Timothy K. Bump, 39, of 3207 Pratt Road, Lot #23, Batavia, is charged with a felony count of DWI, aggravated DWI with a BAC of .08 or greater, and failure to reduce speed for hazard. Bump was allegedly driving on Slusser Road in Pembroke yesterday at 5:10 p.m. when he lost control of his vehicle and hit a guard rail. No injuries were reported in the accident and no other vehicles were apparently involved. Deputy Patrick Reeves investigated the incident.

Michael Baldwin, 41, of 15 Maple St., Batavia, is charged with assault. Baldwin was arrested for an alleged incident Monday at 5:50 a.m. in which Baldwin is accused of throwing items from a shelf and recklessly causing injury to another person. That person was initially treated at UMMC and then transferred to Strong Memorial Hospital. Baldwin was jailed without bail. Officer E.E. Bolles investigated the alleged incident.

Lindsey Goins, 53, of 131 State St., Batavia, is charged with menacing, endangering the welfare of a child and disorderly conduct. Goins is accused of causing a disturbance on State Street at 3:40 p.m. on Tuesda. Goins allegedly shouted obscene language in the presence of children and threatened others with a pocketknife. Goins was jailed without bail. The alleged incident was investigated by Officer Matthew Baldwin.

Chad D. Crawford, 31, of 3 Cedar St., Batavia, is charged with menacing and harassment. Crawford allegedly had physical contact with another person and threatened that person with a knife. Crawford was jailed on $1,500 bail. The alleged incident was investigated by Officer K.M. DeFelice.

Jenna Marie Hattaway, 22, 113 Jackson St., Apt. 2, Batavia, is charged with criminal contempt and harassment. Hattaway is accused of throwing a radio antenna at another person. The court had previously issued an order of protection instructing Hattaway to have no offensive conduct toward that person. Hattaway was jailed on $500 bail. Deputy James Diehl investigated the incident.

Jeffrey Michael Johnson, 21, of 26 Farnsworth Ave., Oakfield, is charged with harassment. Johnson is accused of slamming his girlfriend to the ground and repeatedly punching her. The alleged incident occurred Sunday at 4 p.m. Johnson was released on his own recognizance with an order of protection for the woman.

Brandon M. Riordan, 23, of Rochester, was charged for unlawful possession of marijuana. Riordan was arrested by State Police while in Batavia at 12:35 a.m. today.

There are leads, but no hot leads in the search for the man who robbed the Five Star Bank branch in Pavilion yesterday.

The man fled the scene, apparently, by heading behind the bank, toward St. Mary's Street and the train tracks and heading off into the woods in that general direction.

That, at least, is what the Sheriff's Office believed yesterday, and where deputies and state troopers concentrated their search efforts for about four hours.

The biggest clue that might lead to arrest, Sheriff Gary Maha said, is the blue and black racing jacket with "Husqvarna" lettered down the left sleeve.

The robber is described as a white male, 25 to 35 years old. He presented a demand note at the branch at 11:32 a.m. yesterday and reportedly did not display a weapon.

UPDATE: We just received the example photo used at the top of this post from the Sheriff's Office.  This is what investigators believe is an example of the jacket the robber was wearing.

NOTE: The jacket isn't in Husqvarna's current catalog nor have I been able to find that particular jacket on sale any place online so far.  So it is pretty unique.

We received this e-mail from Jeff Lonnen today about somebody stealing his family's Halloween lights:

I am a resident at 3 porter ave in Batavia and me and my wife were out of  town this weekend.  While we were out someone stole our orange Halloween lights off our porch.  Now i know they don't cost much, but its just the point.  You try and make your house look nice for the holidays and people rip you off.  I don't feel its worth contacting the police over $5 worth of lights. But if someone knows anything about it, i would like to know.  And if you are the one that did it just return the lights.

The manhunt for a bank robber in Pavilion is going into "investigative mode," said Sheriff Gary Maha minutes ago.

The uniformed personal are being pulled from the field. DEC officers from Avon are on the trails through the woods where he was last seen. They will back track to the Five Star branch to see if the robber shed his hat and jacket after leaving the bank.

"When our deputy saw somebody he wasn't wearing this hat or jacket, so either it wasn't him or he dumped his clothing," said Maha.

Investigators are talking to Pavilion business owners and residents, sharing the bank photo of the suspect and following up on leads from the scene, Maha said.

A man suspected of robbing Five Star Bank in Pavilion at about 11:30 a.m. is still on the lam as law enforcement units from three counties (Genesee, Wyoming and Livingston) scour a heavily wooded area southwest of the village.

A state police helicopter is surveying the area, too, along with ATVs and a canine unit.

"We think he's still in the area," Genesee County Sheriff Gary Maha said. "But we're not sure."

Pavilion School has been in lockdown since the incident, but that is being called off now and school officials say the students will be dismissed at the regular time.

The suspect is described as white, between 25 and 35, between 175 and 180 lbs.. He's wearing a black jacket with light blue stripes down the sleeves, with a Husqvarna logo, sunglasses and a green and white hat.

According to Sheriff Maha, the suspect did not brandish a weapon when demanding money at the bank. He was seen running from the bank, then he dropped out of sight. Soon thereafter, a Sheriff's deputy spotted a man running down the railroad tracks nearby. He acted suspiciously and ran into the woods.

The heat-sensor equipment on board the helicopter is virtually ineffective in locating the suspect's whereabout in the thick woods. Law enforcement set up a wide parameter around the scene and eventually let the dog loose to help in the pursuit.

Meanwhile, officers were checking parked cars in the vicinity to clear them of any possible involvement. Fresh four-wheel drive tracks were spotted before the police ATVs arrived, but it's unknown if they relate to this incident.

No one apparently was injured in the heist and the Sheriff said it's unknown at this point, how much money was taken. Although it was intially reported by The Batavian that a bag with money was found, that is not the case. The suspect brought a "Target-type" bag into the bank, but it has not been found.

If this is another case of an urban resident robbing a rural bank, and that's not known yet, it would seem to indicate, according to Maha, that: "maybe they think we're easy pickin's. "

He said, on average, there's one or two bank robberies a year in Genesee County.

James S. Gibbs, 39, of Batavia, is charged with grand larceny, insurance fraud and offering false instruments for filing and a violation of the worker's compensation law. Gibbs is accused of collecting full disability related to an on-duty injury while drawing income from plowing driveways and sealing parking lots in Batavia. Gibbs was jailed on $10,000 bail.

Kathleen M. McBride, 44, of 115 State St., lower, is charged with assault and criminal possession of a weapon. McBride is accused of cutting her husband's face during a domestic dispute. Her husband was not seriously injured in the alleged attack. After he was cut, her husband allegedly pushed her onto the bed and held her there, not allowing her to get up. McBride was jailed on $3,000 bail.

Jean Marie Lorenz, 49, of 7907 Allegheny Road, Corfu, is charged with two counts of assault. Lorenze allegedly attacked and cut two people with a knife Saturday night. Lorenz was reportedly drunk at the time. She was jailed on $1,000 bail.

Karen Ann Garcia, 45, of 13535 Miller Road, Albion, is charged with endangering the welfare of a child. Gardia allegedly allowed her daughter to shoplift at Kmart. Garcia also reportedly lied about her daughter's name and age.

Jamie Luis Santiago, of 5057 Hundredmark Road, Elba, is charged with assault. Santiago was taken into custody for an alleged incident July 12. Santiago allegedly punched his wife in the face causing injury on that date.

Sath P. Dhanda, 29, of 219 Washington Ave., Batavia, is charged with disorderly conduct and assault. Dhanda allegedly instigated a fight. At the time of his arrest, Dhanda allegedly made verbal threats to a police officer. Dhanda was arrested at 7:48 p.m. on Friday.

Dylan A.J. Dembrow, 18, of 14 Pearl St., Akron, is charged with unlawful dealing with a child. Dembrow is accused of hosting an underage drinking party at a location on Akron Road in Pembroke on Saturday night.

James M. Wisniewski, 19, of Attica, was charged by State Police with harassment. The charge stems from a Sept. 19 incident in the Village of Alexander. No further retails are available at this time.

Thomas J. Preedom, 21, of Wyoming, is charged by State Police with rape in the second degree and acting in a manor to injure a child. According to the State Police blotter entry, Preedom is accused of raping an underage girl. The alleged incident took place in the City of Batavia on Sept. 25. He was subsequently charged with bail jumping, criminal mischief, escape and harassment. Cash bail was set at $50,000.

Ronald G. Albertson, 51, of Albion, is charged with DWI. Albertson was stopped by State Police in Elba on at 10:03 p.m. Saturday.

Sheriff's investigators are looking into a brazen daylight garage break-in in which the thief (or thieves) got away with three large items.

Stolen this yesterday morning from 27 Valle Drive, Batavia, was a John Deere tractor with a snow plow attached, a Yamaha Blaster four-wheeler and four snow tires that fit a 2005 Pontiac G6.

The burglars smashed a window to get into the garage between 9 and 10:15 a.m. and left through the overhead garage door, leaving it open.

Anyone with information that might help solve this crime are encouraged to call the Sheriff's Dispatch Center at 345-3000, Ext. 1.

James D. Henry, Jr., 54, of 8296 E. Main Road, Le Roy, is charged with a felony count of criminal possession of a forged instrument and a felony count of attempted grand larceny. Henry, a former Village of Le Roy employee, allegedly entered the village office on Monday possessing a forged doctor's prescription. It stated that Henry "would be out until further notice" in an attempt to gain sick leave compensation, which would have totaled more than $3,000. Henry was arraigned and released under supervision of Genesee Justice.

Robin L. Pirdy, 50, of 588 Route 98, Attica, is charged with DWI and aggravated DWI with a BAC of .08 or greater. Pirdy was reportedly found parked on the side of Molasses Hill Road in Bethany by Deputy Kevin McCarthy. Upon investigation, McCarthy determined that Pirdy had allegedly been driving while intoxicated.

Steven Robert Gorecki, 23, of 106 Tracey Ave., Batavia, is charged with petit larceny. Gorecki is accused of shoplifting from Target.

Willie A. Sabb, Jr., 35, of 19 Porter Ave., Apt. 2, Batavia, is charged with assault in the third degree, endangering the welfare of a child and harassment. Police picked up Sabb at his residence on warrants issued by City Court. The charges stem from three separate alleged incidents. No further details were released.

An Oakfield man who had sex with a 15-year-old girl and videotaped multiple sexual acts with the girl was sentenced to seven years in state prison and 15 years of supervised release following his time in lock up.

Corey W. Klase, 24, was previously plead guilty to charges of sexual performance with a child and rape in the third degree. He was originally indicted on 12 counts.

Klase was arrested in January after deputies searched his home and found a video that depicts Klase engaging in multiple sexual acts the girl.

Arrested a few days after Klase was his girlfriend, Jessica R. Henry, 23, of Oakfield. She was accused of directing the girl in the videos. She was sentenced in July to six months in jail and 10 years probation.

Gergory P. Hamm-Johnson, 19, of 10140 Brookville Road, Alexander, is charged with a felony count of DWI, aggravated DWI and illegal dumping. He was stopped by Deputy Kevin McCarthy at 2:52 a.m. for allegedly throwing trash from his vehicle onto Old Creek Road in Alexander. 

Brian T. Rushing, 24, of 3314 Eagle Harbor Road, Albion, is charged with DWI, DWI with a BAC of .08 or greater, driving left of pavement markings and unlicensed operation of a vehicle. Rushing was stopped on Townline Road in Bergen by Deputy Howard Carlson on Thursday at 5:33 a.m. for an alleged traffic violation.

Matide Maximino Luis, 21, no address, is charged with entering the country illegally. Luis was picked up last week following a traffic accident on Route 20 in Pavilion. Luis allegedly ran from the scene after deputies suspected he was in the country illegally. He was captured after a short foot chase. Luis was turned over to the Department of Homeland Security Border Patrol.

Four Genesee County men were arrested for alleged trespass on Sept. 19, according to a State Police blotter item released yesterday. The four men are apparently accused of trespassing at 2750 Maple Road, Oakfield. Arrested and charged were Ryan T. Schultz, 22, of Oakfield; Robert J. Maerten, 22, of Basom; Donald J. Maerten, 24, of Basom; and, Adam R. Bischoff, 22, of Oakfield. No further details are available.

Attorney Thomas Burns won't get a change of venue for his client Matthew Wells, at least not yet, according to a ruling handed down by the New York Supreme Court, Appellate Division, Fourth Judicial Department.

Wells is one of three men accused of robbing the M&T Bank branch in Elba on June 18 and then leading local law enforcement on a six-hour manhunt through the fields and woods between Batavia and Oakfield.

Burns argued that Wells could not get a fair and impartial jury in Genesee County because many residents -- as evidenced primarily by comments left on The Batavian -- took offense to the perception that three city slickers could get away easily with a bank robbery in a rural county. Burns, in his motion, picked up on the phrase of one comment on The Batavian about dishing out "rural justice."

Burns also suggested that the only a fraction of Genesee County residents are black, so that it would be hard to seat a jury of peers for his African-American client.

The appellate judges ruled that Burns did meet the burden of proof that there is "reasonable cause to believe that a fair and impartial trial cannot be had." But the single-page ruling left open the ability for Burns to appeal again during the jury selection phase of a trial.

It's rare -- if not unheard of -- for attorneys to be granted a change of venue before jury selection begins, but if Burns had not filed the motion now, he could not file a motion -- under rules of the court -- for a change of venue later.

Wells is the only one of the three defendants to not plead guilty. Both Damone Dillon and Dennis Abrams have admitted to their roles in the June 18 robbery. Abrams, who planned the heist, is facing a lengthy prison term. Wells is accused of entering the bank with Abrams and actually participating in the stick up, while Dillon held the door and claims to have been a reluctant participant.

Neither defendant has been sentenced yet.

A woman has been arrested for allegedly telling the Department of Social Services that a relative moved into her house, qualifying her for temporary government assistance.

Between Dec. 5 and Feb. 16, Stacey Ziminski, 36, of 119 South Swan St., is accused of collecting public assistance checks totalling $710.93.

The family member Ziminiski allegedly said was living with her, was actually living elsewhere, according to DSS investigators.

Ziminski was charged with two felony counts of offering a false instrument for filing in the first degree and one count of misdemeanor petit larceny.

She was arrested by Genesee County Sheriff’s Deputy Matt Butler, and arraigned before Stafford Town Justice Ben Mancuso, who ordered her held on $250 bail. 

Statements made by Dietrich Williams to State Police during an investigation into a shaken baby case in June can be used at his trial, Judge Robert Noonan ruled this morning.

Williams, currently held in Genesee County Jail, is charged with assault in the first degree and reckless assault of a child.

The content and nature of his statements were not discussed in court today, but he spent nearly eight hours in State Police custody June 25, after being picked up at a residence he shared with his girlfriend at 14 Hutchins Place.

The baby's name is Mariah and she was reportedly critically injured. Both Defense Attorney Jerry Ader and District Attorney Larry Friedman are waiting for the hospital to produce the baby's medical records for evidentiary review.

Williams is accused of shaking the baby and hitting Mariah's head against a hard object.

Shaken Baby Syndrome has come under new research scrutiny recently, and researchers suggest that the baby's head hitting a hard object may be a key element to any crime.

In his ruling, Judge Noonan said that Williams was made fully aware of his rights and had every opportunity to request an attorney or to cut off questioning. There was nothing improper about the State Police agent's questioning, Noonan said.

State Police investigators who specialize in violent crimes assisted in the investigation.

There were 10 more break-ins into unlocked cars in the Town of Batavia overnight.

Six occurred on Stringham Drive, two on Violet Lane and two on Terry Hills.

The usual items were taken, according to Deputy Chief Gordon Dibble, adding that the break-ins may be related to yesterday's thefts.

"For the most part, the thieves are limiting their efforts to unlocked cars with valuables in plain sight," he said. "Locking cars and removing valuable items (maybe locking them in the trunk) would seem to be prudent advice."

A Stafford man admitted this morning to brandishing a rifle in a threatening manner during a dispute on March 17.

Michael A. Nicometo, 24, also pleaded guilty to an unrelated misdemeanor DWI charge and aggravated unlicensed operation of a motor vehicle. He was arrested on the DWI charge in Le Roy on Sept. 6.

As part of the plea arrangement, a handful of traffic tickets, some stemming from the Sept. 6 arrest and two others from other dates, were dismissed.

Nicometo will be released to an alcohol treatment facility and will come back at a later date for bail review and sentencing on the menacing and DWI pleas.

The maximum sentence imposed on Nicometo, primarily for the aggrevated unlicensed operation charge, could be four years in state prison. But if Nicometo follows the judge's orders, he could face a maximum sentence of 1 1/3 to 3 years. Regardless, the menancing charge would result in a concurrent sentence.

A Batavia man accused of selling cocaine and crack cocaine on two different occasions plead not guilty today to all the pending charges.

Timothy "Cricket" O'Neil Lee, Sr., of 19 Porter Ave., Batavia, is charged with four counts of criminal sale of a controlled substance and four counts of criminal possession of a controlled substance stemming from an arrest earlier this month. In June, Lee was arrested and charged with criminal sale of a controlled substance and two counts of criminal possession of a controlled substance. He was reportedly a resident of Ross Street at the time of that arrest.

Lee is out of jail after posting bail of $50,000 for the first arrest and an additional $5,000 on the second set of charges.

Two men accused of dealing drugs in Batavia -- in separate cases -- were in court today to consider possible plea bargains and both men said they needed more time to think about the offers.

Michael R. Ransear, 24, of Rochester, was arrested in January for allegedly dealing crack cocaine. His aunt was arrested at the same time for alleged possession of a controlled substance.

Today, Asst. D.A. David Gann told Judge Robert Noonan that Ransear has been offered a plea that would lead to a maximum six-month sentence. He would be required to plead guilty to a class D felony, criminal sale of a controlled substance.

Ransear's attorney, Fred Rarik, said his client requested more time to think about it. Judge Noonan set a trial date for October, but also granted Ransear an extension on the plea offer.

Kirby S. Wall, 32, of Rochester, was arrested in April. He reportedly tried to run from police to evade arrest but was subsequently caught in the area of 400 Towers.

Wall has been offered a 2 1/2- to 3 1/2-year prison term in exchange for pleading guilty to a felony count of criminal sale of a controlled substance as a second serious felony offense.

Wall, also, wants more time to consider the offer. Judge Noonan granted an extension on the offer, but also set a trial date in the case.

Gann asked that as a condition of his plea, Wall be required to return "the buy money," which he allegedly ditched during the foot pursuit.

Both Wall and Ransear are out on bail.

Cody L. Pahuta, 18, of 9548 Alleghany Road, Corfu, is charged with rape in the second degree, a criminal sexual act and endangering the welfare of a child. Pahuta is accused of having sexual intercourse with a 14-year-old girl. He was jailed on $10,000 bail. The case was investigated by Village of Corfu Police.

Joel D. Prouty, 23, of 705 Old State Road, Bergen, is charged with DWI, aggravated DWI with a BAC of .08 percent or greater and citations for alleged unsafe lane change, consumption of alcohol in a motor vehicle, uninspected motor vehicle and failure to notify DMV of an address change. Prouty was stopped by Deputy Jason Saile on Thwing Road in Stafford following a report of a suspicious person in the area. Prouty was issued an appearance ticket.

A Stafford man was robbed in his home this morning after he answered a knock on the door only to be hit on his head by a man wielding an unknown object, and when he regained consciousness, the 22-year-old had been cut on his chest and face.

He was treated at UMMC, although his injuries were not serious.

The robber or robbers grabbed his wallet and smashed his mobile phone. The wallet was recovered in the driveway, short $30 cash.

No other items were reported stolen.

The suspect is described as a male in his early 20s, stocky build, wearing blue jeans with a black hoodie. He may have been driving a red Pontiac Grand Am.

The incident occurred between 9:30 and 9:45 a.m..
