Wiss supporters hope trustees take conservative route and avoid taxpayer expense to raze building

Preservationists in Le Roy still think the former Wiss Hotel building can be saved from the old wrecking ball.

In interviews and conversations this week, Wiss backers said they still don't believe village trustees will want to spend six figures of taxpayer money, creating a vacant lot with an uncertain future and expense, when there is a willing and able buyer ready to step in and rehabilitate the structure.

They hope public pressure over the expenditure -- once the cost is known -- will build, and that more people will come forward both to endorse the Le Roy, NY, LLC, and to express their support for retaining some of the charm of the village.

In fact, according to Bob Fussell, more people may show up at tonight's village board meeting to let trustees know how important the issue is to them.

He said he's heard from at least two such people.

The trustees meet at 7 p.m., and since the Wiss isn't on the agenda, any remarks will come later in the meeting during the public comment time.

Meanwhile, the process of requesting bids from demolition companies was delayed a couple of weeks after village officials learned an asbestos survey was necessary before the village could publish an RFP.

Mayor Greg Rogers said the study was completed -- though he didn't immediately have available the results -- and the RFP has been publicized.

The RFP process will give trustees the truest picture yet of just how much it will cost taxpayers to demolish what is perhaps the oldest commercial building in Le Roy.

Informal estimates have ranged from $150,000 to $250,000.

The Le Roy LLC has offered $10,000 for the building and the promise to shore up the building immediately and raise $400,000 to finance restoration.It's unlikely, according to Fussell, that the building could be torn down any sooner than the LLC could shore it up and begin rehabilitation work, negating any concerns over the building's safety.

"My gut feeling is once the community understands the potential cost to demolish the Wiss, we might get a favorable vote at that point," Fussell said.

Rogers has consistently said he doesn't necessarily back the LLC's plans, but thinks their proposal makes the most business sense for the village.

When trustees see the actual price of demolition, it may persuade one or more of them to change their minds.

"I wouldn't say it's a dead deal," Rogers said.

Trustee Jennifer Keys said she's also optimistic that at least one other board member can be persuaded to support the sale of the Wiss to the LLC.

"I hold out hope that until the building is gone, somebody is going to come forward and say something that is going to resonate with other board members," Keys said.

Meanwhile, she said she feels in an odd position. A Democrat, Keys said she feels like she's to the right of some of her colleagues on the issue.

The three trustees advocating the expense of demolition are either Republicans or Conservatives.

"I'm kind of baffled," Keys said. "I must be missing something. I'm generally seen as the most liberal person on the board and I don't see why we would spend this money and not accept $10,000 for the building."

The trustees who so far been backing spending the money are Robert Taylor, Jim Bonacquisti and Mike Tucci.

We tried to reach each of the three men this week to ask a basic question: Why not give the LLC a chance to see what it can do? What's the harm in letting them try?

Taylor said his biggest concern is the people in the LLC. He doesn't think the building can be saved and the people willing to put their own money in the Wiss will lose their investment.

"It's not a question of giving them a chance," Taylor said. "My firm belief is the building is in a condemned condition and they're just pouring their money into a bottomless pit.

"I grew up in this town," Taylor added. "I've known Bob Fussell since he was 2 years old. I haven't seen the list of people in the LLC, but I've lived here for 70 years, so I assume I know them all. Like I said before, I don't want to see anybody pour money down an empty hole."

Taylor said he has fond memories of going to the Wiss as a boy with his parents.

"I remember it when it was in its quote unquote heyday," Taylor said, "and I know what it looks like now."

He said he has it on good authority that the third floor has been suffering from water damage for 30 years and that beams are soaked with water and won't hold a nail.

"I really believe the building is beyond repair," Taylor said.

He also said, "I don't really care what they build. That's not my concern. I don't want them to spend money needlessly."

Bonacquisti also believes getting the actual cost of demolition will help resolve the issue, but not necessarily in favor of the preservationists.

"Despite the folks coming forward now, I can list three times as many folks that agree with our decision," Bonacquisti said in an interview through Facebook messages.

His position hasn't changed, he said.

"I truly believe that corner is worth a lot more empty than having that old building there," Bonacquisti said. "The traffic flow at that four corners is very high and as I have stated in the past, that corner is screaming for some type of retail where we can generate property tax and add to the employment of folks in this area."

The Wiss with apartments on the second and third floor just isn't a good idea, Bonacquisti. There are already too many apartments in Le Roy, he said, plus he knows the building well (he and his wife once lived within 200 feet of the Wiss) and the odor from vehicles, the noise and high traffic volume makes it an unappealing place to live.

He regrets that the village didn't resolve the issue three years ago (which was before he was on the board).

"I also believe taking that building down can fix that corner once and for all," he said. "Have you ever been on Lake Street in the left-turn lane? Pull up to the stop line, only to have to throw the car in reverse as a truck or bus is coming from the east turning north?"

Tucci did not respond to The Batavian's request for an interview.

Keys said she is still confused by her colleagues' position and thinks the LLC proposal should appeal to conservative politicians.

"It's free enterprise," Keys said. "It's people in the community taking care of an issue. It's a group of people who believe in it so much that they've spent their own money to get this far. It just doesn't make sense economically to spend money unnecessarily, even it's as low as $148,000. We could spend that $148,000 on infrastructure."

History: The Wiss has stood in Le Roy for at least two centuries. The original structure was built by Richard Stoddard. Stoddard died in 1810, so the building had to have been erected prior to 1810, according to an article by Le Roy Historian Lynne Belluscio. The article appeared in the Oct. 3, 2005 edition of the Le Roy PennySaver. John Wiss purchased the building in 1869. The hotel was briefly known as the Michel House after George Michel of Wheatland purchased it in 1904. John Hepps purchased it in the 1920s and renamed it the Wiss Hotel, in honor of the previous owner. Don Pangrazio ran the establishment for 40 years before closing it down in 2005. The county acquired the property in 2010 in tax lien foreclosure and immediately deeded it to the village.

Wiss Update

There has been much discussion about the Wiss Hotel on the corner of Routes 19 & 5 in the Village of Le Roy for a few years, but lately the level of discussion has increased. As I did with the pool 2 years ago I would like to try to outline where we are at right now.

About 15-months ago the Village acquired the building known as the Wiss, including the two store fronts on Route 5 that lead up to the tattoo shop, Blood Money, Inc. We advertised it as make an offer and hoped to have the situation resolved (sell the building or demolish it) by one year after acquisition, November 2012. A few potential buyers have gone through it, but no offers were made.

As demolition appeared imminent in August 2012 a concerned group of local citizens put their money together to hire Rick Hauser, of In.Site :Architecture, an expert in the field of rehabilitation and revitalization, to go through the building to evaluate it and produce a feasibility study. He went through the building along with his associate, Mayor Rogers, Bob Fussell, representatives from the DPW, and me (Trustee Keys). Rick and his associate went through the entire building from the basement to and including on the roof. The first hand knowledge they acquired from going through the structure combined with some research conducted about surrounding properties allowed them to put together a feasibility study that first determined the building was worth saving, and second, that with about $1,000,000 in investment (in kind services, cash, and loans) it was likely to break even relatively quickly and turn a profit in a few years. Rick also made drawings of a restored Wiss, showing commercial establishments, and several gorgeous apartments, most 2 stories, taking up the second and third floors of the building. Because the report was favorable and people surfaced who said they would be willing to invest in the project – including Bryan Colton, a local owner of a company that restores buildings that suffer severe damage from fire and water and who will bring it back up to code - the group submitted an offer to purchase the Wiss on November 2, 2012. By this point the Village Board had been told that it would cost between $178,000 and $250,000 dollars to demolish the building, so the purchase offer was worth discussing and delayed decision.

The original offer included a $1 purchase price and request for a loan from the Village in the amount that would have been expended for demolition. There was a great deal of discussion around this and it was decided that tax payer money would not be loaned to anyone to do this. The group then came back with another offer 0n December 7 that excluded the loan from the Village and increased the amount to be raised by investors.

After the second offer was received Mayor Rogers put together a counter offer that was believed to be palatable to both the Village Board members and the group of people who wanted to purchase the building. At our January 9th Board meeting this offer died. By January 9th the Village Board had been presented with a written engineering report that was requested from Clark Patterson Lee after their engineer went through the building that in addition to outlining every detail that needs to be taken care of in order to stabilize the building, also stated that the building is “not in imminent danger of collapse” and stabilization with rehab is a legitimate option. Different interpretations of the report raised concerns over safety and by a vote of 3-2 it was decided that the Board should seek bids to demolish the building. In addition to the safety concerns, several board members wanted to see more action taken to make the LLC an officially recognized entity, and wanted $10,000 upon closing (rather than 1 year of the issuance of a certificate of occupancy).

As a result, before the January 23rd board meeting the group filed with the state and became a legally recognized LLC, Le Roy NY LLC, and submitted a new offer that set closing at on or before four months after acceptance of the offer, $10,000 upon closing, and no contingencies for anyone going on the roof prior to closing (which was part of previous discussions). The offer was submitted on January 23rd and discussed at the meeting, though no decisions were made as not everyone was present and we had not had time to review it in its entirety.  At the same meeting a local businessman verbally offered $125,000 cash for the empty lot after the Village demolishes the building. This has subsequently been put into writing.

What we have before us now is an offer from a group of people who have leapt over every hurdle placed in their way and who have been negotiating transparently in the open with us for several months and gives the Village extra money to potentially use for safety concerns in other areas of the business district versus an offer that was recently made that requires the Village to first expend money to remove the building and does not break even versus tear it down without a plan. By the way the demolition bills keep racking up-we must first pay for an asbestos survey before we can put it out to bid for demolition. When combined with the verbal estimates prior to the survey we are now looking at about $182,000-$254,000 to demolish and we do not have an answer yet about the need for asbestos abatement.

There has been a great deal of discussion since the original offer was made by the group of people in November. The arguments against selling and for demolition have included; it is an “eye sore”, it is ugly, the corner needs to be fixed, why this building, why now, it is a hazard, it has no historical value, we have too many apartments, there is not enough parking, young people do not like old buildings, there are other buildings worth saving, what will happen when the LLC does not succeed. The arguments for selling have included; every building is worth saving as long as it is sturdy (especially on Main Street), it is a better economic deal for the Village tax payers (to sell), there is a group of people who have stepped up and already used their own money to get this far, it is time to stop demolishing Main Street.

I think it is important that people know that the Village is not able to fix the corner for truck traffic. It is owned by the State and that the DOT has been taking money away from our area of the state, so there is no guarantee that it will be addressed if the building is gone. In addition, there may be another way to address the problem that has not yet been discussed. The rest of the arguments against are really all a matter of personal opinion. For example, many people who look at the building see its beauty and what they can do to tie it into Main Street, such as painting the wood and adding cornices to match Bill Kettle’s building on the other end of the block.

At this point the bottom line may not even be the need to save old buildings, but to do what makes the most business sense for our community. One scenario makes us, in effect, $192,000-$264,000 when you combine the $10,000 purchase fee along with keeping the demolition and asbestos survey fees, the other two cost us money without a clear plan as to what to do next.

Old Architecture

As I did with the Pool controversy two years ago I plan to put up an informational blog about the Wiss Hotel controversy. As I was typing it, though, I was reminded that I have always been an old building person and that most of you do not know me on a personal level, so I thought I would give you some background to lay the foundation.

 

I grew up in Canandaigua. My family lived in ½ of a house across from the Army Depot until I was nine. It was a great house with a lot of turns and character. There was even a cast iron claw-foot tub! The full size attic was truly amazing. The only access was through the raised panel door in my parents’ bedroom. I loved playing up there. My best friend down the street had an attic I loved even more. I am pretty sure our attic was bigger, but her attic was accessed through their bathroom. That was so cool! I remember as a small child comparing house features. Our stair case had about three steps up to a landing where you turned to go straight up to the second floor. Their staircase went straight up to a slight curve near the top. They even had a laundry-shoot that went from the second floor to the basement. Our friend around the corner lived in a “mansion”. It was an Italianate with a cupola, TWO interior staircases, a side porch and a barn in the City. The first time I visited there I decided I would live in a house with two interior stair cases. The ceilings were so high and the bedrooms were huge.

 

When I was nine my parents bought their house. I spent my childhood imagining how I could build a second stair case and turn the one stair case around because it does not make sense the way it is. There is an attic room at the top of the stairs on the second floor. Throughout my life I have imagined it as a bathroom, bedroom, home office, play room, you name it.

 

My dad grew up in a house where his family was only the second family to ever live there. I loved to go to my grandparents’ house to play. They had TWO front doors off of the front porch. There was a name plate on one of the doors that covered the key hole. It had the names of the people who built the house engraved on it. The best part, though, was their basement. My grandpa had finished it into an amazing work shop and food pantry. You could get to the basement from either the kitchen or the exterior “loading” doors as I called them.

 

As an adult my husband and I have lived in apartment complexes (I hated them, they were so cookie cutter and there were too many rules), an apartment in an old house, and have owned two Victorians. I loved it when we moved to the apartment in the old house. There was plate rail in the dining room. I have spent the last 18 years scouring the countryside for plate rail for both of my subsequent dining rooms. The butler’s pantry was probably my favorite part of that apartment, though. The land lord allowed us to work on the apartment in exchange for rent reduction. That place was gorgeous when we left.

 

My husband and I purchased our first house when I was 26. It was an 1880 Queen Anne in Rochester. We renovated every single room-4 rooms down stairs, 2 bathrooms, and 4 bedrooms upstairs. We took it down to the studs in every room except four that were already done by the previous owner. We tore out all of the carpets and redid every floor in the house, sanding some, installing new ones as well. We also painted the outside. When we were finished there were eight different colors on the outside bringing out every single exterior detail that was left on it.

 

Our current house in Le Roy is an 1884 East Lake where we have removed the remaining carpets, renovated two bathrooms, restored the plumbing to two that were not working properly, renovated the kitchen, the laundry/mudroom, and two bedrooms including the floors in the bedrooms (the others were already done). This past weekend we restored a window door and opened up a door-way that had been covered over by a previous owner decades ago and started in on the gigantic living room (with a lot of help from my brother).

 

I distinctly remember as a child falling in love with old architecture. Second Empire with its Mansard roofs is my absolute favorite and always has been. Brick or clapboard (no vinyl), it does not matter; I adore Second Empire. I also adore Gothic architecture with all of its angles and points. Both are a visual feast. Queen Anne is amazing, as well, with all of its curves and stained glass and turnings. Gingerbread details are a feast to behold. I do like classic Italianate structures as well with their cornices and cupolas. In truth East Lake is not my favorite, but I do not dislike it. It is a little too square for my personal preference, but I have come to adore this house. In fact as I sit here and type I wonder if the chimney next to me is encased in drywall. When we get to this room I am totally going to expose the brick!

 

Victorian architecture, as you can tell, is my favorite, but I also adore earlier architecture. My husband’s college roommate grew up in houses built in the 16 and 1700’s. They were equally as beautiful with their gigantic cooking fire places and low ceilings to keep the heat in. My love of old buildings goes as far as being able to identify who were the wealthy builders based on the windows.

 

Old houses and old buildings have such stories to tell. You can see the renovations, the additions, the changes, even the people who have been there. This amazing house we currently live in has two interior staircases. There is a small second story addition that houses the second one which was the “servants’ staircase, along with their bedroom and their kitchen/bathroom. There is something in the basement below the original farmhouse sink that makes me think it was originally a cistern. Last weekend I found what I believe to be the original screen doors for the front of the house. I cannot wait to get them up so everyone can see our gorgeous East Lake front doors. The best part of all of this is that our children (7 and 10) love it when we start working on the house. They want to tear down the other two walls that clearly are not original. I have never pictured myself living in a new or modern house. I was always meant to live in an old house.

 

I remember as a kid driving through Le Roy on the way to see my cousins in Pembroke. I always loved Le Roy’s main street. It reminded me of home, but smaller, with all of its old houses and old business district. In truth, I never really understood Batavia’s main street. I am sorry to say that as it sounds so harsh, but it is the truth. As a kid my parents drove us around the entire east coast. I remember liking places like Geneva, Le Roy, Naples, villages in Massachusetts and New Hampshire and Virginia.

New offer from LLC to purchase Wiss Hotel meets renewed opposition to preservation

Preservationists in Le Roy are making a last-ditch effort to save the Wiss Hotel building at the corner of Lake Street and Main Street, the gateway into the village.

Trustees gave Wiss Hotel supporters very little reason to believe during the course of Wednesday night's village hall meeting that they will accept this new offer.

"I'll reserve judgment until I read the proposal, but I have a mind right now that it needs to come down," Trustee Robert Taylor said.

Only Trustee Jennifer Keys is clearly a supporter of preservation and Trustee Jim Bonacquisti, who two weeks ago almost wavered on his opposition to saving the Wiss, came out strongly in favor of getting rid of the building.

Trustee Mike Tucci, who was adamant two weeks ago that the building come down, was absent.

Mayor Greg Rogers said this week, as he did two weeks ago, that accepting the offer is a sound business decision, but once again expressed a level of disagreement with the idea that the building should be saved.

Rogers said the board will discuss the offer in closed session at a time when all five members are present and vote on it publicly afterward.

Attorney Bob Fussell, who has been leading the citizen effort, told village trustees last night that the new offer addresses some of the apparent objections raised two weeks ago, when trustees failed to adopt a proposed counteroffer to the group.

The key points:

  • There is now officially a Le Roy LLC;
  • The group would pay $10,000 to the village at the close of escrow;
  • The time line for taking over the building and ensuring its safety is accelerated.

Even with these changes, a number of residents who attended last evening's meeting raised objections to the trustees selling the property to the LLC.

"We’re sitting here waiting for somebody to really get hurt, and the liability you’re going to incur is going to be a hell of a lot more then the cost of tearing it down," Jim Nielsen told the board.

Later in the meeting, Fussell countered Nielsen, noting that it won't be possible for the village to get the building demolished any faster than the LLC could take it over.

Resident Tom Spadaro offered $125,000 on the spot for the Wiss lot once the building is down and the hole is filled in. He said the lot is worth at least $250,000.

New estimates for tearing the building down range from $146,000 to more than $200,000, but it's unclear if that includes any liability for asbestos abatement or any possible contamination remediation.

Rogers said if the building is torn down, the village will actively seek a buyer for the lot at a market rate, even if takes a couple of years to find such a buyer.

"If we go through with taking it down, we're going to sell it and try to come out ahead," Rogers said.

Residents in opposition called the Wiss an eyesore, dangerous and a fire trap.

Eve Hens, who owns the adjoining building and has residential tenants, said she's constantly in fear of a fire at the Wiss.

"It scares the heck out of me that if there’s a fire in that building it could travel not only into our building, but all the way down Main Street," Heus said.

She called destruction of the Wiss an "urgent issue."

(CLARIFICATION: Possibly because of my misunderstanding, but Hens e-mailed to say that she isn't opposed to saving the Wiss, just that something must be done immediately because of the fire danger, whether it's demolition or restoration; it's an urgent issue.)

Fire Chief Tom Wood agreed it's an urgent issue, and stressed that something be done. But whether that means tearing it down or restoring it, isn't an issue the fire department takes a position on.

“There’s no possible way I can justify putting guys into this building during a fire situation," Wood said. "Absolutely not. Somebody would get hurt. I hate to say this, I would be lucky to save two building (if there was a fire). This building needs to be torn down or something needs to be done with it right away. We’re dragging our feet. Something has to be done either way you go."

Bonacquisti said he's done some research since the last meeting, and in reaction to those who called construction of the Walgreens in the village a mistake, he noted that the former buildings at that location generated only $4,3100 in sales tax revenue in their final year, whereas last fiscal year, Walgreens generated $9,400 in sales tax.

The store employs 23 people, including 16 Le Roy residents, he said.

People don't move to Le Roy, he said, just because of a beautiful village. They also like the fact that Le Roy is affordable, it is safe and it has good schools, and he considers Walgreens one of the village's businesses as well.

"I do a lot of my business here and I'll tell you, you won't find better customer service than Walgreens," Bonacquisti said. "I know profits go up the corporate chimney, that was a statement that was made, but that’s not a concern of mine. We’re making money here and people are working there."

For preservationists, destruction of the Wiss is more symbolic than a matter of saving a historic or elegant building, which nobody claims as descriptions of the Wiss.

"When demolition becomes the easy way out, we may be looking into a future that does not include a business district at all," wrote Lorie Longhany, who could not attend the meeting, in an e-mail to Fussell.  "A building here, another one over there and the historic nature of this community is gone forever."

Doug Hill said tearing down the Wiss could just unleash a domino effect that would eviscerate the business district.

“When you take that building down, then you’re talking about the building next to it and the building next to that," Hill said. "That’s where you are going to change this whole community. Not with tearing down the Wiss, but the fact that the Wiss property is not big enough probably to develop and you’re going to be going to the next building and the next building and tearing down.

"Pretty soon this is not going to look like a community that is attractive to live here. It’s not going to be historic any more. It’s going to look like off Mount Read Boulevard in Greece."

Candace Bower said her family goes back in Le Roy for 200 years and she for one thinks it's time for Le Roy to stop destroying its heritage.

“We need to stop wringing our hands and putting up more what ifs in the way," She said. "Just dream. This board can be the group that finally decided to look to the future of this village and see what it can be if we dare to dream.”

It's also just practical to save the Wiss, some preservationists argued.

Lisa Compton cited studies that show density equals greater economic benefit to a community.

Terry Keys, husband of Trustee Jennifer Keys, said that once the Wiss is gone, it can't be brought back and the LLC is the only group that has come forward with any kind of plan to do something productive with the building.

"The issue is are we willing to write a check and wait to see what happens or are we willing to take a check and watch what happens?" Terry Keys said.

Dennis Melander said he was initially opposed to saving the Wiss, but after reading Rick Hauser's report, he realized saving the Wiss isn't just a pipe dream, but a practical response to a real problem.

"I would object to any taxpayer money being used on demolition when you have a viable offer right here to take it off your hands and save the cost of the demolition," Melander said.

Fussell said that Hauser has estimated saving the Wiss will cost the LLC $400,000 and he already has verbal commitments for $200,000.

“There are people who are interested," Fussell said. "We may not be able to get it for a week, we may not be able to get it in a month, I don’t know. We may not be able to get it at all. But we’re already half way there.”

Trustees pass on offer for business group to buy Wiss, start process to have it torn down

All the experts agree, as Bob Fussell pointed out Wednesday night, the Wiss is structurally sound, but that doesn't mean it's not on shaky ground.

Wednesday, the Village of Le Roy trustees took two key steps that all but guarantee the irreplaceable building's destruction. The board failed to vote on a motion to make a counteroffer for a group of local residents to buy the property and then passed a motion to seek requests for proposal to have the old hotel demolished.

"You're being given an opportunity to have this $250,000 -- maybe half a million -- headache taken off your shoulders and you're asking us to pay $10,000 to boot," Fussell said. "We're probably willing to pay you that $10,000 just because we care about the community.

"We're willing to do something for you that's a huge value and every expert who's looked at it said it's remediable, even Clark Patterson has said you can remediate that."

The reference to Clark Patterson goes back to a three-page letter trustees discussed to kick off the meeting. Trustee Robert Taylor, according to Mayor Greg Rogers, was concerned about the condition of the Wiss and asked engineers from Clark Patterson Lee Design Professionals in Rochester to inspect the building.

Their three-page report, as discussed by trustees, said the building is currently a danger to the public. Youths have trespassed on the property and there are several potential safety issues that need to be addressed immediately.

But as Trustee Jennifer Keys pointed out, the engineers didn't say the building needed to be demolished, and on a merely visual inspection, they found no structural defects.

A more thorough inspection might be required to find any serious problems.

Trustees Taylor, Jim Bonaquisti and Mike Tucci all seized on the report to call for the building's immediate destruction.

"Obviously, this report kind of opened my eyes to a lot of different things," Bonaquisti said.

He noted that his family once owned the building so he knows the roof has been leaking for 30 years and that there have been no tenants on the third floor, because of the leaks, for those three decades.

He said the report noted that youths have apparently been playing beer pong in the vacant building.

"A great concern of mine is that somebody is going to get hurt," Bonaquisti said. "Now there's talk of somebody signing a release from liability and going in and putting a tarp on the roof. Even though we might not be legally liable, it sure would not make me feel very good if somebody went in there and got hurt."

Taylor said one of the things he learned from the report that makes him more comfortable with tearing the Wiss down is that the neighboring building and the Wiss don't share a common wall, so destruction of the Wiss won't harm the other building.

"And the very last paragraph of the report says that some major structural problems may have eluded detection because of limited access to some areas of the building," Taylor said.

Tucci said the report, in his mind, cements the idea that the Wiss needs to be demolished.

"It needs to come down and it needs to come down now," he said. "The report talks about the danger it poses to life and proprty and the surrounding area. If we continue to let it sit there and collect snow that melts and freezes and does it all over again, it's putting the assets of the village at risk."

Fussell, an attorney with experience in liability law, was taken aback by the sudden concern over liability for the village by Bonaquisti, Taylor and Tucci.

If there was such a concern for the danger of the building, Fussell asked, how come the insurance company for the village hasn't been demanding a cover on the roof or a scaffolding around the building or otherwise pushed the village to ensure the safety of the building?

"We've put in a lot of money and a lot of effort to do something for this community and all of the sudden these bogeymen concerns about liability," Fussell said. "You know I know a lot about liability.

"I'm a trial lawyer. I've been doing it for 40 years. I know a great deal about it. I know that this baloney that you've got about liability is nothing more than that. I'll be very blunt in telling you that."

Former Mayor Jim DeLooze -- who owns a building on Main Street that he said he's invested $250,000 in -- said he's very concerned about the fire danger presented by the Wiss. The first fire wall on Main Street isn't until 60 Main St. The fire department said six years ago, it won't fight an interior fire in the Wiss, but will only fight it from the outside, according to DeLooze.

"The number one responsibility of you five people is the safety of the people of this community," DeLooze said at the start of his statement, and concluding, "I have a very big concern that if that thing ever did catch fire, my building is possibily going to be in danger also. So I'm asking you as a former mayor, please do the right thing and have the thing taken down as quickly as possible."

DeLooze also questioned the historical value of the Wiss, and fellow Main Street property owner Jack Hempfling questioned its esthetic value.

"Most of the younger generation I talk to would feel like Walgreens and the Bank of Castile are the best looking things on Main Street," Hempfling said. "They're certainly not historical, but they (replaced the) eyesores that were taken down. Regardless of what anybody is talking about doing with the Wiss, it's still going to be one of the remaining eyesores in Le Roy.

"They say they're caring for the community. Some of us would think caring for the community isn't keeping it looking like it was in the 1930s. Some of us would say caring for the community is bringing it down and widening the intersection."

Lisa Compton said that since talk of saving the Wiss made the news, it's drawn interest from members of the Genesee County Landmark Society and the NYS Landmark Society, that even a trustee in Bethany has expressed an interest in investing in the project.

While the Wiss itself isn't historical, the structure could play an important role -- and losing it could diminish the chances -- of declaring the village a historic district.

"It's a significant part of the district," Compton said.

Mayor Rogers said he was only looking at the Wiss as a business proposition, which is why he put considerable time into drafting a counterproposal for the LLC to purchase the building.

"While their vision for the Wiss Hotel is nowhere shape or form what mine is, but from what I'll call a business standpoint, we always hear from people who tell you what they can't do, but very seldom do you hear from people who tell you what they can do," Rogers said. "We have people here who are the latter, who are willing to take a chance, who have invested their own money already and, quite frankly, if successful, would save the village $200,000.

"I don't believe they are looking to renovate the building to have the building be the eyesore it is now," Rogers added. "If somebody were to look into the future and think that's their vision, just to have the doors open over there, I would like to think in no way shape or form that's the ideal they have coming."

Rogers' counteroffer included a specific timetable for the LLC to meet, such as being legally formed, securing financing, taking possession of the building, shoring up safety issues and beginning renovations, as well as paying the village $10,000 once a certificate of occupancy was issued.

One of Tucci's objections to the project was that he didn't think the LLC could successfully rent the apartments. Fussell said there would be more market research done before the final floor plan was completed and if the market couldn't sustain five more expensive apartments, then seven could be put into the space at a lower monthly rent. Rogers pointed out that what the LLC did with the building once it owned it wasn't really a matter of village business.

When he called for a motion to approve the counteroffer, Jennifer Keys made the motion, but there was no second, so it died for lack of support.

Talk of possible ground contaminates that could drive up the demolition costs, perhaps to $500,000, almost had Bonaquisti convinced to back the sale to the LLC, but others pointed out that there is no evidence of ground contaminates under the Wiss.

With the counteroffer killed, Tucci made a motion to have the building demolished. This was amended to see requests for proposal to find out exactly how much it would cost the village to tear down the Wiss.

This motion passed 3-2, backed by Tucci, Taylor and Bonaquisti.

Le Roy group makes new offer to buy the Wiss Hotel

The new offer eliminates the prior provision that the village loan the group money to purchase the property. The village board will provide the opportunity to residents to appear at the beginning of its meeting at 7 p.m. on Wednesday, Dec. 12, in the Le Roy Village Hall to comment on the proposal.

A Personal Perspective - LeRoy's Wiss Hotel Dilemma

Last Thursday, I took the time to attend the Wiss Hotel Feasibility Study presented by Rick Hauser, CEO of Insight Architecture LLP.  In addition, I was able to take home a hard copy of the study which included photographs of the inside of the property.  I’m not ashamed to say I went into this presentation very skeptical and although I remain so, I guess I’ll say I’m less skeptical.  I guess I see The Wiss Hotel as a bit of the history of LeRoy.  I can remember my grandfather telling me that pre-Thruway, the Wiss was an overnight stop for travelers on Route 5.  It’s a piece of our Village’s history. 

I have to ask a fundamental question.  How did this building and more importantly, how was this building allowed to reach the current situation?  I realize the property has been vacant for a couple of years but don’t we have a Zoning Officer that monitors commercial building code in this town?  Maybe that was done and ignored by the owner(s).  In addition, understanding  the situation where the county and later the village took ownership, why was a salvage/restoration company allowed by the original owners to come onto the property and strip components of value?  We any of the resulting funds used pay back taxes and obligations?

Regardless, now the Village and its budget are left with a burden.  What to do?  There is the tear it down and sell the property school of thought that might possibly end up a break even or slight profit (with a lot of luck) to the village.  Then there is the question of what’s right for that property?  Please not another drug store scenario, we’ve made that mistake once already.  I’ve heard Starbucks or Tim Horton’s?  I for one feel we have a couple of well-established coffee houses, no more coffee joints please.  Lesson learned:  We put a couple of drug stores out of business with the last decision, let’s not put a couple of reputable coffee places in jeopardy.  What’s right for that corner, if not the Wiss is a question for careful consideration.

So then there’s the proposal we listened to.  Again, I was not in favor of “saving the Wiss” but I have to admit, I’ve put my sledgehammer away for at least the immediate.  I think there are a lot of questions to be answered but somewhere in Mr. Hauser’s presentation, there may be a reason to further delay the decision on the property and explore.

Mr. Hauser proposes a loan from the village equal to the cost of demolition.  I question whether this is even legal but were it to be so, don’t do it.  The village should not be in the business of funding private enterprise.  We have a couple of community banks with community spirited leadership; go see them for your loans.

  1. Mr. Hauser and his company have done an assessment, which seems quite well done of the property but what are his credentials in assessing structural integrity?  Shouldn’t there be a second opinion?  Before I laid out any contribution to the LLC, I’d want to be sure the end product was going to be structurally sound.  In addition, Rick Hauser’s company will financially benefit from this project.  This will need to be very well researched and contractual agreements well spelled out before progressing.
  2. There was discussion regarding Historical Preservation Funding.  I believe that typically requires others in the immediate area to join.  Are other property owners ready to assume that responsibility?   I remember 20 years ago that being explored on East Main.  I was not well accepted and never became reality.
  3. The project suggests 5 loft type apartments on the 2nd and 3rd floors. 4 apartments with rent of $1,300 and a small unit with rent of $790.  I question the likelihood of getting rent in LeRoy at those rates.  Especially considering the view from these apartments isn’t of the Oatka Creek or some other picturesque location.
  4. There are also 4 retail spaces bringing $850-1100/month rental income.  Will they be filled?  I think so, if marketed correctly.
  5. I’m also wondering what the local feel is for contributing to this LLC.  I liked the statement Rick made of “put your money where your house is”.  At the same time, it doesn’t seem like the return on this investment will be large or immediate.  Will people contribute an aggregate of $400,000? 

Conceptually, seems possible.  Reality, a significant amount of work needs to be done and this should not be a leap of faith.  Saving the building is the right decision if it can be done prudently and responsibly and most importantly, without municipal funding.

Architect shares vision for possible future for the Wiss, and the Village of Le Roy

The Wiss Hotel building in Le Roy can be saved, village renewal expert Rick Hauser told about 50 people gathered in the village hall last night to hear his presentation.

The foundation is straight. The walls are straight. It needs a new roof and nothing in the interior can be saved, but it's got "good bones," he said.

And the two-floor apartments on the second and third floors would be pretty awesome.

The total cost of the renovation? About $1 million, financed by the formation of a limited liability corporation that would raise $400,000 in equity and borrow another $600,000.

"In my experience, nice apartments are hard to come by, and in my experience, and again, that's all I'm going on, as well as the supply and demand in Le Roy, and that's more anecdotal -- there's a shortage of apartments," Hauser said. "These kind of apartments get good rent and rent for the full amount. They become your anchor tenant. You are going to fill the apartments."

The first floor would consist of four or five retail or business spaces, in the draft plan created by Hauser, CEO of InSite: Architecture. 

Hauser has been consulting with people in communities like Le Roy for a number of years, but the best example of his work can be found in Perry, his hometown, where he has helped community residents rehabilitate several old buildings and turn them into profitable, attractive, productive mixed-use complexes.

The property values of those buildings have gone, in general terms, from the tens of thousands up to $150,000 and even $250,000.

Every building has gone from a deteriorating eyesore to an attractive, money-making venture.

The first part of Hauser's presentation included pictures of the accomplishments of the Perry community in revitalizing their downtown area. He also shared how a Main Street, LLC works.

It involves getting 30 or 40 local residents to invest in the LLC, either making a monetary contribution or in-kind (a plumber doing the plumbing work in the building, an electrician doing electrical, etc).

This isn't charity. The investors can potentially share in profits.

They could also realize any tax benefits.

The biggest tax advantage would be realized if Le Roy could successfully get its downtown designated a National Historic District (Le Roy is totally appropriate for such a designation, Hauser said), then 40 percent of investments in building preservation becomes a tax write-off for investors.

If $400,000 of the $1 million restoration cost came from investors, each one would realize a 100 percent, potentially, write-off on their share of the investment.

The project isn't without difficulties and risks, Hauser said. There will be critics who try to stop it, creditors will want tenants before loaning money, tenants will want improvements before they commit and no improvements can be made until the LLC has some loans in place to help get the project started.

However, Hauser said, the trick to solving this "chicken and egg" problem is to treat it like a flywheel -- get a little momentum going and build on it. If a bank says, "yeah, we can loan you some money if you have a tenant" find a tenant willing to commit if financing is in place, and keep building piece by piece from there.

Part of Hauser's suggestion for the Wiss is for the LLC to borrow $200,000 from the village at no interest.

The estimated demolition cost for the Wiss is $200,000. Rather than spend that money with no possibility of return on investment, Hauser is suggesting that the money be committed to something that will turn the Wiss into an asset that will help spur economic growth and generate more tax revenue for the village.

When a group of people make this kind of investment in their community, Hauser said, they become the champions of the village that help drive economic growth. They shop more in the village and encourage others to support local businesses. They have a greater stake in the economic vitality of the community.

"When you ask people to put their money where their house is, it's self interest, but it's self interest writ large," Hauser said.

Asked if the Wiss was worth saving when it's not really an obvious architectural beauty, Hauser said he never really looked at the building that way. It's a potential asset to the community because of its size, scale and location. It's more valuable where it stands than as a vacant lot.

"Saving an old building is a tool for economic growth," Hauser said. "It creates jobs. It creates business opportunity. It brings nice apartments that attract people who have stable incomes and is a catalyst for other initiatives that make Le Roy a better place to live. I don't really care about the architectural beauty of the building."

Group of Le Roy citizens make offer to purchase, revitalize Wiss Hotel

A group of concerned Le Royans has made an offer to purchase the Wiss Hotel  from the village. The offer was made after Rick Hauser, of In. Site: Architecture LLP in Perry, who conducted a comprehensive investigation of the building on the group’s behalf.

Mr. Hauser concluded the building could be a viable business entity consisting of five beautiful residential apartments on the second and third floors, and several commercial establishments on the first floor. The cost of the project will be about $1 million. (While tearing down the dilapidated building and replacing it with a structure of equal value is estimated to cost several times that amount.)

The goal is, over the next few months, to form Le Roy, New York LLC, to purchase the building, and to find interested community members to join the LLC and to invest their work and/or money into the project, and to obtain loans from entities such as the GCEDA and from the Village of Le Roy itself.

The offer is to purchase the building for a dollar, and have the village lend the LLC the money it would cost the village to demolish the property. This plan will transform the Wiss from a major liability into a profitable investment for community investors, and an asset all Le Royans can enjoy with pride.

Consultant says there are options for saving Wiss Hotel building in Le Roy

Le Roy's Wiss Hotel, often referred to as a lost cause, may yet be saved.

A group of citizens pooled their resources and hired Perry-based revitalization expert Rick Hauser to conduct a feasibility study on whether the Wiss could once again be a viable business.

Hauser's short answer: Yes.

Though an expensive proposition, the old hotel building is structurally sound enough to be restored and the resulting mix of retail space and apartments would provide a return on investment.

Hauser's report suggests creating a limited liability corporation that would take the lead on the project.

Funds would come from investors -- both cash and in-kind (such as a plumber doing work in exchange for shares in the company -- tax abatement and a no-interest loan from the village.

Rather than spending upwards of $400,000 to destroy the Wiss and remediate any existing environmental problems, the money would help seed the restoration and rebirth of the building at the corner of Route 19 and Route 5, the west-end entry into the village.

The village would also need to apply for and receive National Register Historic District designation that includes the building.

The financial analysis also assumes a 10-year PILOT grant from the Genesee County Economic Development Center.

Hauser's feasibility study proposes four retail spaces on the first floor and five large, high-ceiling, light-filled, market-rate apartments -- ranging in size from 800 to nearly 1,400 square feet -- on the second and third floors.

Under such a plan, at 100-percent occupancy, the building would eventually turn over $34,000 in annual net profit.

There was little discussion of the report -- which wasn't an item on the agenda -- at the village board meeting Wednesday night.

Supporters of the project said they just wanted to get the report in the hands of trustees quickly, before the village committed to destruction of the building.

Village acquires former Wiss Hotel, will seek grant for demolition

The Village of Le Roy has acquired title to the former Wiss Hotel. The question now: What to do with it?

The village would like to find a buyer, according to Mayor George Brady, but with demolition costs reaching well into the six figures, the building probably needs to come down before any commercial developer will take a look at the parcel.

"The hotel is right at one of the major crossroads of the nation," Brady said. "Unfortunately, it was built before there were cars and it's filled with that miracle substance of the 1930s, asbestos."

The village will seek an emergency grant from the state or feds to help pay for the demolition, Brady said.

If a buyer comes along before then, the asking price is just a few hundred dollars for the county filing fee.

Demolition of Wiss Hotel may be more costly than first reported

Demolishing the vacant and ramshackle Wiss Hotel in Le Roy Village could cost at least twice as much as the Genesee County Legislature discussed Wednesday night before voting to forgive tax liens on the property.

A local real estate investor -- who asked not to be identified -- said he looked at the property one time and had a Rochester-based demolition company give an estimate on taking down the building. The low-end best guess was $175,000.

The investor said that's the price for tearing it down without an asbestos inspection and hauling the material to a dump that would accept potentially contaminated material.

If it could be confirmed before demolition that there's no asbestos present, tearing the structure down and disposing of the material could be cheaper. But an asbestos inspection costs $35,000.

If an inspection was done, he said, and asbestos was found, then the demolition price would climb beyond $175,000, perhaps beyond $225,000.

And that's before dealing with any potential contamination from the former NAPA location next door on Route 19.

It's a great location, he said, but realistically, any investor would need both properties to make it a suitable space for modern retail. The potential expense of buying and leveling both properties so a new business could be built, would eat up most potential profits -- even if the hotel parcel was bought for the price of the tax liens.

With the county washing its hands of the property, it becomes the problem of either the village or property owner.

Gene Sinclair, Le Roy code enforcement officer, said he isn't sure what the village will do. In early 2010, the village started down the path of declaring it an unsafe building, but backed off when it became clear what the potential demolition costs would be.

The investor said the interior of the building is in pretty bad shape and gives anybody who looks at it a pretty clear idea that the building needs to come down.

"I'd hate to wake up some morning and read that the building has fallen down with a couple of people buried under it," he said.
