Genesee County conducted an auction of properties with tax liens at Bontrager's in Batavia on May 20.  Here are the results of the auction.

Winning bidder agrees to pay $33K for 109 Walnut

Jeff Freeman was the high bidder this morning at an auction by the city of a house at 109 Walnut St.

Freeman agreed to pay $33,000, beating out three or four other bidders.

The purchase must be approved by the City Council before it is final.

Freeman said he plans to complete renovations on the house and then provide it as rental.

It is a single-family home and auctioneer Todd Jantzi, of Bontrager's, noted that the city sold the house once before at auction, in 2011. That buyer subsequently sold the property and the new buyer began renovations, and got very far along before abandoning the project for unknown reasons.

The house has been painted upstairs and down, has new carpeting and flooring throughout and a new kitchen, but lacks fixtures.

The city foreclosed on the property to satisfy unpaid taxes.

City staff has proposed using the auction money to fund Vibrant Batavia for another year, but that would require City Council approval first.

Properties there were foreclosed on by either the city or county in the past year for failure to pay property taxes were auctioned off today at Bontrager's.

We'll post the results of the auction once they are available to us.

Note that the selling prices are listed along with the approximate amount of taxes and penalties owed. ***However, included in the amount DUE is interest, but that needs to be removed, as it was not earned. So the final amounts DUE are not available today, but they will be less than shown below.

Treasurer Scott German said the amount of taxes owed has been calculated not to include accrued interest, but the figure is still preliminary. The list of city properties sold is not yet available.

Bontrager's hosts auction of county and city properties seized for unpaid taxes

About 150 people registered for yesterday's auction of foreclosed properties at Bontrager's on Wortendyke Road.

The county was owed about $310,000 in back taxes for the properties included in the auction. The properties sold for a total of $665,000. Those figures are preliminary, said County Treasurer Scott German.

The city also had a handful of properties up for auction, but those figures are not available at this time.

All of the properties auctioned were seized by either the county or city for failure to pay property taxes for a number of years.

We'll provide more details when they become available.

City turns profit on three properties sold at tax lien auction

The city realized a nearly $91,000 profit on the sale at auction of three properties that were seized last year because of delinquent property taxes.

Back taxes on the three properties totaled $66,686 and they sold for $157,500.

The names of the buyers were not released in a memo given to the City Council prior to Monday's meeting.

The properties sold were:

  • 339-341 Ellicott St. ($23,062 taxes owed, sold for $44,500)
  • 10 Swan St. ($18,730 in taxes, sold for $72,000)
  • 61 Oak St. ($24,894 in taxes, sold for $41,000)

This time things worked out in the city's favor, City Manager Jason Molino said. Sometimes properties at auction go for less than the unpaid taxes.

Twenty parcels slated for county tax lien auction

County Treasurer Scott German has released the list of properties in Genesee County slated to be auctioned off as a result of unpaid tax liens.

There are 20 parcels with a total assessed value of $579,500. The total unpaid taxes on the 20 parcels is $174,259.28.

The auction is set for 10 a.m., March 3, at Bontrager's Auction Center, Wotendyke Road, Batavia.

City releases list of property that could be auctioned off for non-payment of taxes

There are eight properties in the City of Batavia that could be put up for auction for non-payment of property taxes, other charges and fees. All eight properties have reportedly been delinquent for three consecutive years.

No date has been announced for the auction.

The properties are:

  • 24 Franklin St., a single family home, delinquent $17,244; assessed value $67,700
  • 12 Hall St., a single family home, delinquent $12,501; assessed value $29,000
  • 1 Pearl St., a single family home, delinquent $27,294; assessed value $48,000
  • 3 Walnut St., a single family home, delinquent $18,962; assessed value $54,900
  • 48 Walnut St., a single family home, delinquent $29,746; assessed value $54,900
  • 109 Walnut St., a single family home, delinquent $27,381; assesed value $52,000
  • 11 Watson St., a single family home, delinquent $11,598; assessed value $49,900

County to no longer cover cost of building demo following foreclosures

When a property in a town or village is seized in a tax lien foreclosure, by law and by courtesy, the county ensures towns, villages and school districts receive the back taxes owed those jurisdictions. 

The county also reimburses some related expenses the local jurisdiction might incur, including, up 'til now, demolition costs on condemned buildings.

But that can get expensive, so County Treasurer Scott German proposed to the Genesee County Legislature on Wednesday that the county stop guaranteeing towns and villages that demolition costs will be covered.

German is asking the legislature to pass a resolution, followed by a letter from County Attorney Charles Zambito to mayors and supervisors, declaring that the county will no longer cover the cost of demolition on tax lien foreclosed buildings.

Some costs could be covered, German said, if the property fetches more at auction than is owed in delinquent taxes, but for parcels without buildings, that rarely happens.

German told the Ways and Means Committee that, for example, on a parcel that is less than an acre, it might bring $3,000 at auction, but the demolition cost on a building might be $20,000.

The way things have been, the county ends up paying the entire bill, even though it had no part in contracting for the demolition.

"Who can blame them for going in and taking care of demolition, but it shouldn’t be a county cost," Legislator Mary Pat Hancock said.

Under state law, the county must reimburse school districts and towns for taxes owed when it forecloses on a property, and the county has provided those reimbursements to villages, even though not mandated by law.

The city takes care of its own tax lien foreclosures.
