Graham Corp. to hold annual stockholders meeting Aug. 11 virtually, due to COVID-19

Batavia-based Graham Corporation (NYSE: GHM) announced Tuesday that due to the ongoing public health impact of the COVID-19 pandemic, and to support the health and well-being of its stockholders, directors, officers and employees, the format of the Annual Meeting of Stockholders (the "Annual Meeting") of the Company has been changed.

As previously announced, the Annual Meeting will be held at 11 a.m. on Tuesday, Aug. 11, Eastern Time, however the Company has made the decision that this year's Annual Meeting will now be held solely by remote communication, in a virtual-only format.

The Annual Meeting will not be held at a physical location, and stockholders will not be able to physically attend the Annual Meeting. This does not represent a change in the Company’s stockholder engagement philosophy, and the Company expects to resume in-person stockholder meetings next year. 

In order to attend the virtual Annual Meeting, stockholders of record as of the close of business on June 19, 2020 must sign-in via the internet at www.virtualshareholdermeeting.com/GHM2020.

To vote at the virtual Annual Meeting, stockholders will need their 16-digit control number included within their proxy card, notice of internet availability of proxy materials or voter instruction form.

Fourteen GC students earn third-place honors in annual digital media competition

Despite cancellation due to COVID-19 of the annual media awards event called "The DIGIES" put on by the School Library System, there were more entries than ever this year and a total of 14 third-place winners from Genesee County.

The system's media conference, festival and awards is a program of the Genesee Valley Board of Cooperative Educational Services -- BOCES.

The mission of The DIGIES is to strengthen the digital media continuum between PreK-12 schools, higher education and professional institutions. The DIGIES recognizes student potential in an annual festival format and students compete from all throughout the region and the Upstate New York area.

The year’s festival awards event was scheduled to be held last month at The Strong National Museum of Play in Rochester. 

Emilee Hillman and Andrea Fetterly, Library Technologies’ specialists coordinate this conference. Fetterly said that school building closures due to COVID-19 did not dampen enthusiasm for this year’s festival, which drew a number of entries.

“We are excited to celebrate the amazing creativity and skill demonstrated by the participants in this year's DIGIES festival," Fetterly said. "Despite a shortened in-person school year and extraordinary circumstances, students continue to achieve great success."

Schumer vows to fight for $25B for USPS: 'Pandemic has crippled a lifeline service for countless Americans'

A day before he heads back to Washington, D.C., to lead negotiations on the next coronavirus recovery bill, COVID-4, U.S. Senator Charles Schumer revealed that U.S. Post offices, including those across Upstate New York, could be forced to shut their doors unless they get an immediate infusion of funds and the personal protective equipment (PPE) and supplies needed to keep workers and the mail-receiving public safe.

Schumer, citing the worry, made a vow, today, to fight for a critically needed $25 billion for the USPS so they can keep the doors open and the mail moving for all Americans.  

“All across Upstate New York, from Western and Central New York, to the Finger Lakes, Southern Tier, Capital District, Hudson Valley, or beyond, the USPS performs a lifeline service for countless Americans and the people of New York that must continue amid and beyond this pandemic,” said U.S. Senator Charles Schumer.

“The fact is, the coronavirus has severely crippled USPS operations and their funds. Despite that, they have kept the doors open, the mail -- and really the economy -- moving, and now they need the help to sustain their pace. The fight to keep our post offices open by injecting the dollars needed to do the job and purchase the personal protective equipment and cleaning supplies required to keep everyone safe will begin tomorrow, and I am here to say: I vow to lead it."

Schumer explained the fight to keep post offices across the country open will begin this upcoming week. He said the services provided by USPS amount to lifelines for millions of Americans that cannot be replaced or easily replicated, especially in certain parts of the country.

Schumer detailed how the coronavirus pandemic has crippled our post offices and their operations as he stressed their relevance and importance to our larger economic recovery.

According to the Associated Press, mail volume is down by more than 30 percent from last year because of the coronavirus, and the Postal Service says losses will increase by more than $22 billion over the next 18 months.

Schumer added that the monumental costs of personal protective equipment (PPE) are also driving huge costs for the USPS. Those supplies are needed to keep workers and the mail-receiving public safe. Schumer said the USPS will need dollars to purchase the PPE it needs, in addition to funding to offset the aforementioned operational shortfalls delivered by the coronavirus.

“We are unable to predict the duration of COVID-19 business closures and the duration of the recession we are currently experiencing: however, this situation will materially damage our financial condition,” said USPS Chief Financial Officer Joseph Corbett.

“While we continue to conserve capital and reduce expenses in areas where volumes are declining, our ability to continue to serve the nation will require substantial finding from the federal government or other sources.”

“The bottom line here," added Schumer, "is that without the U.S. Postal Service in operation, we might as well stamp ‘Return to Sender’ on any economic recovery plan that is presented.”   

The U.S. Postal Service is the only delivery service that reaches every address in the nation: 160 million residences, businesses and Post Office Boxes. The Postal Service receives no tax dollars for operating expenses and relies on the sale of postage, products and services to fund its operations, according to the Service.

A State of Emergency was declared in the TOWN OF BATAVIA, effective at 6 p.m. on July 16, 2020.

This State of Emergency has been declared due to the existing and continuing declared States of Emergency at the Federal, State, County, and City of Batavia, related to the COVID-19 virus.

This situation threatens the public safety.

This State of Emergency will remain in effect for 30 days or until rescinded by a subsequent order.

As the Chief Executive of TOWN OF BATAVIA, County of Genesee, State of New York, I, Gregory H. Post, exercise the authority given me under Section 24 of the New York State Executive Law, to preserve the public safety and hereby render all required and available assistance vital to the security, well-being, and health of the citizens of this Municipality.

I hereby direct all departments and agencies of TOWN OF BATAVIA to take whatever steps necessary to protect life and property, public infrastructure, and provide such emergency assistance deemed necessary.

Ranzenhofer: Rare July session is an opportunity to help families and small businesses

It goes without saying that 2020 has been one of the most unpredictable and challenging years of our lifetime. The fallout from the COVID-19 pandemic will be felt for years to come.

As the Legislature prepares to return for a rare July session, many important questions remain unanswered.

In a recent Buffalo News article, it was stated that legislative leaders anticipated a “robust agenda” for the upcoming July session. It is my hope that we will not squander the opportunity and will start providing much needed clarity and assistance to families and businesses.

For years, I have advocated for increasing assistance to working families through an expansion of the Child Care Credit. This assistance is even more critical now as many families are struggling to find adequate childcare, while continuing to work from home.

In addition, it is critical that we develop plans to ensure that children and teachers can return to school safely and as soon as possible.

While I acknowledge that the current fiscal crisis could not have been predicted, it is still troubling that we have yet to be presented with the Governor’s suggested budget revisions.

Furthermore, it is impossible to ignore the fact that prior to COVID-19 the state was already experiencing an over $6 billion deficit. As part of my 2020 Legislative Questionnaire, over 51 percent of respondents said the state should address deficits by reducing spending and cutting outdated regulations.

Conversely, only 28 percent of residents advocated for tax increases or cost shifts.

Right-sizing New York State government is more critical than ever to ensure the quickest, most sustainable, economic recovery possible.

I strongly believe we need to examine how we utilize our economic development dollars. With so many small businesses struggling to survive we need to do all we can to assist them.

The Governor controls billions of dollars for economic development incentives to attract new businesses to the state. I can think of no better time redistribute these resources to support locally owned businesses.

In my previously mentioned questionnaire, nearly 53 percent of respondents said the state should not be in the business of picking winners and losers. Instead, they supported broad-based tax relief for businesses or not incentivizing private corporations at all. Only 13 percent of respondents believed that incentives were extremely important to help businesses.

Great challenges face government leaders as Legislative Session resumes. I hope the Governor and Senate and Assembly leaders will take real steps to assist hardworking families and struggling small businesses.

GCASA presses on as overdose numbers rise; Virginia Taylor elected as board president

The COVID-19 pandemic has not only adversely affected business operations and the economy, it also has fueled a surge in the opioid crisis, placing added strain on those in substance use recovery who have been isolated by state-mandated stay-at-home orders.

John Bennett, executive director of Genesee/Orleans Council on Alcoholism and Substance Abuse, drove home that point on Wednesday during the agency’s annual meeting via Zoom videoconferencing.

“Obviously, COVID-19 has changed how we do business and it has changed the landscape of where we were at a year ago,” Bennett said. “From 2017 to 2018, we saw a reduction in opioid overdoses across the country, and just last year alone there was a 5-percent reduction, according to the Centers for Disease Control.”

But this year, things are very different, he said, reporting that the overdose rate went up 18 percent from a year ago in March, 29 percent in April, and a 42 percent in May.

“So, overdoses are up 42 percent across the country, and I don’t think regionally that it’s any different. We’ve seen an increase in overdoses and overdose deaths,” he said.

Latest statistics were compiled by the Overdose Detection Mapping Application Program, a national surveillance system that provides near real-time suspected overdose data.

Despite the disheartening news, Bennett said that GCASA is steadfast in its mission to offer a wide spectrum of services to those in need.

“GCASA has been a regional leader in building new addiction services that normally aren’t in rural communities, and we continue to be committed to maintain our efforts to expand services so that folks in our regions and in our communities don’t have to travel outside the area,” he said.

Bennett, who took over as executive director in 2012, commended the board – “very committed and dedicated individuals who are kind and caring” – and praised his staff.

“To my staff who are on the call today, I’m super proud of all of you,” he said. “You’re always willing to pitch in and assist our community partners and advocate for people suffering from addiction.”

Outgoing Board President Brian Paris conducted the election of new board members and presented the new slate of officers.

Elected to their first three-year terms were as follows:

  • Jennifer Groff -- The director of fiscal operations and child support for Genesee County Department of Social Services, she has served on the GCASA Foundation board since 2018.
  • Stefano Napolitano -- The City of Batavia fire chief, he also serves on the Foundation board and his department participates in the Police Assisted Addiction & Recovery Initiative in conjunction with GCASA.
  • Jackie Gardner -- She is vice president of client services for Claims Recovery Financial Services.
  • Pattie Kepner -- She is the associate executive of quality assurance for the Arc of Genesee and Orleans, having worked in human services for more than 30 years.
  • Tim Batzel -- He is the business administrator at Alexander Central School, which contracts with GCASA for Prevention services.

Bennett thanked the outgoing board members for the six years of service. They are Paris, president; Shelley Falitico, Shawn Heubusch, Holli Nenni and Daniel Thurber.

The new slate of officers:

-- President, Virginia Taylor.

She holds a Ph.D. in Higher Education, which she received at the age of 50.  She is a recipient of the WNY Network for Women Leaders in Higher Education Bernice Poss Award, a Buffalo Business First 40 Under 40 Recognition Award, and Niagara County Community College Distinguished Alumni Award.

-- Vice President, Victoria Elsenheimer.

She is the executive assistant to the Vice President of Advancement, a position she has held for the past 12 years at Brockport State College. She joined the U.S. Army in 1989 and was enlisted in the Army Reserves for 17 years; honorably discharged as a Sergeant in 2006.

-- Secretary-treasurer, Frederick Rarick.

He is an attorney in Batavia; practicing law for 35 years in the representation of individuals charged with crimes. He is licensed to practice law in New York, California, and Washington, D.C. He was a past board member of the Genesee County Veterans’ Support Network.

Menzie, LeBaron Earn Scholarships

As previously announced, Jillian Menzie, of Bergen, and Ashlyn LeBaron, of Albion, received GCASA Foundation scholarships for 2020.

Each award was for $1,000.

Menzie is a 2020 graduate of Byron-Bergen Central School who plans to attend Brockport State College to pursue a nursing degree with a minor in Spanish.

In addition, she plans to study abroad as well as join the Army ROTC program. Throughout her high school career, she participated in many sports teams, music programs, and clubs. 

LeBaron is a 2020 graduate of Charles C. D’Amico High School in Albion and valedictorian of her class. She plans to attend either Cedarville University in Ohio or Roberts Wesleyan College to pursue a career in nursing.

She, too, participated in numerous extracurricular activities, including sports, band and orchestra.

GCASA’s Recovery Station set to expand hours, resume activities with guidelines in place

Genesee/Orleans Council on Alcoholism and Substance Abuse employees are keeping their collective fingers crossed as they look to resume activities at Recovery Station, the agency’s social gathering and recreation place in the former Bohn’s Restaurant building on Clinton Street Road.

“Beginning next Monday (July 20), and as long as COVID-19 cases remain low and there are no other restrictions put in place by New York State, the center will start allowing up to 10 community members at a time into the building for a variety of recovery activities,” said Rosalie Mangino-Crandall, director of Project Innovation and Expansion.

The public schedule for the reopening week is 10 a.m. to noon, 1-5 p.m. and 6-8 p.m. on Monday, Thursday and Friday, and 3-5 p.m. and 6-8 p.m. on Tuesday. The center will be closed on Wednesday.

Recovery Station Coordinator Sue Gagne said that the following health- and safety-related guidelines will be in force for all visitors:

-- Be expected to wear masks at all times while on the property;
-- Adhere to the 6-foot social distancing rule;
-- Have their temperature taken immediately upon entry to the center building;
-- Be asked a series of COVID-19 screening questions;
-- Be asked to use hand sanitizer and/or wash hands immediately upon entry.

“We will also begin to add more structured activities in the coming weeks,” Gagne said, noting that staff will be disinfecting furniture, equipment, table games and all rooms frequently throughout the day.

Currently, GCASA officials have allowed one-to-one sessions with Recovery Station peer advocates at the location, in addition to opening the center to staff and residents of the Atwater House residential facility.

Extra precautions at all GCASA buildings and offices at the Batavia and Albion campuses are being taken, said Executive Director John Bennett.

“We are going the extra mile when it comes to safety of our patients and staff,” Bennett said. “Face coverings must be worn by employees when they are walking in the common areas, when working with patients and even when they are alone just in case they happen to meet someone. Whenever there are two or more people in a room, a mask is advised to keep each other safe.”

Elizabeth Riter, director of Corporate Compliance and Quality Assurance, said that in addition to wearing masks, all staff members are required to attest to having taken their temperatures and are asked to complete a standard Covid health screening as they enter each facility.

“Similar to the Recovery Station, the Batavia and Albion Outpatient Clinics are promoting good health practices as we welcome patients back on the grounds for face-to-face services,” she said.

Riter added that masks are provided to any staff or patients who may not have one or forget to bring theirs, and that temperatures of all patients who enter are taken immediately and they are asked to sanitize their hands.

“Unfortunately, friends and family who are not scheduled to be seen will have to wait outside in order to minimize contact in the waiting areas,” she advised. “All offices and common areas have been modified to promote socials distancing, while enhanced cleaning schedules have been instituted in all facilities.”

The same stringent standards apply to the agency’s residential programs, Riter said, adding that new admissions coming from medical facilities have essentially been quarantined and screened before being placed into GCASA’s program.

Independent Living of the Genesee Region begins limited reopening today.

In mid-March, human service agencies were among the many facilities that New York State required to close their doors to prevent people from gathering and thereby stem the spread of COVID-19.

While they have continued to serve people with disabilities by phone, email and the Internet, now that the State has entered Phase Four, the Batavia and Warsaw, New York offices of Independent Living of the Genesee Region have reopened on a limited basis, observing strict rules for everyone’s safety:

  • Consumers wishing to meet face-to-face with a service provider must first make an appointment, and complete a screening questionnaire over the phone, the day before the appointment. If they do not have face coverings to bring with them, inform the staff at this time, so one can be obtained (if available), or the appointment can be rescheduled for a date when they can bring one. If the staff member cannot be reached by phone, they should not come in, to avoid an unnecessary trip.
  • On arrival, if the answers to four short screening questions are acceptable, they are to use hand sanitizer or wash with soap and water and take a seat in the waiting area until a staff member escorts them to a private, sanitized meeting room. If the answers are not acceptable, they will be asked to reschedule and contact their medical provider.
  • Consumers are asked to maintain a six-foot social distance, and refrain from hugging, shaking hands, fist bumping or other physical contact.
  • On departure, consumers should, again, use hand sanitizer or wash with soap and water.

Gov. Cuomo announces new COVID Rent Relief Program

Governor Andrew M. Cuomo on Tuesday announced an emergency rental assistance program that will help keep low-income families throughout New York in their homes.

The program, which is designed to reach those individuals and families with the greatest need, will provide direct aid for tenants who lost income due to the COVID-19 pandemic. The program is funded through the Coronavirus Relief Fund, which is part of the CARES Act.

The program is administered by New York State Homes and Community Renewal and access to program applications will be available here on Thursday, July 16.

"Since day one we made it clear that no New Yorkers should be thrown on the streets because of hardships caused by this pandemic," Governor Cuomo said. "It's critically important that people are able to stay safely in their homes as we progress through our data-driven, phased reopening, and the COVID Rent Relief Program reinforces that commitment with direct assistance to those in the greatest need."

Senate Majority Leader Andrea Stewart-Cousins said, "Despite the progress we have made in fighting COVID-19, millions of New Yorkers are struggling because of this virus and the economic crisis. Providing direct aid to overburdened renters will help these New Yorkers stay in their homes and be able to make ends meet. I applaud Senator Brian Kavanagh for advancing this legislation, my Senate Democratic Majority for passing it, and Governor Cuomo for signing it into law. While this effort will offer some relief, we know that government needs to step up and provide more support during this difficult time. We are going to keep advancing meaningful legislation to help New Yorkers, and we need the federal government to work with us and provide the resources our state needs."

Assembly Speaker Carl Heastie said, "For many New Yorkers, the COVID-19 pandemic has made the challenges of securing affordable housing even greater. The Assembly Majority has fought tirelessly for years to keep New Yorkers in their homes and in the communities that they helped shape. With many New Yorkers still out of work, we still need assistance from the federal government to help states deal with significant fiscal challenges. We must do everything in our power to help New York families. This rental assistance program, while still not enough to meet the tremendous needs that exist, is a step forward to lifting a financial burden off of our most vulnerable families. We will continue to look to do more to help people remain in their homes during this unprecedented time."

Under the new program, eligible households will benefit from a one-time rental subsidy paid directly to landlords and housing providers. Tenants are not required to repay this assistance. 

To qualify for the program, applicants must meet all of the eligibility requirements: 

  • Must be a renter with a primary residence in New York State. 
  • Before March 1, 2020 and at the time of application, household income (including unemployment benefits) must be below 80 percent of the Area Median Income, adjusted for household size. Applicants can find the Area Median Income for their county, based on household size, on HCR's website here.
  • Before March 1, 2020 and at the time of application, the household must have been "rent burdened," which is defined as paying more than 30 percent of gross monthly income towards rent.
  • Applicants must have lost income during any period between April 1, 2020 and July 31, 2020.
  • The application period will be open for two weeks. Residents can apply any time during the two-week period. 

HCR will prioritize households with greatest economic and social need, accounting for income, rent burden, percent of income lost and risk of homelessness. The rental assistance payment will cover the difference between the household's rent burden on March 1, 2020 and the increase in rent burden during the period the household is applying for assistance. Households can apply for up to four months in rental assistance for the months of April through July. The program is open to households that rent apartments, single-family homes, manufactured homes and manufactured home lots. 

Households with at least one household member with U.S. Citizenship or eligible immigration status are qualified to receive the subsidy. Tenants currently receiving a Section 8 Housing Choice Voucher for housing costs or who reside in public housing are not eligible for RRP assistance.

The COVID Rent Relief Program builds upon Governor Cuomo's efforts to protect New York's renters during the coronavirus pandemic. This includes a statewide moratorium on COVID-related residential or commercial evictions; banning late payments or fees for missed rent payments during the eviction moratorium; and allowing renters facing financial hardship due to COVID-19 to use their security deposit as payment and repay their security deposit over time.

While we need a lot more funding to cover a much wider range of people, including those currently homeless and those whose immigration status makes it difficult to access other forms of assistance, this program is an important first step toward supporting New Yorkers in need of relief. Tenants and landlords face enormous financial challenges brought about by our ceaseless fight against this virus. Representative Carolyn B. Maloney said, "The COVID Rent Relief Program is a much needed, common-sense approach that will help renters experiencing economic strain brought on by the pandemic. New York State is once again leading the way and the Senate should follow suit by passing the House's Heroes Act, which includes a $100 billion fund for rent relief, and H.R. 7301, the Emergency Housing Protections and Relief Act. Nobody should lose sleep worried about how they will keep a roof over their heads, especially during a pandemic. We must continue to take steps to help our nation weather this storm and deliver meaningful relief to the American people when they need it most."

Representative Nydia M. Velázquez said, "So many New Yorkers are struggling right now as a result of the pandemic and they are faced with an unbearable choice between paying rent, keeping their lights on or putting food on the table. The COVID Rent Relief Program will deliver critical assistance but this is just a small part of the overall need. I will continue to fight for additional federal funding to ensure that no New Yorker is forced from their home during an unprecedented health and economic crisis."

Representative Hakeem Jeffries said, "New York has borne the burden of the COVID-19 public health crisis, and our communities have experienced unthinkable pain, suffering and death. As we start to reopen the state carefully, we must ensure that the people and communities with the most need receive assistance to help make their ends meet. The emergency rental assistance program will reach those who are most at risk of losing the roof over their heads. This is an extraordinary crisis, and I thank Governor Cuomo for his extraordinary leadership."

Representative Grace Meng said, "For months, I have led calls for relief to be provided to New Yorkers struggling to pay their rent. I thank the Governor for establishing this program and look forward to doing more to help additional New Yorkers who have been forced to endure this severe financial burden through no fault of their own. But this is a first step forward to solving a major issue and I will continue to use my spot on the House Appropriations Committee, which funds the federal government-to combat the renter crisis. Batavia Youth Baseball's Board of Directors sets guidelines for the upcoming season during COVID-19 pandemic

A letter from the Batavia Minor League Youth Baseball Board of Directors:

Fellow Community Members,

During these trying and uncertain times, the Batavia Minor League Youth Baseball Board of Directors, coaches and players have been patiently waiting for the go-ahead to begin our season. We are very excited that the time has arrived and we look forward to getting back to the game that we love.

The Board has done their best in navigating the many restrictions and rules due to the COVID-19 pandemic, making the necessary changes to our operations to maintain social distancing and helping to ensure the safety of our players.

While we believe that we have the proper plan of action in place, it cannot be achieved to its fullest without the support of our community. 

The Board would like to share a few of our guidelines for the upcoming season.

All individuals should measure their body temperature to ensure that no fever is present prior to participating or attending each League activity. Anyone with symptoms of fever, cough, or worsening respiratory symptoms, or any known exposure to a person with COVID-19 should not attend any League activity until cleared by a medical professional.

Any individual, including players, at risk for severe illness or with serious underlying medical or respiratory condition should only attend League activities with permission from a medical professional.

It is strongly recommended that players travel to the field with a member(s) of their immediate household when possible. Sharing rides is highly discouraged unless absolutely necessary.

Players, coaches, volunteers, and families should vacate the field/facility as soon as is reasonably possible after the conclusion of a game to allow for proper sanitation of the facility and to aid in greater social distancing.

Social distancing is required for the entire complex, and the wearing of face covering is highly recommended when social distancing cannot be accomplished.

The concession stand will NOT be in operation for this season. Players should plan accordingly to bring their own drinks to ensure proper hydration.

Spectators:

  • Spectators must maintain social distancing when possible.
  • Spectators shall have NO access to the field, batting cages or player areas.

Residents of Batavia and Pembroke latest to test positive for COVID-19

  • Genesee County received two new positive cases of COVID-19, for a total of 236 positive cases.
    • The positive individuals reside in Batavia and Pembroke.
    • One of the positive individuals is in their 40s and one is in their 60s.
    • The positive individuals were on mandatory quarantine prior to testing positive.
    • Two of the previous community positive cases have recovered and have been released from mandatory isolation.
    • No new individuals are on precautionary quarantine due to travel from restricted states.
    • No individuals are hospitalized.
  • Orleans County received zero new positive case of COVID-19, maintaining a total of 269 positive cases.
    • Five new individuals are on precautionary quarantine due to travel from restricted states.

Friedman asks Legislature to lift hiring freeze for already authorized assistant DA position

Even before the pandemic struck New York, the Genesee County District Attorney's office was hit hard, according to DA Lawrence Friedman, by new discovery rules that greatly increased the workload of attorneys in his office, he said.

Now, his office is faced with the daunting task of catching up on a backlog of cases at a time when courts are scheduling defendant appearances further apart.

In order to maintain social distancing in courtrooms, courts are putting a time buffer between cases, which impacts the workflow and increases the time an attorney can be tied up in court, Friedman said.

"The same thing is going on in every court in the county," Friedman said. "We can't even imagine what that is going to do as far as our time commitments. We're concerned."

When the pandemic hit, Friedman's office was in the process of hiring a seventh full-time attorney to help with the prosecution load but before a new person could be brought on board, the county initiated a hiring freeze.

The hiring freeze remains in place but yesterday, Friedman asked county legislators at the Public Service Committee meeting to lift that freeze for this one position in his office.

"We're well aware of the financial difficulties faced by the county but the same pandemic that created the financial problem has only increased our need for the position," Friedman said.

Before the hiring freeze, Friedman did hire two new paralegals, authorized in this year's budget, to help with the workload mandated by the new discovery rules (under the new rules, there is more material to review and turn over to defendants in a shorter period of time).

"This is not a position we can just fill immediately," Friedman said. "We need a month to get the word out and collect resumes, schedule interviews, and make a job offer. Generally, attorneys like to give four weeks' notice. So it could be a couple of months, at best, before we're able to hire someone."

Only Friedman and First Assistant District Attorney Kevin Finnell have more than 14 months of experience in the DA's office and Friedman will retire at the end of 2021.

The workload in the office is also increasing because state troopers will start wearing body cams, which will mean more evidence to review in some cases, and the repeal of Public Service Law 50-a, which used to keep police disciplinary records confidential, has also made the discovery process more burdensome. 

"Our obligation is to make sure that information is disclosed to the defense," Friedman said.

The public defender's office, Friedman noted, also has six attorneys handling criminal cases but the office, Friedman said, handles only "a fraction" of the cases the DA's office handles. Since defendants might hire a private attorney or received assigned counsel, the Public Defenders Office doesn't handle every single criminal case in the county, which the DA's office does.

There are also state grants available to help cover the public defenders' budget, Friedman noted.

Friedman also noted that new City Court Judge Durin Rogers is "more demanding" and takes up more time on cases, and Town of Batavia Supervisor Greg Post has also asked for more DA time in the Town of Batavia Court.

No committee member offered any comment on Friedman's request nor is there an indication on when the legislature might consider it further.
