town of Pembroke.

Valerie Ann Parker, 32, of Parker Road, Basom, is charged with assault, 3rd. Parker was reportedly involved in a verbal argument with another woman when she allegedly head-butted the woman, breaking her nose.

Shawn MIchael Twardowski, 29, of Vine Street, Batavia, is charged with criminal contempt, 1st, and aggravated harassment, 2nd. Twardowski was taken into custody on a warrant out of Town of Oakfield Court and jailed on $2,500 bail.

Albert Andrew Ackerman, 47, of Silver Road, Bethany, is charged with harassment, 2nd. Ackerman is accused of grabbing, pushing and punching a woman during a domestic dispute. An order of protection was issued requiring Ackerman to stay away from the woman.

Jason Robert Sando, 45, of Walkers Corners Road, Byron, is charged with unlawful imprisonment, 2nd, and harassment, 2nd. Sando is accused of restricting a woman's movements and subjecting her to physical contact during a domestic dispute. He was jailed on $1,000 bail.

Tammy L. Price, 40, of 1526 Kingsley Road, Wyoming, is charged with DWI, driving with a BAC of .08 or higher, unsafe start and uninspected motor vehicle. Price was taken into custody by Le Roy PD after her vehicle was allegedly observed pulling out of a parking lot in an unsafe manner.

Joshua A. Mead, 27, of Downing Avenue, Buffalo, is charged with DWI, driving with a BAC of .08 or greater and following too closely. Mead is accused driving drunk at the time he was involved in a motor-vehicle accident at 12:04 a.m. Sunday on Route 77 in Darien. Mead was taken into custody by Sgt. Greg Walker. Darien Fire Department assisted at the scene. (Initial Report)

Terrance A. Falk, 47, of West Main Street, Le Roy, is charged with harassment, 2nd. Falk is accused of dumping a plastic tote filled with paper over his wife's head during a domestic dispute.

Ashley Allen Wayne, 46, of Rose Circle, Hamlin, is accused of being a fugitive from justice and was cited for no seat belt. Wayne was stopped on Route 237, Byron, for allegedly not wearing a seat belt. During the stop, Deputy Chris Parker discovered Wayne was wanted on a warrant out of Pennsylvania for allegedly endangering another person. Wayne was jailed pending extradition.

Daniel Gordon Vanderwalle, 33, of Stuart Avenue, Newark, was arrested on a bench warrant. Vanderwalle is accused of not appearing on a charge of petit larceny in Town of Batavia Court.

A 24-year-old Corfu resident was charged with drunken driving following an accident on Indian Falls Road, Pembroke, this afternoon that sent both himself and the other driver to the hospital.

Timothy D. Largey, of Phelps Road, Corfu, was reportedly on Cleveland Road when he stopped his 2000 Dodge SUV at the intersection of Cleveland and Indian Falls roads.

Largey then allegedly proceeded into the intersection and his car was struck by a 2002 pickup driven by Jeffrey C. McGiveron, 49, of Phelps Road, Basom.

Both drivers were transported to UMMC by Mercy EMS.

Largey was also cited for alleged failure to yield.

The accident was investigated by Sgt. Greg Walker. Deputy Howard Carlson made the DWI arrest.

Robert Anthony Holley, 41, of Overlook Drive, Batavia, is charged with endangering the welfare of a child and harassment, 2nd. Holley is accused of grabbing his son, throwing him to the ground and kicking him during an argument. Holley is also accused of throwing his wife to the ground when she reportedly tried to stop him. Holley was jailed on $500 bail.

Uriah Ian Charles Smoke, 27, of Bloomingdale Road, Basom, is charged with reckless endangerment, 2nd, and criminal mischief, 4th. Smoke is accused of failing to appear in the Town of Alabama Court following his release from the Erie County Correctional Facility and was arrested on a warrant.

David Christopher Dodd, 23, of County Road 132, Ovid, is charged with two counts of aggravated DWI (child passengers under 16), operating a motor vehicle while impaired by drugs and failure to stop at a stop sign. Dodd was arrested following a report at 9:05 p.m., Wednesday, that a vehicle was operating erratically on Park Road. Dodd was stopped by Deputy James Diehl.

A warrant has been issued for the arrest of an admitted burglar who failed to appear for his sentencing in county court today.

Benjamin W. Muntz, 22, of 6966 Knowlesville Road, Basom, entered guilty pleas Jan. 4 to burglary, 3rd, and grand larceny, 4th.

Attorney Thomas Burns said Muntz hasn't been seen nor heard from since early March and his family doesn't seem to know his whereabouts.

Jason William Wolf, 36, of Hutchins Street, Batavia, is charged with felony DWI, driving with a BAC of .18 or greater, unlicensed operator and aggravated unlicensed operation, 1st. Deputy Kevin McCarthy was reportedly on routine patrol in the Village of Corfu at 3:51 a.m. Sunday when he observed a vehicle pulling randomly into driveways. Wolf was arrested following further investigation.

Jessica M. Miller, 18, of South Pearl Street, Oakfield, is charged with harassment, 2nd. Miller is accused of hitting another person during a dispute.

Evan Ryan Anderson, 30, of 2832 Pearl St. Road, Batavia, is charged with operating while ability impaired by drugs. Officer Darryle Streeter responded to a report at 3:43 a.m. Saturday of a person passed out behind the wheel of a car with its engine running at 419 W. Main St. Anderson was allegedly found at the wheel of the car.

Daniel Jeffrey McGiveron, 26, Phelps Road, Basom, is charged with criminal possession of a controlled substance, 7th. During an unrelated investigation at 9:50 p.m. Saturday in Oakfield, McGiveron was allegedly found in possession of suboxone. Deputy Brian Thompson was assisted by K-9 "Pharoah."

Jessie Lee Jackson, 27, of Byron Holley Road, Byron, is charged with criminal mischief, 4th, and harassment, 2nd. Jackson was reportedly involved in a domestic incident in which he allegedly struck a vehicle with a skateboard and hit a person in the side of the head with his hand. Jackson was jailed on $800 bail.

Alexandra R. Wood, 21, of 8193 McCall Road, Le Roy, is charged with DWI, unsafe start and failing to yield the right of way. Wood was stopped at 2:14 a.m. Friday on Myrtle Street by Sgt. Michael Hare. Wood allegedly refused to submit to a breath test.

Federal authorities raided four smoke shops on the Tonawanda Indian Reservation this morning, seizing alleged untaxed cigarettes, synthetic marijuana and bath salts, according to U.S. Attorney for Western New York William Hochul.

Authorities are investigating whether the so-called synthetic drugs were being sold for human consumption, Hochul said.

Sale of products such as K2, Spice and bath salts for human consumption is illegal as an analogue to controlled substances.

"There's been reporting throughout the country on how dangerous these substances are," Hochul said. "Obviously, we want to reduce that danger where we can."

"It's 100 percent a public safety issue," Hochul added. "Whether it comes to bath salts or even untaxed cigarettes, you don't know what's in these substances."

At least one of the smoke shops is also under investigation for alleged sale of counterfeit merchandise, Hochul said.

No charges have been filed, Hochul said. This is an ongoing investigation.

The shops raided were The Rez, Arrow Hawk, Sacajawea and Smoke Rings.

Unrelated, there was also apparently a raid (or raids) this morning in the City of Batavia by members of the Local Drug Enforcement Task Force. There is no more information available at this time on this activity.
