Today's Poll: Do you support the increase in the cigarette tax?

Is it my imagination, or is there more tax on the product than the actual cost of the pack? Man, the reservation is going to be busier than ever, illegally selling to non-native americans. Maybe some more seizures by the state police can help increase fine revenue for the offenders. We already do sobriety checkpoints, why not tax checkpoints? If these lands are truly sovereign nations, they should understand what excise and duty taxes are. You get them when entering from a foreign country, why not an independent country that is within our boundaries?
We need more revenue to fuel the monster money eating machine that is NYS.

If there's no provision in existing compacts for reservations to collect taxes on cigarettes to non-tribal members, then the reservation is under no obligation to collect any such tax.

If there is no provision in the existing compacts to prevent the reservation from selling cigarettes to non-tribal members, then there is nothing to prevent the reservations from selling to non-tribal members.

And without a provision on the compact dealing with either of these issues, it would be illegal (and unethical) for New York to try to impose a tax by any means.

They raised the fee for stores to sell cigarettes and now more taxes on cigarettes is forcing many small businesses to decide not to sell cigarettes anymore because they don't make much profit from those item(s). More taxes on soda and snack foods is just going to give WalMart another monopoly over the little guys. Good luck collecting anything from the reservations because they will fight NYS just like they have in the past. Our state has been in a downward spiral for so long now it's ridiculous. Meanwhile the politicians can't pass a budget but still get paid ?

If the reservations are truely an sovereign nation, why not set up border check stations and require a passport to exit or enter. This way an import duty could be assess on all products entering the US.

Good question, Tom. Maybe it will be a tax on something a non-smoker enjoys. How about a higher alcohol tax, let's say three times the actual cost of a six pack or a bottle of booze. Maybe a bar tax where each drink served over the counter carries a hefty tax. I wonder how much yelling and screaming that would cause?

McDonalds; for example, earns in the neighborhood of 2.6 BILLION dollars per year. If McD's alone collected a 1 percent extra "FAT food" tax, it would earn the state 26 MILLION dollars. Add BK, Wendy's, Arby's, etc. to the mix and the state would be out of hock before you know it. Nearly everyone partakes of fast food in this country at one time or another, and who would actually quit going to these places if they added a measly percent? Nobody. And if they did, tough for them and more fries for me!

Collect from the masses, and leave the damn smokers and Native Americans alone. You'd think that smoking was the only bad habit around, and it's clearly NOT.

raising the taxes isn't going to solve the budget problem Albany. Furthermore it really will not get large numbers of people to quit smoking. It will get some to quit smoking but not a whole lot.
I'm still trying to figure out how Albany even thinks that they can try to tax anything being sold on the reservations. I thought that the Reservations do not even fall under state law. Do they not fall under Tribal law and Federal law? Aren't the Reservations Federal entities? That would be the same as New York State trying to collect state sales taxes for items sold on Fort Drum.

Hey Albany do your job. You are stealing from me and the other tax payers right now. You are in violation of State law. You have not passed a budget and it appears as though you have no intentions of doing so.

As a smoker, I don't like the tax increase, but at some point, the price of smoking will lead me to quit. And like another reader pointed out, when many smokers quit, who will be next to make up the lost taxes. What will happen if the Native Americans set up toll boothes where the NYS thruway runs through their lands. If I were a Native American, I would be incensed at the state, and it's attempt to circumvent signed treaties. Great advice tp, how about 50 bucks a car to drive into this foriegn land via the thruway, be careful what you wish for.The state is after smokers now, but who might be next, the overweight, gamblers, drinkers, people who get traffic tickets, thrill seekers, after all, these behaviors could lead to health risks.

If the purpose was to eliminate or reduce the number of people smoking, then it will have some impact.

If it was to raise money, then as more people stop smoking, you lose the tax money you had planned on. It's like the Thruway. They raise the toll and fewer people use the it. They then have to raise the toll more, but lose even more money.

Another example was when New York raised taxes on the very rich, they lost money. At some point, high taxes reduce the amount of taxes raised.

If the tax increase brings in less cigarette tax money due to less demand, where will the State get the money to make that up?

And budgeting in money from Native Americans is a smoke screen if you don't really do it. Makes it look good on paper, but its phony bookkeeping. How many of you, even if you support taxing them, really think the State will really do it?

Fact of the matter is Tom, people are not that smart. With all the dangers with smoking, people still do it. Being a non smoker the tax does not bother me. What does bother me is that NYS will without a doubt spend this money foolishly. You want to tax the heck out of the smokers? Go ahead, they deserve it, they are foolishly killing themselves and polluting the air I breath, but use the money wisely...how about using it for real "iron clad" quit smoking programs that will help people kick the habit, or programs that will help pay for people when they end up with an oxygen tube up thier nose, or in the cancer ward and still insist on smoking, but cant pay thier med bills. Instead of raising MY premiums to pay for something they did to themselves use some of this money to offset the cost so the clean non smokers are not penalized.

And as far as the native americans go...if NY is going to go forward with taxing THEM get ready for a war. Remember last time with the burning tires, ect ect? Yikes....

Yeah Tim, we are all just in awe of your wisdom. As 1 of the not smart people, i agree with Bea. Triple the cost of alcohol, the real killer legal drug!!!
When it comes to fast food, candy, and soda , when the tax hike comes , you guys will be crying like a 2yr old.
I thought this was America. Free choice and all that. keep drinking that kool-aide

Really Tom? Your going to use the "free choice" defence? When I am munching on my cool ranch doritos i am not hurting anyone around me (with the exception of my flatulents) :) But to have to breath in someone else's recycled smokey air is another thing.... :(

However you do bring up a good point though, the state will no doubt just love the extra revenue created from this tax so much that they will just start going wild finding other "sins" to tax. Although the smoking one and the alcohol one i agree with, i do realize there will come a day when my beloved cool ranch doritos will get hit with a hefty tax as well :(

Tom I agree with alcohol being a big killer, will they tax it as high as cigarettes? Never, people would just make there own and then “bootlegging” would return. How easy is it to make your own booze compared to making a cigarette?

With so many anti-smokers and a high population of smokers it is a reason they will keep taxing it higher and higher one groups gets mad the other happy. And Tim couldn’t your premium going up also include the obesity problem,more NYS taxes, and greedy insurance company. I don't know I don't have insurance I go to the doctor it comes out of my pocket.

Yes I smoke Yes ive tired but its pointless to keep taxing smokers for what... is it going to help the money problems of the great NYS? Where is the money realy going? It is a problem with me cause there slowly taking away rights of people. Yes you can go buy this that or do this but theres a tax on the tax thats taxed. When is it going to stop? It wont because the government cant live like everyone else and Live within your means. Sorry for the ranting.

idk what the federal tax law is but when i go to germany every summer im allowed to bring back 1000 cigarettes or 100 cigars. so i assume the rez would be able the same. 5 carton max type of thing
