Police Beat: Three Clinton Street residents arrested following child-welfare investigation

Cassi Ann Schutt, 23, of 111 Washington Ave., lower, Batavia, is accused of criminal possession of a controlled substance and endangering the welfare of a child. Deputies came into contact with Schutt as the result of an investigation into two young children found wondering on Route 33 at 9:05 a.m., Wednesday. Schutt is accused of keeping the children in a situation that was unfit and improperly supervised.

Lonnie Ann Fairbanks, 43, of 5263 Clinton St., Apt. 1, Batavia, is charged with criminal possession of a controlled substance and unlawful possession of marijuana. Deputies came into contact with Fairbanks while investigating a possible endangering-the-welfare -of-a-child case at 5263 Clinton St. Road. Deputy Brian Thompson reports that he found Fairbanks allegedly in possession of Schedule IV Propoxyphene and marijuana both in the residence and in her car. Thompson reports the alleged drugs were in plain sight.

Jay Daniel Lucas Schutt, 22, of 2 Gas Lite Lane, Batavia, is charged with criminal impersonation. Schutt allegedly gave deputies a false identity and fake birth date during an investigation on Clinton Street Road into a case of two children found wandering on Route 33. Schutt allegedly gave a false identity because he is accused of deserting from the Army. Schutt was turned over to the Army for transport to Fort Drum.

Jacob James Meinhold, 19, of 2537 Dodgeson Road, Darien, is charged with burglary, 3rd. Meinhold is accused of gaining forced entry to the Oil Doctor and stealing NYS certificates of inspection.

Edward Frank Finnin, 43, of 4063 W. Main St. Road, Room 6, Batavia, is charged with exposure of a person. Finnin is accused of urinating in public at 12:55 p.m., March 20, outside the Metro Mattress store on Veterans Memorial Drive.

Tonya E. Smith, 38, 3582 Lockport Road, Oakfield, is charged with criminal contempt, 2nd. Smith is accused of sending letters to a protected person in violation of a stay-away order.

Dying for ones country, with honor, is certainly NOT punishment, my friend, however desertion is, and should be punished VERY harshly (maybe not death but a couple decades at Leavenworth would be sufficient).

This is Christina Schutt....to everyone who is hating on my husband jay schutt have no clue what you are all talking about....He is a hard working loving father and husband and has never done anything wrong. yes he made a mistake but no body is perfect. he did not desert the army he stayed here because i was unable at the time to raise our children so he did wat any loving father would do and stayed to make sure his kids were taken care of so if anything it was my fault e was awal. and the whole time he was home he kept in contact with his superiors and they all knew wat was going on. and he did not leave irag...he never went because he broke his wrist and had to have major surgery so they didnt send him over....the news IS NOT always right...before you go jumping to conclusions you should get your facts straight....now if anyone has anything to say email me at csanchezanderson@live.com and i will set you straight....HE DID NOTHING WRONG.... everyone makes mistakes......

Ok this i Jay Schutt now before my unit deployed in dec. i was begging to go down range i couldnt wait!!! i broke my wrist while on duty, before that i was promoted early TWICE! i won soldier of the month in June 09 i won soldier of the quarter in July 09 and was going to participate in soldier of USAEUR (US Army Europe) in Feb. I came home on leave in feb for a death in my family now i was faced with a tough decision of go back to the army or stay here and do what my kids needed me to do i stayed the whole time i was home i kept in contact with all the right people they knew where i was and what i was doing at all times. now before any of you judge me take a hard look in the mirror your blogging on a batavia news website that isnt even accredited now before i run circles round all of and mess up all your emails (believe me i can) please get your stories and facts straight and please dont judge me for i am a father before i am a soldier.

Are you charged by the Army with AWOL, or missing a deployment? Are you under any kind of confinement or restriction? If not, then you should be able to make the 3 hour drive from Fort Drum and maybe give Howard an interview.

Jay, its one thing, to leave the service for an injury, and another, to threaten to hack into someones e-mail. It is a threat, Id like to see you try. Is the Army aware of your cyber threat? Its no way to conduct yourself, when representing your country. Calm Down and realize, this is Batavia. People jump to conclusions around here, every day. How you deal with it is up to you.
I never understood why the punishment was so severe for going AWAL anyway. You mean to tell me, if one of our sons or daughters ran home, out of fear of being killed in Iraq, we would send them to Levenworth for a couple of years?? Thats crazy!
I guess until any of these "Brave Batavians" have walked a day, in a 50 lb kevlar vest, in 100 degree desert weather, dodging bullets and bombs, seeing your buddies, and civilions, blown to bits, leaving your home, to give your life, for your country, can any of us pass judgement...

My sympathy is with the two children found wandering on route 33. So, Christine and Jay, if your argument is that he went AWOL to care for his children because you were unable to...I'm not buying it. My only question is...where was he when the children were endangered?

Yes, we can pass judgement. Some on this site have served, and didn't end up on any AWOL list.

In addition, you take and oath and sign a contract to serve. There is even time to drop out while first in training.

There is also a procedure in place to address sudden and unplanned family care issues, if any. But not reporting to duty is not one of them.

i am just as mad at him about it as you all are...how do u think i felt when i got a phone call at 11 in the morning about my children almost being killed. i understand you dont feel bad a wouldnt either but to pass judgment on someone you dont know and have never met is wrong to. everyone makes mistakes...i bet you have to. but how do u think he feels... his kids are his everything and for him to know he failed as a father that day kills him inside. i think you all need to just mind your business and worried about your own lives and your own problems....if you all ask me i think you all need to get a life and stay out of ours.....you are no better then us...and if u think you are you think wrong...like ive said a million times everyone makes mistakes...this one just happens to be bigger then others...now please stay out of our business

Find me one news organization in the United States that is accredited? It's not the Batavia Daily News. It's not the Buffalo News. It's not the New York Times. It's not CBS or CNN. It's not even Stars and Stripes. So what are you talking about?

An amazing bit of theatrics. The drama of relating the story to put the man, who endangered the lives of his children, in a postive light is admirable but misguided.
Everyone makes mistakes, true. But could you casually brush aside his mistake if the children were harmed in any way.
AWOL is a breach of contract. It isn't something that should be taken lightly. If, in fact, he is headed for Leavenworth then it may be the best place for him. He might be able to get his life in order.
Yes, threatening to hack the emails of those who post to this site was a childish reaction, but it should also be taken seriously. Hacking accounts, and admitting that one knows what to do in order to cause another person's account harm is serious business.
Belittling this side as not accredited was another childish statement. Are you getting the thread here? Childish. This man/child is the person to whom you trust the lives of your children?
You may think we are critical of your situation, but each child in our area is our concern. Their safety is important. We trust thier parents to treat them as the treasures they are.
When an adult abuses that trust, it becomes the concern of everyone in the community.
This man has not given any indication that he was trustworthy or honest. He stated, above, that his superiors knew of his situation. Now we learn he is going to Leavenworth. If the first statement was true, then why is he headed to Kansas?

For the past number of years, most soldiers, male or female, who have gone AWOL over verifiable family issues, have not gone to Leavenworth. Most are reduced in rank to private (E-1), loss of all pay and benefits, maybe fined, and given a Dishonorable Conduct discharge (not something you want to go through life with). Some are allowed to stay in the service, but reduced in rank, fined and other restrictions. Each case is judged separately.

Could be wrong on this, but I bet there is more to his AWOL than just family problems.

Even the military has due process. Somebody isn't going to be arrested one day and a few days later already know he's going to Leavenworth. Court systems just don't work like that.

C’mon, let’s not be coy. This thread is not about watching out for children, or military members’ responsibilities, etc.

It’s ironic that four or five sentences from a police report results in self righteous outcry yet several personal posts begging for a little crumb of compassion invokes nothing but an uproar over which website account is being accessed, arrogant demands for explanations and apparently, alibis.

To assume absolute, unequivocal guilt is not only unconstitutional and absurd, it’s damn scary.

Really, it was pretty obvious that whoever posted the “accredited” comment was unaware of or confused by the correct definition of the word; and the “threat” made in frustration. I’m getting heated and this has absolutely nothing to do with me.

See, that’s the point. It has nothing to do with any of us. Beat your breast all you want, this is nothing but gossip.

I’m fairly confident the appropriate authorities will somehow manage to sort all of this out themselves. They might even choose to rely on obscure things such as evidence and proof, rather than uninformed judgments and unverified information presented as fact.

I hope Christina and/or Jay considers deleting their posts. This thread has made me sick.

I agree Julie. How about a little compassion? We've all made mistakes. Let's just hope that Christina and Jay learn from their mistakes and get the help that they need to move on with their lives and be positive role models for their children.

However, when someone comes into the site they should expect feedback, good or bad.
People don't announce they will hack email sites and brag that they know how.
Nor do they relate conflicting stories about their plight.

This is sooooo confusing. All I know is I feel very sorry for these children...they are obviously suffering because of bad decisions of others. That said, I do give credit to whomever did the apologizing. For them to say it was childish was well...brave. I know people who couldn't apologize if their lives depended on it...let alone say it was childish.

I'm with Lorie... These poor kids. Possession charges, unfit parents... Regardless of excuses, Child endangement investigations aren't just picked at random. Obviously there is way more going on with this family than just Awols and poor judgement. My heart goes out to these children. I hope the parents can pull it all together and give these kids what they need.
