S'mores and more: Batavia Kiwanis assemble 100 Family Game Night Kits to give away in BCSD

The coronavirus pandemic has brought about the challenge of trying to keep ourselves busy with new and varied activities.  

The Kiwanis Club of Batavia came up with a way to help families fill the day with some good old-fashioned cheer, as they worked to fulfill their mission of serving the children of the world in our community

Club members assembled 100 Family Game Night Kits that will be distributed to local families.

Each kits has two family-friendly card games, fixin's for s’mores, ingredients for a batch (or two) of authentic homemade popcorn, and a container of “snickerdoodle salt” -- a specialty item made by Kiwanians!

“We know families have been quarantined and that they are out of books, games and movies -- a Family Game Night Kit seemed to be a great choice for everyone,” said Kiwanis Club President Bob Conrad

The kits have been given to Batavia City School District to distribute through all of their schools. All district family names have been entered into a drawing and the winners will be selected at random.

“It’s great that it reaches across the socio-economic spectrum,” said district social worker Julie Wasilewski. “I am more accustomed to working with the underserved, this is broader, and I like that. We really appreciate it!”

School representatives will be working to get all of the games distributed over the next couple of weeks, winners of the kits will be contacted by school officials for delivery.

“The generosity of the community during this time has been great, and we love the idea of bringing joy to families through the simple things in life,” said John Kennedy School Principal Amanda Cook.

Genesee County Public Health reports two new COVID-19 cases

The Genesee and Orleans County Health Departments have received six more COVID-19 cases. Orleans has four new positive cases (bringing the total to 225) and Genesee has two (bringing the total to 188).

Contact tracing has been initiated and all who have had direct contact with the individuals will be notified by Health Department staff. Three of the Orleans County individuals are residents of Orchard Rehabilitation and Nursing Center and one is a community resident. The two individuals from Genesee County are both community members.

There is currently no further information to release on ages and locations. Mapping to include the positive cases from the weekend will be updated on Monday afternoon.

Now that we are in Phase 2, we ask residents to continue social distancing, mask wearing, and proper hygiene even in the company of whom we trust the most -- family, friends, and coworkers. We also ask residents to be respectful of the business owners and wear masks while you are in their establishment.

If you are unable to wear a mask due to a medical condition, call the business and ask for curbside delivery. We can all show people that we care and respect them by continuing these practices to keep everyone safe.

Free milk giveaway Monday afternoon at Craigs Creamery

On Monday, June 1, there will be a free milk giveaway at Craigs Creamery in Pavilion, located on the border of Genesee and Livingston counties at 1840 Craig Road.

The event is scheduled from 4 to 6 p.m. and gallons of milk will be distributed on a first-come, first-serve basis until gone.

The distribution in conjunction with Natural Upcycling, Dairy Farmers of America and the Livingston County Farm Bureau, is in honor of World Milk Day.

Up to 2,000 gallons of Craigs Creamery milk is expected to be given away.

This effort was made possible through the ReFED COVID-19 Food Waste Solutions Fund, a grant designed to reduce food waste across the United States.

Hawley votes in favor of amendment that limits governor's executive powers

Assemblyman Steve Hawley voted "yes" on an amendment, introduced by the Minority Conference that would have taken large steps to ensure that the governor’s executive powers wouldn’t continue.

Since the start of the statewide response to the COVID-19 pandemic, Gov. Cuomo has issued 36 executive orders that impose a range of rules and regulations, from business closings to election process overhauls.

Hawley believes steps to curb that power will return the state to the more familiar democratic republic that New Yorkers expect.

However, despite the clear need for curtailing of executive privilege and overreaching of authority, the Downstate politicians voted down this amendment, keeping the governor’s power absolute. Despite this setback, Hawley is just as determined to fight and hold the Majority and the governor accountable.

“In the early stages of a pandemic, getting all of your ducks in a row is incredibly important, and the use of executive privilege in handling a crisis early on was important,” Hawley said. “However, with the decline in positive cases and the return of the legislature, it’s high time that clearer boundaries be made for what is and is not acceptable for the governor to do.

"This amendment would have restored the checks and balances system that is so crucial to our democracy. It’s a shame that my colleagues in the majority couldn’t recognize this, because it leaves the door open for power abuse and manipulation in the future. That’s no future I want to see in this state, so I will be fighting diligently to return the checks and balances.”

Specific provisions of the proposed legislation included:

  • County-by-County Declaration – All state of emergency declarations would be done on a county-by-county basis rather than statewide, with a detailed explanation for each county based on the specific facts and circumstances of such county justifying the emergency declaration.
  • Limited Duration – All emergency declarations would automatically end within 30 days, and could be extended by the governor for an additional 15 days. No other extension could occur without being authorized by the state Legislature.
  • Local Authority – The county executive, chairperson of a county legislature would be able to request that the governor terminate any state of emergency that applies to their respective county. If the governor does not grant the request, he must provide the specific reasons why the request was denied.
  • Due Process – Any Executive Order that impairs freedom of assembly, freedom of speech, freedom of worship, the equal protection of the law, the loss of liberty or property, or other fundamental constitutional rights would be subject to due process review, in a manner specified in the Executive Order and subject to independent judicial review.

Those simple devices - wearing a mask, hand sanitizer -- they make all the difference. You talk to all the experts -- what advice, what should we do? Wear a mask. How can it be that simple? Because sometimes it's that simple." 

Governor Andrew M. Cuomo today announced that New York City will enter Phase 1 of reopening on June 8 and that five other regions—Central New York, Finger Lakes, Mohawk Valley, North Country and Southern Tier — can enter Phase 2 of reopening today. Phase 2 allows office-based workers, real estate services, in-store retail shopping and some barbershop services to resume.

Each industry is subject to specific state guidelines to maximize safety and social distancing. Business guidance for phase two of the state's reopening plan is available here.

Governor Cuomo also announced the implementation of a new early warning dashboard that aggregates the state's expansive data collection efforts for New Yorkers, government officials and experts to monitor and review how the virus is being contained on an ongoing basis.

It tracks new infections and their severity, hospital capacity by region, and other metrics. The early warning system dashboard was developed in consultation with internationally known experts who have been advising New York State. The early warning dashboard can be found here.

Assemblyman Hawley believes Phase Two will start on Saturday, calls for an end to one-man rule

With Phase Two of New York’s reopening plan temporarily on hold due to Gov. Andrew Cuomo’s call for a review of the health data by “international experts,” Genesee County business owners hoping to open their doors to the public can only sit and wait for another update out of Albany.

That update may be coming very soon, said state Assemblyman Stephen Hawley, speaking by telephone after a nearly 15-hour legislative session that ended around 2:30 this morning.

“My belief is that he (Cuomo) is going to make an announcement this morning that on Saturday we’re going to enter Phase Two,” Hawley said, after expressing his dismay over how things have been handled since the COVID-19 pandemic struck in mid-March.

“I’m not sure how he has been able to do it pretty much all on his own up to this point with looking at statistics and data as he likes to call his decision-making process,” Hawley said. “I’m not sure why all of a sudden, he wants to bring in whoever his experts are. He has quite a few around him and pretty much has single-handedly run the state for the past two months.”

On Thursday, published reports indicated that Cuomo said he has “international experts who (will) go through it and we’ll follow the data.”

“The reopening in the first five regions ends tomorrow. When the reopening of Phase One ends, we’ll give the experts all the data. It is posted on the web, but let them analyze it. And if they say we should move forward, we’ll move forward,” the governor stated.

The Finger Lakes Region, which includes Genesee, Orleans, Wyoming counties, entered Phase One on May 15.

Regional leaders were expecting to enter Phase Two today, with that action clearing the way for more retail stores, barber shops, salons, real estate offices and professional services to reopen.

Hawley said the time has come, with adherence to proper safety guidelines, to return to some sense of normalcy.

“Enough stalling,” he said. “We have done what we need to do for the last two and a half months, and we’ve been doing it well. Western New York is not New York City.”

The assemblyman also said Republicans attempted to pass a resolution to a bill last night during session “that would have taken away his (Cuomo's) powers and suspended his one-man rule, but it failed on a party-line vote pretty much.”

“We need to get back on track and have three co-equal branches of our government operating as it was intended to do in our country and our state,” he offered.

Hawley also criticized the state Department of Labor for delays in processing unemployment insurance checks for those who have been laid off through this health crisis.

“We have folks who have been waiting for unemployment for eight, nine, 10 weeks,” he said. “The Labor Department was operating under a system known as MS-DOS, which is an outdated, archaic technology that was used back in the 1980s. It was never updated in all these years.”

Genesee County Legislature Chair Rochelle Stein also weighed in this morning, acknowledging that patience has “worn thin.”

A part of the regional control room, Stein said that prior to official word from Cuomo, business owners could put their licenses at risk by opening on their own.

“We would just ask for additional patience and we understand that (patience) has already all worn thin. But to get out ahead of the governor is not a good position to be in,” she said.

She added that new guidance has been posted on the New York Forward website.

Genesee County Fair cancellation a tough break for 4-Hers

Stein said she was disappointed over the cancellation of the Genesee County Fair and felt bad for the young people involved in 4-H.

“The 4-H youth who participate in educational programs all year long, and have an animal ready to go to the Fair that they have spent an incredible amount of time, either training or growing --this type of learning experience that 4-H provides for our youth, along with the animal agriculture education, for me, that’s the hardest hit,” she said.

Co-owner of Stein Farms in Le Roy, she said she understands the work that goes into getting ready for the fair.

“It’s not just a couple weeks before the fair,” she said. “It starts when the animal is born, and there is a significant amount of blood, sweat and tears that goes into these animals and these projects. That’s where my heart really has been saddened by this.”

She said she supports the Agricultural Society’s decision to cancel.

“I know it’s been a terribly difficult decision for the Ag Society to come to, but as I see that other fairs have done the same to protect the health and safety of others, I know that just this one time, just for now, this is what needs to happen,” she said.

Due to the COVID-19 pandemic, this induction ceremony event was canceled.

These students met the rigorous criteria set forth by this national organization. The minimum grade-point average for acceptance is a 3.0. Students are also selected based upon credit hours completed, attendance, volunteer service, and membership in other student organizations.

Elba HS Class of 2020: Community adapts and adopts to give seniors unique send-off

Many schools are hoping to abide by tradition, while others are accepting that sometimes you need to adjust your course and start sailing in a new direction.

For the administrators at Elba Central School District (ECS), the need to adapt to the situation imposed by the COVID-19 pandemic is being embraced wholeheartedly. They are planning to switch gears as necessary.

“The traditions for graduation are the same, they have stood the test of time,” said Gretchen Rosales, principal of the middles school and high school. “How do we create new traditions that are meaningful?”

Community members, concerned that this is not a traditional year for the graduates, have offered their help.

Each graduating senior has been adopted by someone in the community and they have been showered with gifts and attention.

Another generous class supporter, Lori McClurg, gifted each teenager a “swag bag,” full of cookies, cake pops, hand sanitizer, bubbles and other fun items — plus a chance for one lucky grad to win all of the sweet treats they desire for their graduation party — the lucky winner will be announced soon.

“For us this is like family, we all know each other, there is a small population and it’s rural,” Rosales said. “Everyone wants to see these teens have a great send-off.

“I am a mom of a senior myself. It is hard to watch our students miss out on the most important events in their lives so far. I have been doing my best to frame this positively…it’s a huge part of history, it’s unique.”

With the support of senior class advisor Laura Williams, district reps have worked hard to do some great things for their close-knit group of 20 graduating seniors, including a variety of individualized activities to make each graduate feel special.

They celebrated their Top 10 students by inviting them to the school driveway to share a breakfast treat with school faculty, and presented them with a Party-in-a-Bag and their “Home of a 2020 Lancer” yard sign. It advertises their big accomplishment, setting the tone for a celebration at home.

Because the district is in the process of replacing some of the school lockers this year, the seniors were allowed to decorate their locker doors for 2019-2020. They were told they could keep the door to “take a piece of their school with them,” Rosales said.

Rosales herself has gone above and beyond by spotlighting each senior on social media with their photo in front of their own personally decorated front door at home.

She and other staff members have written personalized notes with words of encouragement to the teens, while they have facilitated virtual class meetings to help keep the classmates connected.

Cap and gown picture day was made memorable with individualized sessions for each senior where formal and candid shots were taken to be shared with their families.

Each teen was asked to create a sign that “advertised their plans for next year” and Rosales intends to compile them in a video. These, too, will be by shared on social media.

As for the graduation ceremony, no plans have been confirmed.

If it is necessary to change venue, or even move the ceremony out a couple of weeks to keep everyone safe, then that is what will happen.

“It may be what we need to do … I am cognizant of the sadness that the students and their families feel right now; what is meant to be a celebratory time has become a disappointment for many," the principal said.

"As a school leader, it is important for me to honor students’ achievements while keeping them safe and healthy, and I need to carefully balance that, with the need for closure.”

NYS Farm Bureau issues guidance to help farms manage and mitigate spread of COVID-19

New York State has issued comprehensive guidance to help farms manage and mitigate the spread of COVID-19, and New York Farm Bureau is asking farms across the state to review the information and put it to practice.

The guidance follows a letter NYFB President David Fisher wrote to Governor Cuomo in April asking for this assistance.

Farms have implemented a number of health and safety practices to protect their families and employees, but still had lacked comprehensive protocols from state officials that are specific to the unique aspects of agriculture.

The new guidance includes information for farmworkers, detailed cleaning protocols and a checklist for farms to follow.

“Planting season is underway and guest workers are arriving on farms," said David Fisher, New York Farm Bureau president. "If we are to farm and produce food in a safe and responsible manner, farmers need to understand how best to do that amid a pandemic.

"I would like to thank Governor Cuomo as well as the Commissioners of Agriculture and Markets, Health and Labor for the newly released guidance. Farm safety is extremely important, and we must do all that we can to inform our farms, protect our valuable employees, and prevent a potential spread of the virus. No place of business is immune from the virus, and I ask my fellow farmers to continue to be proactive in their efforts."

NYFB has emailed the guidance to its members as well as published the information on the COVID-19 page of its website.

Since the pandemic began, the organization has worked with its partners across agriculture to provide members with the resources they need in these times. In addition, NYFB and Cornell Cooperative Extension have been conducting outreach to county health departments across the state to assess preparedness and quarantine housing options should an outbreak occur on a farm.

NYFB has also established a farmworker relief database to connect farms with potential temporary employees should they be needed.

Three GC nonprofits get money from WNY COVID-19 Community Response Fund

The Western New York COVID-19 Community Response Fund, announced that it has awarded nearly $1 million to an additional 47 nonprofit organizations, bringing the total grant amount from the Fund to $6.6 million, supporting a total of 156 nonprofit organizations.

This collaborative philanthropic effort was created in mid-March in response to the COVID-19 health crisis and has been coordinated by the Community Foundation for Greater Buffalo, Health Foundation for Western & Central New York, The John R. Oishei Foundation and the United Way of Buffalo & Erie County.

Grants were awarded to organizations serving all eight counties of Western New York that are addressing immediate needs in our community as a result of the COVID-19 crisis in the areas of food, housing, healthcare, childcare, mental health, transportation, and other emergency services.

This is expected to be the final phase of grantmaking to individual organizations from the WNY COVID-19 Community Response Fund. Additional funds raised will provide microgrants ranging from approximately $500 - $2,500 to grassroots organizations in all eight counties. Going forward, the collaborative effort is evolving into a “Build Back Better” initiative to support developing strategies focused on recovery efforts through collaborative systems work to address specific needs such as sourcing personal protective equipment for nonprofits and food security.

The following nonprofit organizations in Genesee County received a grant (amounts not specified) from the WNY COVID-19 Community Response Fund in May:

“The sudden arrival of the COVID-19 crisis necessitated an immediate response to meet the significant need in the community with everyone working together on solutions," said Clotilde Perez-Bode Dedecker, president/CEO of Community Foundation for Greater Buffalo. "We are grateful that so many foundations, corporations, community leaders and individuals continue to generously contribute time and resources to support more than 156 organizations to date working on the frontlines at a time of great need."

Robert D. Gioia, president of The John R. Oishei Foundation added, “We are just at the beginning of this crisis and it will take a sustained, collaborative effort to continue to assess critical needs and find new, creative solutions to rebuild our community.”

"It’s clear that COVID-19 will have a long-term, serious impact on the people and communities of Western New York," said Nora OBrien-Suric, Ph.D., president of the Health Foundation for Western and Central New York. "We remain committed to supporting nonprofit organizations in our region as they work tirelessly to meet the evolving needs of the community."

"We are facing unprecedented need and are only just beginning to grapple with the effects caused by COVID-19," said Michael Weiner, president and CEO United Way of Buffalo & Erie County. "Extraordinary times call for an extraordinary response and we will continue to support our community and the nonprofits on the ground throughout this unprecedented crisis."

To date, the WNY COVID-19 Community Response Fund has raised approximately $7 million from 60 local foundations and private sector companies, more than 40 community leaders and approximately 1,900 individuals. SUNY and NYS Office of Mental Health launch crisis text line and training to help students during COVID-19 crisis

The State University of New York and the NYS Office of Mental Health today (May 27) announced the launch of a crisis text line and training initiative, two resources designed to help promote mental health awareness, ease stress and anxiety, and identify and support individuals at risk of suicide.

SUNY advanced its promotion of the resources in order to assist students, faculty, and staff as they confront the COVID-19 pandemic, including SUNY Genesee Community College.

“Slowing the spread of COVID-19 has called for a series of sudden shifts to how we live, work, study, and interact,” said SUNY Chancellor Kristina M. Johnson. “Though this transition is necessary to keep people safe, there may be an unintended, psychological impact of these changes on many of our students, faculty, and staff. We thank the New York State Office of Mental Health for their partnership in providing these resources to our SUNY family.”

Information about these resources is available at SUNY’s new mental health resource page found here. The first is a Crisis Text Line for students, faculty, and staff who are dealing with emotional challenges. Members of the SUNY community can access the confidential text line 24/7 by texting Got5U to 741-741 for help.

The text line can be used to help alleviate depression, anxiety, stress, and suicidal thoughts. It also provides a way for people to talk about substance use, relationship issues, domestic violence, and school stressors, as well stress and anxiety related to the COVID-19 pandemic.

The second resource is online Question, Persuade, Refer (QPR) training, designed to teach participants how to recognize someone who may be in emotional distress or having suicidal thoughts, and how to appropriately engage and connect that person to resources that can help. Anyone can practice QPR in any setting, and it is appropriate in all relationships.

QPR does not require clinical training, only a willingness to listen, care, and help. Members of the SUNY community may register here and entering “SUNY” as the organizational code.

QPR and the Crisis Text Line are just two ways that SUNY is working to address the mental health impacts of the pandemic among its 64 campuses. All campus counseling centers remain open, and online education experts have been available virtually to alleviate concerns about the transition to online learning.

All 64 SUNY campuses will be receiving marketing materials to promote the availability of QPR and Crisis Text Line services.

Both services are components of a partnership between SUNY and OMH, thanks to $3.68 million from the Garrett Lee Smith Grant that OMH received last year. OMH designated SUNY as one of the partnering institutions of a multi-year sub-award. The grant comes from the Substance Abuse and Mental Health Services Administration, and is awarded to states and tribal nations for comprehensive youth suicide prevention efforts.

Garrett Lee Smith was the son of former U.S. Senator Gordon Smith of Oregon. The younger Smith died by suicide in 2003, shortly before he turned 22. A year later, President George W. Bush signed the Garrett Lee Smith Memorial Act and allocated $82 million to seed grants for suicide prevention.

Suicide is the second leading cause of death among 15- to 34-year olds. For some people, the college years may be especially difficult. The onset of psychiatric conditions may coincide with new experiences at college that are often stressful, even distressing.

Even before the coronavirus pandemic, some studies found increases in depression, anxiety, and suicidality among college students.

In addition to QPR training and the Crisis Text Line, SUNY plans to use the grant to do outreach to college students who may be at risk of suicide; build a repository of mental health resources across the system; and implement and develop a best practices guide for responding to the occurrence of a suicide death.

Council considers measure that increases unassigned fund balance to 25 percent of operating expenditures

Batavia City Council tonight took a step toward changing the municipality’s fund balance policy to give it more muscle and flexibility in dealing with financially stressful circumstances.

Council members agreed to forward a resolution to their June 8 Business Meeting that increases the unassigned fund balance level from 10 percent to a range of 15 to 25 percent of the City’s general fund operating expenditures.

Tonight’s meeting was conducted via Zoom videoconferencing; the June 8 meeting is scheduled to return to the City Hall Council boardroom.

Deputy Director of Finance Lisa Neary, in a memo dated May 18 to City Manager Martin Moore, wrote that she is recommending the revision “in consideration of the current economic situation the City is facing and, in an effort, to create a healthier financial outlook.”

The proposal triggered a 24-minute discussion that touched upon fund balances and reserves as well as restrictions that come with the different types of accounts.

MOORE: TIME HAS COME TO MAKE A CHANGE

“Last August, when we had our financial report we were at approximately 11.3 percent,” Moore said. “Well, we think that it’s time, particularly because of the challenges we’re facing and the impact on the unassigned fund balance, that we need to have an additional amount of unassigned in there to be able to face significant situations.”

Moore said the change is being requested to give the City a lower target to shoot for at 15 percent in unassigned funds but also to have a goal of up to 25 percent in case revenues dried up for several months or if the City faced a “significant challenge” such as a large health insurance claim.

In effect, the move could buy the City some time, with Moore stating that the 10-percent level equates to about five weeks’ worth of unassigned fund balance and that 25 percent moves the bar to three full months.

Neary said the fund balance policy “needs to be a policy that meets our best interests.”

“It seems as though coming into this COVID issue, that 10 percent really doesn’t suit our purposes," she said. "That’s not to say that we’re going to get to 15 or 25 (percent) overnight. We’re going to need a number of good years in order to hit those kind of percentages. But we need at least a policy to do that."

JANKOWSKI: GIVES US A CUSHION

Council President Eugene Jankowski said he thought it was a reasonable request, adding that bumping up the percentage would give the City a cushion if the “market drops or something wild happens like this experience.”

Jankowski mentioned that Council previously budgeted to put money into reserves, but, in light of what has transpired with the coronavirus, it would act differently now.

“Maybe we didn’t want to put that money into reserves because we needed it for everyday operating expenses,” he said. “There really is no mechanism for us to pull money out of reserve and say, ‘never mind we’re going to not use it for reserve, we’re going to put it over here.’ The reserves are reserves because they’re protected; they’re locked (for specific purposes) for a reason.”

Moore said that a conversation is taking place with local and state leaders about reserve fund options and that he plans to reach out to Assemblyman Steve Hawley and Sen. Michael Ranzenhofer “to allow us to deal with operating expenses and give us a reasonable time to be able to repay the reserve.”

VAN NEST: RESTRICTIONS ABOUND

City Attorney George Van Nest said the problem with reserve funds under Article 6 of the General Municipal Law is that each type of reserve fund is very restrictive as to what it can be used for, and if there’s any leftover balance as to how that can be used.

“When you get into a financial situation like this, you just don’t have the statutory flexibility that you’d hope for or want to be able to access some of those funds …,” he said.

Van Nest then mentioned a bill in the State Assembly (A10492) relating to bond anticipation notes issued from 2015 to 2021 that authorizes the expenditure and temporary transfer of reserve funds for expenses related to COVID-19, and gives an extension of repayment of interfund advances made for expenses related to COVID-19.

“This legislation is something that NYCOM (New York Conference of Mayors) has obviously been supporting on behalf of municipal members and something that they are tracking very closely,” he said.

Council Member John Canale asked Van Nest if the board would be able to “borrow our own money … and then pay that fund back?”

Van Nest said that a capital reserve fund could only be used for capital expenditures and that a transfer from any type of reserve could be used for COVID-related issues as long as it is repaid, with interest, within a five-year period.

Jankowski said he puts a lot of stock in reserve funding for specific projects, but it’s not a priority at the moment.

“If we would have known in January when we were doing our budget that we were going to take a hit, I don’t think any of us would have put any money into reserves,” he said. “We would have said let’s hold off in reserves this year and keep the money in our fund balance or in our fund, not in reserves, in the event we go short somewhere, then we have the money.”

NEARY: RESCINDING MAY BE AN OPTION

Neary said that she believes that Council has the power to rescind a prior authorization to fund reserves in the 2020-21 budget, leading Van Nest to say that he would look into such a measure.

Canale wrapped things up by saying he wanted to know “for a fact what our options would be.”

“It’s about being prepared for the worst,” he said. “And I think at this point we really need to. I’m doing it on a personal level as well. I’m preparing for the worst and making sure that I have funds available if I need to during a second wave of this thing.”

In other action, Council approved a resolution amending the City’s investment policy to add BankonBuffalo (formerly Bank of Akron) as a designated depository. The resolution was immediately forwarded from the Conference Meeting to a Special Business Meeting set up tonight exclusively for this item.

In explaining the reasoning for the move, Moore said that the City has a chance to get a “more favorable” interest rate of around .75 percent from BankonBuffalo by investing liquid funds that aren’t immediately needed but could be accessed if necessary.

City Clerk Heidi Parker said the resolution was expedited to get BankonBuffalo “in there so we can move quickly in investing this money.”

Future policy changes would allow investments to be made without having to wait “for a Council meeting to come up in case it is a bank that is not listed as one of our designated depositories,” she said.

Jankowski said he had no problem with the resolution, but asked for additional modifications in the wording of the policy that included “some kind of checks and balances” to make sure that more than one person is involved in the process.

He suggested that Parker, Moore, Neary and Assistant Manager Rachael Tabelski all have a say in these types of investments and the financial institutions to be utilized.

Also, as previously reported on The Batavian, Council moved to the June 8 meeting a resolution that spells out a $554,112 grant the City received from the NYS Department of Health’s Lead Service Line Replacement Plan.

The grant will enable City crews to replace up to 75 lead service lines on Swan, Hutchins and Otis streets on the City’s Southside.

DPW Director Matt Worth said the grant requires no match from the City and the only cost a homeowner would incur is if crews were unable to make a connection from the curb shut-off into the house likely due to a deteriorating pipeline.

Another resolution forwarded to the June 8 meeting was a motion to obtain a firm to provide administration/engineering services for a $750,000 Downtown Revitalization Initiative project to improve Jackson Square.

Worth said the deadline for firms to respond to the City’s request for quotation is Wednesday.

He also reported that the City Centre mall roof replacement project is about 35 to 40 percent complete and he expects it to be done within 30 days.

“Hopefully, the buckets will be gone by the end of June,” Jankowski quipped.

Q&A with Jay, Vol. 2: Medicaid stimulus funds 'missing in action'; six furloughed employees are back on the job

Earlier this month, The Batavian asked Genesee County Manager Jay Gsell a series of questions pertaining to the COVID-19 pandemic, the New York State budget and state aid, and federal stimulus proposals.

With the Finger Lakes Region (which the county is part of) poised to enter Phase Two of Gov. Andrew Cuomo’s reopening plan, we caught up the Gsell again today to update our readers about issues that will have and are having a direct effect on county operations.

No. 1 – New York’s $13 Billion Budget Gap

The state’s $13 billion gap, which probably is growing, is tied to the Fed Stim (Stimulus) 4.0 proposal, and we’re also waiting for his (Cuomo’s) first 30-day hit with regard to the state budget and state and county aid reimbursement, or lack thereof. There are three “measurement” periods – the month of April, May through June, and July through December, and we haven’t heard anything yet.

Under the Fed Stim 4 -- the compromised legislation that we hope will get enacted in June, if it doesn’t slip away entirely because of what is going on in Washington right now and the very partisan wrangling that’s going on -- there’s going to be a “Maintenance of Effort” clause in there. That says money can not be reduced or diverted from, in this case, the state down to the other governments if we are part of Fed Stim 4 – with regard to the governor replacing state money with federal money and then still making cuts to local governments.

No. 2 – County Waits for Medicaid Funding

To the best of my knowledge – getting information from the New York State Association of Counties -- there’s already about $2.2 billion that the Fed Stim 1 / 2 provided to the State of New York for Medicaid – for our adjustment of weekly shares of Medicaid. We have not seen hide nor hair of that yet.

In Fed Stim 1, this money went to the states and that’s why we haven’t seen it yet. By the same token, the new Fed 4.0, that may or may not happen, there would be actually no pass-throughs in some cases or limited pass-throughs from state governments to the locals. It would actually be based on population and one or two other metrics, particularly COVID-19 expenses and some other destitution loss of revenue. Remember this is nationwide, not just New York State.

We’re talking now almost two months. I know that there’s a process called reconciliation that is slightly connected to this. Three years recouping of the money that was spent in the Medicaid program on a county-by-county basis. In Genesee County, we would be owed some money. Until they refine that reconciliation process, they’ve been sitting on this Medicaid weekly share money. That is something that Congress recognizes and (saying) "so if that’s the case, why is it that they are asking for money?"

About $450,000 would be adjusted out of our weekly shares over the balance of this calendar year for us at this point. There are 52 weekly shares – do the math, that’s what it represents. But it would obviously be savings to us in our general fund budget. It would help us reduce our $9.6 million (annual mandated Medicaid) payment to something closer to maybe just under $9 million as far as calendar year 2020.

No. 3 – Sales Tax Money to Aid Distressed Facilities

In this new state budget, there is a distressed $250 million fund that was set up that is going to be funded from county sales tax shares … so they can put this distressed hospital fund together. There is also federal money for distressed hospitals since COVID-19 started. Then the question will be, "How are states balancing that or not and adhering to these new federal cautions regarding Maintenance of Effort?"

I am seeing in terms of the more recent back-and-forth with Fed Stim 4 that as long as it is not something like the $3 trillion Christmas package that the House voted on – that barely passed two Fridays ago – (there’s a chance it could pass). There’s still some other loan programs and other benefits that they would like to be able to re-up and continue, and the Fed Stim 4 would be an opportunity to do that.

The piece that is connected to aid to counties, cities, towns and villages across the country, still has a decent chance of getting enacted. It was supposed to happen right after Fed Stim 3.5, then it got pushed back to this month which is almost over, so it looks like sometime maybe mid-June if we’re lucky,

No. 4 -- Genesee County’s Operational Status

All of the departments are putting together their reopening plans. We’re still on pause, at least until Friday. Some of our departments that are connected to state agencies like the courts and DMV may be into June before they can remotely think about some kind of general public reopening, and even that will be on a gradual basis.

Our highway crews are back – doing roadwork. We’ve never changed the operations as far as the jail, communications and the sheriff’s department; same thing with the county health department that has been working on full cylinder right from the get-go. Same with county emergency management.

We’ll start preparing at the very end of this month or early June, presuming that NY Pause is not part of our future.

If our seven metrics in the metric calculator that the state uses all stay in the green, we should be able to open on Friday for Phase Two. Again, there’s no absolutes as far as that’s concerned. Again, we’re talking about a (Finger Lakes) regional basis, so we may not be able to start Phase Two on Friday.

No. 5 – Six Furloughed Employees Return to Work

We are bringing a few people back. From our perspective and the departments’ perspective, they need to bring people back to help meet the demand and pick up the slack. But, again, we are using it also as a budget-saving tool in case the state comes in with its 20 percent reduction right out of the gate – which could be about three-and-a-half million dollars. Plus, whatever happens with our next quarter sales tax (revenue) report.

Currently, 42 employees are on furlough – (down from 48) – and we also froze another 40 positions that are staying that way. If your buildings and operations are not at full service, there’s no point in trying to bring people in to fill vacancies when you can’t send them off to training, can’t send them to the schools, can’t get them oriented, and even can’t have them work with colleagues to learn on-the-job training stuff.

No. 6 – The Importance of the 2020 U.S. Census

People need to fill out their U.S. Census forms. A lot of what’s coming with this state and federal aid is connected to the population of our communities. We need to have the U.S. Census filled out and achieve a better than 72 percent (rate). We need to be as close to 100 percent as we can. A significant number of the dollars are connected to the population of the communities across the country, so we do not want to be on the short end of that equation.
