Empire Access, which has an office in Batavia, has received a $3.2 million grant award from the New NY Broadband Program. The New York Broadband Program was developed to help fund the expansion of high-speed broadband Internet service in New York State, with the ultimate goal of ensuring that all New Yorkers have high-speed broadband access by the end of 2018.

The New NY Broadband Program grant provides Empire Access with significant funding for the expansion of high-speed broadband services to more than 1,600 homes and businesses in the Finger Lakes and Southern Tier regions of New York, including Burdett, Lodi, Odessa, Prattsburgh and Pulteney. These specific areas were identified by the New York State Broadband Program Office as underserved or unserved in Phase II of a multiphase grant process.

Empire will offer residents in the awarded areas super-fast Internet service with standard speeds of 100 Mbps download x 20 Mbps upload, along with an even faster 1 Gigabit per second option. High definition digital television, digital phone, security and smart home services will also be available. All services will utilize a state-of-the-art 100-percent Fiber Optic dedicated connection.

This deployment of broadband service is supported by a grant awarded to Empire Access by New York State through the New NY Broadband Program.

About the New NY Broadband Program

Recognizing the importance of broadband infrastructure and building on prior State investments in broadband deployment, Governor Andrew M. Cuomo in 2015, with legislative support, established the $500 million New NY Broadband Program. The Program provides New York State grant funding to support projects that deliver high-speed Internet access to Unserved and Underserved areas of the State, with priority to unserved areas, libraries, and Educational Opportunity Centers.

An “unserved” area is defined as an area where the fastest available advertised Internet download speed offered by a wireline-based provider is less than 25 Mbps. An “underserved” area is defined as an area where broadband service is only available from a wireline-based provider at advertised Internet download speeds between 25 Mbps and 99 Mbps. The program is the largest and most ambitious state investment in broadband in the nation, with a goal of achieving statewide broadband access in New York by the end of 2018.

Brian Fiorella became the first Batavia resident with TV service from Empire Access today when a work crew completed the addition of the service to his home network.

It's been a long process for Empire to get the agreements and approvals in place with the city and state to start providing TV service to Batavia residents, so Empire executive Bob R. VanDelinder was on hand for the installation.

"It's exciting for us," VanDeinder said.

Dozens of people have already signed up to start getting TV service from Empire, even though the company just started advertising its availability.

The service is entirely digital and combined with broadband service gives customers the opportunity to access the full array of home entertainment services available online and from TV networks.

"Given that it's all digital, you have great quality," VanDeinder said. "There are still systems out there that are analog, cable-type systems, so you don't have the same quality.

"Being on fiber optics allows us to provide better service uptime," VanDeinder added. "With this service we're able to provide amazing digital TV service, HD service, DVR -- whole-home DVR, and we have a watch-TV-anywhere feature, which allows you to watch TV from anywhere in the world with an internet connection."

Empire Access has received a $3.4 million grant award from the New NY Broadband Program.  The New NY Broadband Program was developed to help fund the expansion of high-speed broadband Internet service in New York State, with an ultimate goal of ensuring that all New Yorkers have high-speed broadband access by the end of 2018.

Empire Access is a locally owned and operated fast-growing telecommunications company, offering high-speed Internet, digital television, phone and security services to homes and businesses – all enabled by Fiber Optic technology – to over 25 communities in Upstate New York and Northern Pennsylvania.

The New NY Broadband Program grant provides Empire Access with significant funding for the expansion of high-speed broadband services to more than 1900 homes and businesses in the Southern Tier region of New York, including Burdett, Lodi and Odessa. These specific areas were identified by the New York State Broadband Program Office as underserved or unserved in Phase I of a multi-phase grant process.

Empire will offer residents in the awarded areas super-fast Internet service with standard speeds of 100 Mbps download x 20 Mbps upload, along with an even faster 1 Gigabit per second option. High definition digital television, digital phone, security and smart home services will also be available. All services will utilize a state-of-the-art 100% Fiber Optic dedicated connection.

Officials with Empire Access said today they expect to begin offering cable TV service in Batavia this fall.

They've applied for a franchise license and have been working closely with City Manager Jason Molino and other staff on an agreement.

"Jason's been great to deal with. We're looking forward to giving Time Warner more competition," said Empire COO Jim Baase.

Empire Video, a subdivision, has been offering high-speed Internet service (data and voice) in the city for the past year.

Following a public hearing, once the city council approves its franchise agreement, it goes to the state’s Public Service Commission for final approval.

Empire plans to offer new customers an introductory monthly rate of $65, which would rise to $121 after six months. There would be no rate increase for the term of the contract.

But existing Empire customers would be offered "bundled pricing" and be given the opportunity to get the introductory rate as well.

"We try to do the right thing by customers," Baase said.

Once cable TV service is added to the mix, Empire expects to double its local customer base, to at least 15 percent market penetration.

Customers can expect a high-quality, 100-digital signal with a higher resolution than the competition, which has a mix of analog and digital.

Plus, they will be able to provide their customers with local stations from both Rochester AND Buffalo, not one or the other as is the case currently -- depending on your provider.

Also, it will all be in high definition at no extra cost.

"It's a TV everywhere product," said Bob VanDelinder, Empire Access director of marketing. "You can watch it on your iPad, smartphone, and not just at home, but while traveling, too."

The digital video recording service records up to five different stations at a time, and while using different TV sets.

There will be no set-up or installation costs. No bulky cable to install. It's all wireless, with a modem. And they will help you program your remote control device before they leave.

"It's a pretty easy transition for customers," Baase said.

"We offer a very competitive product," VanDelinder said. "We're excited to be here."

Because Batavia is already wired for broadband, TV service will be a cinch for Empire to roll out.

"It'll happen immediately, as soon as we sign a franchise agreement with the city," Baase said.

Empire says its eager to help the city in its "Bet on Batavia" campaign to vy for $10 million in downtown revitalization funds, for example, by bringing Wi-Fi downtown.

They are rolling out broadband to business customers in the Village of Le Roy and hope to add residential soon.

The City of Batavia is wired. Wired for high-speed broadband, that is. 

Empire Access can now deliver download speeds of 100 megabits to more than 95 percent of the properties in the city. There are only about 40 or 50 households that would be hard to reach, but once a couple of access hurdles are cleared, Empire will be able to service those customers as well.

"We're very pleased with the response we've received," said Jim Baase, president of Empire. "Even without video, we've sold a lot of internet-only packages. We're ahead of plan of where we thought we would be and video will only help with more penetration."

While broadband and telephone service is licensed through the state and requires no local approvals to provide service, federal law requires cable TV providers to sign franchise agreements with local municipalities.

Empire has been in negotiations with the City of Batavia for a franchise agreement for at least six months. Councilman John Deleo has raised the issue at two consecutive City Council meetings and City Manger Jason Molino hasn't wanted to comment further in public than "we're in negotiations."

Empire already has franchise agreements with 35 other municipalities in New York.

"Typically, it takes a couple of months to get through negotiations," Baase said. "It's taking a little longer with the City of Batavia. There are still a few outstanding issues that the city is requiring us to agree to. We haven't resolved those issues yet. We're hopeful in the next few weeks those issues will get resolved."

For residential customers wanting affordable, high-speed broadband now, the installation process typically takes about two weeks.

The photos with this story are of an Empire crew doing a line drop on a residential street in Batavia and at a Downtown location.

Once a customer signs up for the service, an outside crew drops a line to the location and tests it. An inside crew comes later, at an appointed time with the customer, to finish the install inside the residence.

The installation make take a little longer with apartment complexes serviced by underground utilities.

Empire is also working on expanding service beyond the City of Batavia. The company is working with Town of Batavia officials now to start stretching beyond the city's borders and engineers are drawing up plans for providing service in Le Roy.

The company hopes to start building the network in Le Roy by the fourth quarter of this year.

As for reaching more rural parts of the county, Baase said the company is looking for municipal partners in that process and is in fact talking with Town of Batavia officials along those lines.

With such partners, it might make it possible to tap into the $500 million in seed money Gov. Andrew Cuomo has proposed for expansion broadband in rural New York.

They're also looking for more partners like the Town of Big Flats, in Chemung County, where officials didn't want to wait around for grant money, so the town helped Empire secure a low-interest loan to build out the network.

"There are limited resources and we can't build everywhere at once," Baase said. "We're in the Town of Big Flats because they reached out to us. We're looking for more partnerships like that."
