Downtown Batavia Public Market opens for the season Friday

The Genesee Country Farmers' Market @ The Downtown Batavia Public Market opens for the season on Friday, June 7th, at the market's location on the corner of Bank Street and Alva Place in the Downtown Batavia Business District.

Market hours are 9 a.m. to 4 p.m. on Tuesdays and Thursdays, and 9 a.m. to 5 p.m. on Fridays with the season running from Friday, June 7th, through Friday, Oct. 25th.

FeBREWary Beer Walk

Tonight Downtown Batavia was buzzing with the smiling faces of participants of the first winter craft beer walk.

Based off of the success of summer's Beertavia, orchestrated by Downtown Batavia’s Business Improvement District, a winter version of the popular event was created.

The FeBREWary Brew Walk appeared successful by an informal survey of attendees and some of the 20 business owners that were open and hosting the craft breweries and cideries.

BID board names Barb Dietrich as new director

The Downtown Batavia Business Improvement District (B.I.D.) is thrilled to announce the appointment of Barbara Dietrich as the B.I.D.'s new Executive Director.

Dietrich comes to the B.I.D. from an extensive background of marketing, event management, public relations, promotions and business startup skills. She was the president of Dietrich Consulting in Batavia starting in 1998. She consulted for a variety of businesses on marketing, advertising trends, promotions, sponsorship and events. She was the radio personality on Entercom Buffalo; News Radio 930 WBEN – “Easy Living with Barb Dietrich."

Dietrich was the sponsorship director of “The Great Pumpkin Farm ”Oink”toberfest, NYS BBQ Cook-off Competition in Clarence. During her time at Dietrich Consulting she was the director of Marketing and Development for the YWCA Genesee County, director of Marketing for Empire Tractor Inc., director of Marketing, Public Relations and Sponsorship for Rivera Theatre in North Tonawanda, and general manager for WNY Event Centre in Clarence.

Dietrich has volunteered for many organizations over the years, she was a board member as well as past chairperson for Genesee County Chamber of Commerce, a member of the Batavia Business Advisory Board, Cornell Cooperative Extension Board, Genesee County Business Advisory Board for Tompkins/Bank of Castile and Junior Achievement.

“Most of my marketing/management career has been in the Buffalo area and I’m so happy to use those skills and experiences here in my own community," she said. "It’s an honor to be a part of the exciting growth of Batavia!”

Dietrich moved to Batavia from State College, Pa., with her husband, David Dietrich, more than 25 years ago. They have two children, Joe and Petra.

She said she is happy they chose Batavia as their home.

Dietrich is looking forward to joining the B.I.D. and working closely with the downtown businesses, volunteers, board members, the City of Batavia and its community. Her official start date will be Monday, Jan. 28. We warmly welcome her to the B.I.D.

The Batavia Improvement District hosted Christmas in the City last night, which included sleigh rides, a toy train ride, visits with Santa (and the Grinch) along with local Christmas shopping.

Batavia Business Improvement District seeks new executive director, apply by Nov. 30

The Batavia Business Improvement District (BBID) is seeking qualified applications for the position of Executive Director.

We would like to thank our former Director, Beth Kemp, for her service to the district and wish her the best in her professional endeavors. Kemp represented our BBID with integrity, strong leadership and endless energy. Her presence will be missed.

Leanna DiRisio, former BBID board member, has accepted the interim position at this time, working part-time and resigning her position from the Board of Directors effective immediately. DiRisio will assume all functions of the Executive Director along with Board President, Jennifer Gray.

A hiring committee has met to discuss and establish the guidelines for hiring the next director. In addition, the Board is seeking two new members for the board, both tenant positions. Board members work collaboratively to solve problems, beautiful the downtown, identify strengths and areas for improvement as well as guide the BID organization in decision making to promote business in our district.

Any tenant member of the BBID interested in serving on the Board should contact the office for more information at 344-0900.

The BBID is seeking an Executive Director for full-time, salaried employment. Qualified candidates should have three years’ experience in executive leadership and/or management, including directing volunteers and being responsible for managing budgets of more than $100,000.

The ideal candidate is outgoing, amicable, reliable with excellent communication skills. Candidate must be a team player who enjoys making connections and new partnerships. A background in grant writing and community development is a plus.

A bachelor’s degree is preferred in either business, government, administration, marketing or similar/related fields. Paid vacation and bonus earnings are offered, with flexible hours with some mandatory nights and weekends.

BID announces winners of its inaugural Scarecrow Contest

The Batavia Business Improvement District hosted its first Scarecrow Contest for Downtown Batavia.

As a creative way to add some more fall flavor to downtown decorating, the BID invited any business, group or organization to enter the contest.

For $20 each business was provided basic supplies of straw, a post and zip ties along with their pole assignment. Each business could then get creative in creating their scarecrow.

All voting for favorite scarecrow ended Friday, Oct. 19th. 

  • First-place Winner for 2018 is Batavia Pediatrics;
  • Second-place Winner is Genesee Valley PennySaver;
  • Third-place Winner is Adam Miller Toy and Bicycle

First-place winner receives $100 cash prize, second place $75 and third place $50. The BID would like to thank Home Depot for sponsoring the scarecrows and donating of posts, and to our City of Batavia Fire Department for assembling the posts.

Beth Kemp steps down as director of the BID

Beth Kemp, executive director of the Batavia Improvement District, has decided the business she co-owns with her husband Brian, T-Shirts Etc. needs more of her time and attention so she's resigned her position.

"It was an extremely hard decision for me because I love working as director of BID but T-Shirts Etc. continues to grow and I felt it was shortsighted of me to allow my own small business to struggle and continue my role here," Kemp said.

"I was only able to maintain a few hours at T-Shirts Etc. while working for BID, which was definitely not enough to support what we need to do over there."

Kemp has given notice to the board but she didn't share her final work day.

The Batavian reached out to Jennifer Gray, president of the BID Board of Directors, for comment and information about finding a replacement for Kemp but we have not yet received a response.

Kemp became director in November 2016.

"This opportunity has been amazing and I am so thankful to have been able to work with so many amazing people in our community," Kemp said. "In the past two years we have put in a lot of work in.

"We are in a great place with our finances, events, sponsorships, business relationships, community relationships, and mission. I look forward to still volunteering for events and community projects as the BID needs."

Local law enforcement officers complete Crisis Intervention Training

Early this year, Genesee County was selected to be the recipient of technical assistance and funding to develop a Crisis Intervention Team (CIT) program with resources made available through the NYS Senate and allocated to the NYS Office of Mental Health.

The Office of Mental Health (OMH), Division of Forensic Services, is managing the crisis intervention services initiative.

Crisis Intervention Team (CIT) training is a program that has been developed to help police officers in situations involving individuals with mental illness. The concept of CIT began in Memphis, Tenn., in 1988, and has become nationally known as the “Memphis Model” of pre-arrest jail diversion for those in a mental health crisis. 

A Crisis Intervention Team is a group of experienced police officers who volunteer to receive an additional, one-week training in mental health-related issues.

Last week, local law enforcement officers from the Genesee and Wyoming County sheriff's offices, the City of Batavia Police Department, Village of Le Roy Police Department, Village of Attica Police Department, and Genesee and Wyoming county probation offices participated in training.

The training will prepare officers so that when they are the first responders to an incident, they have the knowledge, skills and support to de-escalate situations and divert individuals from the criminal and juvenile justice systems, when it’s appropriate to do so.

Among the goals of CIT programs are to reduce the number of arrests of individuals with mental illness, refer them to treatment facilities or other support services, and eliminate adverse incidents between law enforcement and those with mental illness. CIT programs involve ongoing collaboration and partnerships between, and among, law enforcement, the mental health system, and consumer and advocacy groups.

Rezoning of Liberty Street parcels, bike rack installations on City Council's plate

The Batavia City Council on Monday night voted to move several resolutions forward, including measures to rezone the St. Anthony’s Church area on Liberty Street from residential to commercial and to install bicycle racks and trash receptacles in several locations within the Downtown Business Improvement District.

A memo from Interim City Manager Matt Worth suggests that seven parcels on Liberty Street and Central Avenue surrounding the St. Anthony’s Church campus – which was purchased by City Church in 2016 – should be reclassified from R-3 to C-3 to allow for some “ancillary activities (dance school, art school, community education classes, etc.) that could be considered a business activity and a non-conforming use in an R-3 district.”

City Church, on July 19, filed a petition to rezone this campus of parcels that would annex the property into the adjacent C-3 district, thus bring the property into conformance with zoning regulations, Worth wrote.

Council’s action moves the resolution into the hands of the Genesee County Planning Board for a recommendation and then to the City Planning and Development Committee for review and to schedule a public hearing in accordance with zoning laws.

In late July, the BID sent a request to the City to install 10 bicycle racks and six trash cans at downtown locations.

A memo from Ray Tourt, superintendent of maintenance, listed the sites as follows:

Bicycle racks – Tim Hortons, Save-A-Lot, Court Street (near the former Coffee Culture); outside JCPenney/Batavia Showtime; near the Christmas Tree between the Bank of America and Tompkins Insurance; in front of Game On on Main Street; in front of Southside Deli on Ellicott Street; in front of Pok-A-Dot on Ellicott Street; in front of Bourbon & Burger Co. on Jackson Street; and in front of Glass Roots on Center Street.

The BID has four more bicycle racks that can be used as replacements when needed.

Trash receptacles – Two on East Main Street and four on Ellicott Street from Court Street to Goade Park.

Tourt said the bicycle racks are of a hoop design marked with a feet motif to go with the BID’s “Feet on the Street” promotion. The trash cans are similar to ones installed by the city in 2004.

Council also agreed to consider a pair of resolutions dealing with the Ellicott Station project coordinated by Savarino Companies of Buffalo.

One is the granting of a stormwater easement due to the fact that a major city storm sewer lies within the boundary of the project.

Worth wrote that this is a requirement of the site approval issued by the City Planning and Development Committee, and would serve as an “important legal document giving the City access for maintenance of this storm sewer in the future.”

The other focuses on the distribution of a National Grid Urban Center/Commercial District Revitalization Grant in the amount of $250,000 that has been awarded to the City to enhance the Ellicott Trail Project, which will run along the southern boundary of the Ellicott Station site.

Based on preliminary construction estimates, Savarino Companies has identified $183,477 worth of improvements (landscaping, lighting, seating, etc.) that would be reimbursed by the grant. An agreement with the City would allow Savarino to access up to the full amount of the funds provided by National Grid.

Council is expected to vote on the BID and Savarino resolutions at its Business Meeting on Sept. 10.

Beertavia more popular than ever in its fourth year

It wasn't all fun and games at Beertavia on Saturday afternoon. There was also the serious business of sampling beers from more than two dozen brewers from Batavia, Buffalo, Rochester, the Southern Tier, the Finger Lakes and beyond.

Four years ago, there were only three brewers participating and 300 people in attendance. This year, at least 700 people attended.

"It’s only going to get bigger and bigger every year," said Cory Wolcott, who has been one of the organizers of the event since its inception. "People love it. We run it well. People are happy, so it will grow."

Four years ago, there were no breweries in Batavia and how we have Eli Fish Brewing Company, reviving a local brand that died out 100 years ago. Eli Fish was a lead sponsor of this year's Beertavia.

This is the first year that VIP tickets sold out in advance.

Wolcott said one reason people love Beertavia is it's easy to try so many different craft beers.

"They like the ability to get to a brewery and try their beer pretty effortlessly," Wolcott said. "There are a lot of bigger events but this is like a medium event so you can still try just about everybody who is here without waiting too long or feel like you’re elbow-to-elbow with somebody. It’s so relaxed but still big enough to enjoy a lot of different breweries."

It was a bright, beautiful day for the first day of the Batavia's Downtown Public Market at Bank and Alva.

In addition to many returning favorites for the Genesee County Farmer's Market, there were two new vendors at the market today, Market Manager Mike Bakos told WBTA. 

Pickle Annie's offers a variety of pickles as well as flavored cider vinegar, which Bakos said is supposed to be good for joint health.

Also new this year is Bad Ash BBQ (The Batavian's publisher and editor can recommend the pulled pork sandwich with baked beans and coleslaw).

"This is a really good spot for the market because we can attract vendors all season long and expand," Bakos said. "We can make the market bigger as needed and that’s really nice."

The market sells $5 Farmers Market Money gift certificates and if you buy $45 worth you get another $5 free.  

The market also accepts SNAP benefits and thanks to a grant, through July, customers who use their SNAP benefits card at the market will receive a $2 coupon for each $5 purchased from a food vendor.

BID Board sees first female leadership

The Downtown Batavia Business Improvement District (B.I.D.) Board elected new officers for the 2018-2019 term.

New executive board is made up of Board President Jennifer Gray, Board Vice President Leanna DiRisio, Board Treasurer Kristine Duran, and Board Secretary Lisa Casey.

The BID Board welcomed five new board members this year that were announced at the BID’s Annual Meeting in April. The new members to include: Wesley Bedford, Joann Baiocco, Marc Johnson, Rick Mancuso and Tina Rose.

The newly elected officers represent the first female President and Vice President to serve on the BID Board since its origination in 1998.

Downtown business owners encouraged and praised at BID's annual breakfast

Pastor Marty Macdonald was an evangelist for Downtown Batavia at the Business Improvement District's annual meeting and awards breakfast in the Generation Center on Friday morning.

Macdonald, pastor of City Church and the keynote speaker Friday, delivered a sermon on the virtues and values of Batavia, his belief in its potential, and his encouragement for Downtown's business owners to remain steadfast in their commitment to growth and community.

“This is the greatest city on the face of the Earth,” Macdonald said. “I really believe that. We as leaders are commissioned to make incredible decisions, not just once in a lifetime but every single day because we are presented with the call to make the future around us great. And not just for five, 10 or 15 years. We are called to change generations yet to come.”

He said he is overjoyed to see the success he sees coming Batavia's way and encouraged business owners not to gripe about the problems they might see but embrace what is going right.

"I’m thankful when I pull into the parking lot next to our building and I can’t find a place to park," Macdonald said. "I remember there was a time you could have thrown a bowling ball in any direction and not hit anything. Now people are upset because they’ve got to walk a little bit. Come on, we need to walk more anyways."

Instead of listening to the few lingering negative voices in the community who badmouth everything they see, Macdonald said we all should aim higher.

"I know I’m not talking to anybody in this room who talks about things that can’t be done," Macdonald said. "I’m talking to people who are can-do people here. Instead of saying what cannot be done or listening to the two or three voices in the community that seem to have the largest megaphone built into their mouths, let’s decide to live at a higher level than we’ve ever lived before. Let’s commit our attitude to be changed in order to go higher and go further than we have ever gone before."

After comparing and contrasting two birds of the desert -- the vulture that feeds only on dead things and the hummingbird that seeks beautiful flowers and spreads life -- Macdonald said, "Can I encourage you today to start thinking like a hummingbird, to start thinking like that one who is looking for life, looking things that are living, instead of focusing on something that is dead. I just want to throw this out here, and I don’t mean to insult anybody, but urban renewal is over. It’s dead. It’s gone. Yes, we learn from yesterday but we can’t stay stuck in yesterday if we are going to move on to a great future."

Adding, "In my church, everyone would say, ‘Amen’ right now."

Jon Mager, co-owner of the newly established Eli Fish Brewing Company, along with Matt Gray and Matt Boyd, delivered the opening remarks, talking about how the new restaurant, brewery, and restaurant incubator came to be.

"We all grew up in Batavia," Mager said. "We’re all very familiar with the area. We recognize that Downtown has been hurting for quite a few years. Over the years we, unfortunately, saw many restaurants and retail stores leave Downtown or close up completely. We admit we looked other places. We saw places with lower rent, lower operating costs, and lower construction costs over the entire project."

But they picked the former Newberry building for several reasons, including (the fact that) its surrounded by parking; Jackson Square is a hidden gem; there is ample traffic passing past the location; the current Downtown businesses are "awesome," and they are all nostalgic and love old buildings.

City Council President Eugene Jankowski talked about the benefits of the Downtown Revitalization Initiative and the process of the city winning the $10 million prize.

He recalled that while making a presentation in Albany, a slideshow of pictures was on a screen behind him when serendipity struck.

"I was talking about how I was walking to school and I remember the smell of those wet, demolished bricks and seeing this once beautiful downtown just rumble down," Jankowski said. "I remember that smell and I was telling the story, and unbeknownst to me, the picture came up of urban renewal and a pile of wet bricks. Jason (Molino) told me that afterward and I thought maybe the timing is right on this one."

Jankowski expressed his appreciation for Downtown's local business owners.

"I want to thank you from the bottom of my heart for investing your time and your hard-earned money in our Downtown and in our City," Jankowski said. "I know it’s a risk and I know sometimes it’s not always easy, but I as a Batavian really appreciate driving down Main Street and seeing all the traffic."

Summary of NYS Local Governments and School Accountability audit concerning City of Batavia and BID

Purpose of Audit

The purpose of our audit was to determine whether City officials properly accounted for and monitored the Business Improvement District’s (BID) financial operations for the period April 1, 2015 through September 14, 2017.

Background

The City of Batavia is located in Genesee County. The City has approximately 15,500 residents and is governed by an elected nine-member City Council. The Council created the BID in 1997. The BID is a geographic area in which a charge is imposed upon benefited properties for improvements, operation and maintenance costs and other services such as advertising and promoting BID activities. The district management association (DMA) is a not-for-profit entity governed by its own board of directors, which performs many District day-to-day management functions. The 2017-18 BID charge was $55,742.

Key Findings

  • The Council did not enter into a written agreement with the DMA or monitor the manner in which the DMA used BID funds.
  • City officials did not maintain adequate records to properly account for BID funds.
  • BID charges exceeded the statutory limit for 11 of the past 13 years by a total of approximately $464,000 or an average of $42,000 each year.

Key Recommendations

  • Enter into a written agreement with the DMA.
  • Monitor BID financial operations especially the manner in which the DMA uses BID funds.
  • Levy BID charges in compliance with the statutory limit.

State comptroller's audit directs City to tighten its grip over Downtown Business Improvement District

A New York State comptroller’s audit of the City of Batavia’s relationship with the Downtown Batavia Business Improvement District mandates City Council to assume greater control of the agency’s financial matters.

That was the word from both Council President Eugene Jankowski and Interim Manager Matt Worth at tonight’s City Council business meeting at City Centre Council Chambers.

“Basically, the state has supported what we said in the past (that Council needed more oversight of the BID) and lays down some ground rules going forward,” Jankowski said. “This has been going on for a couple years; we should have caught it sooner.”

Worth said the audit addresses several procedural issues, particularly in the areas of budget oversight and retention of the BID’s funds.

“It deals with who should take possession of the funds and requires that a more formal contract between the City and the BID needs to be created,” Worth said.

The City and the BID were at odds for some time into the second half of 2016, stemming from the City’s contention that the agency’s 2016-17 assessment budget exceeded the General Municipal Law limits for district assessment charges used for operations.

Jason Molino, city manager at the time, also urged the BID to follow Open Meetings and Freedom of Information laws, and to post its bylaws and meeting notices and minutes on its website.

The dispute simmered in a public forum, eventually prompting Laurie Oltramari to resign her position as BID director (although she said the budget flap did not enter into her decision).

Since then, the BID Board of Directors has changed as has the director, with Beth Kemp taking over the lead role in November 2016. Additionally, the City -- in a move supported by the audit -- has more than $200,000 in a special account (BID taxes that were levied inappropriately) that will not be used until the agency plans a capital improvement project.

A call to Kemp this evening had yet to be returned when this story was posted.

In other action, Council:

-- Approved a contract with R.A. Haitz Co. Inc., of Batavia, for $49,838 to replace two roofs at Dwyer Stadium, with the intent of having the work done prior to the opening of the Batavia Muckdogs’ season in mid-June.

“I think it’s great that we finally found someone from Batavia that can do some work in Batavia,” Council Member Rose Mary Christian said.

The cost comes in at $1,838 over the projected budgeted amount, but Worth said he thinks the City could save money on some other projects at the baseball park “so it comes out in the wash, so to speak.”

The Haitz bid was not the lowest of the three received, however. A $28,800 bid from Dan & D.J.’s Reasonable Contracting, of Elba, was not considered because that firm miscalculated insurance costs related to the project, Worth said.

-- OK'd a liquor license request by the Muckdogs to offer beer and cider during the New York-Penn League games.

-- Voted to contract with Labella Associates in the amount of $12,000 for administrative services in connection with a Communities Development Block Grant to replace 900 linear feet of water mains on a portion of Brooklyn Avenue.

-- Passed a resolution designating four eligible census tracts – in Ward 2, 3, 5 and 6 – as federal qualified opportunity zones.

This gives developers federal tax incentives to reinvest capital gains in areas designated as “disadvantaged” by virtue of having 20 percent or higher poverty and a median family income 80 percent less than the area’s median income.

The resolution states that “coupling opportunity funds with the locally enacted Pathway to Prosperity tax increment financing program may assure cleanup of brownfield sites, gain new investor commitments to Batavia, and will ensure that our region can be an attractive economic driver creating jobs, building tax base and increasing population …”

-- Was informed that two part-time janitors have been hired to work at the City Centre Mall but a full-time maintenance worker has not been hired yet.

Council Member John Canale reported that a mall merchant commented that she noticed people working in the mall and “appreciated” the City’s effort to improve what has long been a tenuous association between the merchants and the City.
